Human rights activist, Femi Falana (SAN), has revealed why the Petroleum Products Pricing Regulatory Agency (PPPRA) lacks the ‘constitutional power’ to determine the prices of petroleum products in Nigeria.

The cerebral lawyer during an interview with Vanguard on Monday, faulted the attempted announcement of petrol price by PPPRA claiming the decision was ‘unconstitutional’ as the price determination ought to have been done by market forces.

“With respect to the attempted fuel hike by PPPRA which has no power whatsoever to make the announcement accredited to it, I was made to understand based on security report that Nigerians were prepared to challenge the increase before the government came out to apologise.

“But as far as I’m concerned, the government is nearly buying time because the International Monetary Fund (IMF) has insisted that the prices of fuel be determined by the so-called market forces.

On one hand, Chief Femi Falana is arguing for market forces to determine pump price of petrol and on the other he seems to endorse government intervention based on security report. Yet again, he revealed that FG will still increase based on market forces to impress IMF.

By the way, PPPRA was set up by LAW to regulate the price of petroleum products based on MARKET FORCES among other functions. Yet Falana is insisting on the same market forces to prevail without FG through PPPRA protecting the public interest in a situation where the marketers gang up to fix an outrageous price as capitalists they are. What is Falana actually trying to say?

Dear Femi Falana why do we have NBA to regulate law practice instead of allowing the situation of "anything goes" in the legal profession?
