They’ve not even start the case. What they’re at the Supreme Court is to ask the court if PDP have the locus standi to sue another party. If the Supreme Court rule in favor of PDP the case will go back to high court and hearing will start.
I don't know where you guys keep getting this wrong notion from that if the Supreme Court rules I favour of PDP the case will return to the high court.....wrong bro, I say wrong. This was a case thrown out by the federal high court and court of appeal and now the Supreme Court admits it, meaning the cross examination was done which was not meant to be in the first place so on May 26th, judgment is what Nigeria awaits and you are saying it will return back to High court? Return for what when judgment will be dispensed by the Supreme Court either favourable to APC or not, ditto PDP. Case closed!

If shettima didn't violate the Nominations from two different parties, how about the bolded?

Secondly, The electoral Law is prevalent across all political parties.

By saying PDP can't sue APC for violating the electoral Law, is equivalent to saying your Neighbor can't sue you for physically abusing your kid because he's not a member of your household.

The issue of double nomination, which is the bone of contention at the SC, falls under Section 35 of the Electoral Act 2022, and it provides as follows:

"35. Where a candidate knowingly allows himself to be nominated by
more than one political party or in more than one constituency, his nomination
shall be void."

From the above section, you ll agree with me that the Legislators used the word *Candidate* instead of the word *an aspirant*. Therefore, if I am to argue in favour of Atiku, I ll go by way of literal interpretation of the law, and opine that, the Act, having used the word a Candidate, means that it has gone beyond party affairs, because a candidate is used, where a political party has concluded it's primary and produced a winner that will contest against other political party candidates. That if the Act had intended it to be an internal party affairs, the word ASPIRANT would have been repeatedly used, as seen in Section 29.

With the above line of reasoning duly canvassed and supported with judicial meanings of a candidate and an aspirant, the court may likely hold that truly PDP/Atiku has the locus standi to institute the suit.

This is my opinion though, which we all know that, the court has the final say, and will decide based on the arguments canvassed before it.

The Supreme Court Hearing/Judgement In The Case Of Shettima’s Double Nomination.

Case No. 18.SC/CV/501/2023

PDP (Appellant) Vs INEC and 3 Others (Respondents). (APC, Tinubu and Shettima).

The case was called…

PDP is represented Joe I.B, Mike Ozekhome, and others.

INEC was represented by Isaac Adebiyi,

APC was represented by Babatunde Agana, Bridget Amaemi, Gbenga Benson, Julius Ishola

Third Respondent (Tinubu) Omosonya Popoola

Fourth Respondent (Shettima) Oluronke Adeyemi.

The fourth respondent stated that there is a motion on notice… the motion was filed as a pre-election matters. The application was filed on the 8th of May 2023.

The judge held that it’s a pre-election matters

The fourth respondent withdrew her motion.

The motion of 8th of May 2023 is hereby struck out by the Judges.

According to the second respondent, the appellant is asking the court to hear the matter knowing that it has expired.

According to Joe I B… the appellant filed an appeal against INEC about double nomination, the matter was heard and even the 2nd respondent APC admitted to having double nomination under oath.

According to Joe Gazama, the issue of double nomination has been laid to rest in the case of Uche Nwosu.

APC in responding, stated that the honorable court should dismiss PDP’s appeal.

According to the judge, the Apc admitted to double nomination.

In response, APC stated that they didn’t admit to double nominations indicating that the case of Uche Nwosu we are talking about two party nomination which is Apc and AA… but in this case, the nominations are in the same party with us APC and the positions are presidency and senatorial. He went further to state that the appellant has filed the case in at the tribunal but wanting the Supreme Court to take over the duties of a case being currently tried at the tribunal…

The judge asked if the first respondent APC added it in his address which was an emphatic No…

The appeal was accepted and judgment set aside for 26th of May 2023.

I never mentioned jurisdiction, rather I said PDP went to Supreme Court after the high court and Appeal court dismiss the case that PDP did not have legal right to sue APC on how it nominates its candidates. If the case is brought by a member of APC it will be considered.
If the case is brought to the Supreme Court by PDP and according to you if they (PDP) lacks legal right to bring it up why is the SC entertaining it and not strike it out? Do you get my drift now?

Uche Nwosu contested under 2 parties APC/AA.
The 2022 Electoral Act did not give someone outside a political party to sue another party about their nomination. Only a party member can do such.
In this case PDP lacks the power to sue APC about how it nominates its candidate.

If this matter of jurisdiction is the case, what stops Supreme Court from throwing it out, why are they interested in the case all of a sudden and will even give judgment after cross examining the parties involved despite the fact that this case had been thrown out by a Federal High Court and Court of Appeal as a pre election matter which PDP has no locus standi to bring it up.....why? This is why I am interested in the case.....judgment will be served on May 26th, know this.

Appeal court can dismiss whatever they want to dismiss, but the Law cannot be dismissed.

PDP doesn't have the locus standi to call out an electoral misnomer that the law condemns?
So if your Neighbor violates the law, and you sues him, he would tell you that you didn't have the locus to sue him because you are not a member of his household? The law is the law.

That appeal court dismissed it is a story for another day.

In 2019, supreme court ruled exactly on this same issue which affected David Lyon.

However, I doubt the possibility of SC sacking Tinubu and APC, based on Shettima's double nomination. My reason is that, since it was brought as a pre-election matter, PDP, does not have the locus standi to institute the action. They should have waited till after election, to bring it by way of post election matter. Should the suit be dismissed for lack of locus standi, Shettima will still have to battle double nomination at the post election matters before the PEPT, where the court will decide it on the merit.

How did the case get to Supreme Court already?

And why did the Supreme Court fix May 26th for Judgment and not 30th or 31st?

Remember that May 26th is Friday while May 29th is Monday.

The implication is that if the Supreme Court sacks Tinubu on Friday, there will be no time for any entity to approach the Supreme Court requesting for interpretation and for a stay of execution of the judgment whilst the interpretation lasts before Monday morning when Tinubu is supposed to be sworn in.

Like I said, I am not expecting the Supreme Court to sack Tinubu but what if….

Today, it seemed as if a sledgehammer had hit the APC camp as they might have been caught napping by the PDP over a case filed at the Supreme Court which came up for hearing today.

The Supreme Court Justices would have given judgment today perhaps but they moved the judgement to Friday, May 26th.

And that day is now probably the most important day in Nigeria since the February 25th Presidential election this year.

Millions of Nigerians also were not aware of the case which came up for judgement at the Supreme Court today. The shenanigans at the Presidential Election Tribunal in the past few days were enough distractions to even imagine that a case of this magnitude was waiting at the Supreme Court.

What is the judgment to be given by the Justices of the Supreme Court , in a nutshell? It is to determine if the APC Presidential running mate, Alhaji Shettima violated Section 35 of the Electoral Act 2022 by having a double nomination, thereby voiding the joint presidential ticket.

There’s been precedence set by the Supreme Court in a similar case like this with Uche Nwosu of Imo State. The Supreme Court ruled against Nwosu and disqualified him. That precedent is what many legal experts are looking at to see if the Justices will rule against Shettima and the APC this Friday.

I have spoken to a few brilliant lawyers and their positions are that Shettima has no hope of dodging this case, with all the facts of the case on ground. A couple more lawyers I asked for a balanced opinion are undecided. They feel it can go either way, since the confidence in the Supreme Court in giving the right and expected legal judgments in the political space has been waning for a couple of years now.

If the Supreme Court rules on Friday that Shettima violated the Electoral Law, it would mean outright disqualification of him and Bola Ahmed Tinubu, since it’s a joint ticket!

If that happens on Friday, it would mean a couple of things might happen, depending on the further judgement given. It might mean that the person whom INEC declared as the second position holder in the Presidential Election would be declared the President-Elect. That would be Atiku Abubakar. If that is the case, then Atiku will likely be sworn in as the President.

However, if the Supreme Court disqualifies both Tinubu and Shettima without making any pronouncement on who should be sworn in, there would likely be an extension for a number of days, of the Buhari presidency. Buhari might continue for not more than six months and if he doesn’t wish to continue in office beyond May 29th, perhaps Vice-President Osinbajo might hold forth for a few more months if he too wishes, until another election holds. These are my own layman’s opinions on what might be the scenario and not cast in stone under any legal framework. So, the reader should take this part about an extension of the Buhari/Osinbajo tenure as hypothetical on my part.

There is another scenario too. If Atiku is declared as the winner and sworn in, the case at the Presidential Election Tribunal asking for the judicial interpretation of the constitution as it concerns the 25% in the FCT will definitely come up.

Now, here’s what I think of that section of the constitution. I believe that for a winner to be declared in any Presidential Election, that person has to win 25% in the FCT. I think it’s a no-brainer. My own understanding tells me that the ‘AND’ in that section of the constitution is not in anyway ambiguous but a conjunctive requirement.

So, if Atiku is declared the winner if the judgement on Friday dismisses BAT and Shettima, it is rather likely that he will still step down when the Tribunal gives a judgment on that 25% in the FCT matter. If that happens, Atiku and Obi will slug it out in a run off election, going by the Electoral law, because BAT and Shettima would have been disqualified from running in that run-off.

So, you now can see why this Friday the 26th of May is an important day for millions of Nigerians.

I can only imagine the kind of pressure the Honourable Justices of the Supreme Court are under right now.

Nigerians can only hope that they give the judgement which satisfies their consciences according to the rule of law.

I have not seen this point discuss in any forum.*

What this means is that these servers can scale_in or scale_out. *THE FACTS OF 25TH FEBRUARY PRESIDENTIAL ELECTION*

1. One accreditation was done for 25th February election.

2. That accreditation covered the Presidential, Senate and House of Representatives elections.

3. The results of the House of Representatives and Senate were successfully uploaded by THE BIVAS MACHINES TO iREV PORTAL.

4. When it was time for the Upload of The Presidential, whoever was in charge suddenly changed the password.

SO ALL THE FIELD AGENTS WERE CUT OFF FROM THE IREV PORTAL.

5. INEC later claimed they had glitches or server failure or whatever.

6. We contacted unofficially, Amazon confirmed all servers were in absolutely perfect and functional condition before, during and after the 25th February.

7. They will avail the official SERVER LOG FILES if and when subpoenaed.

8. The server log files also showed who signed in and changed the passwords at what time.

9. The server log files also showed that some states, especially in the North had election results already entered as at 6:25am Nigerian time, long before accreditation and/or the elections even started!!

Jigawa had 40,000+
Niger had 35,000+
Gombe had 40,000+
Etc, etc.

10. It was the attempt to cover up the infractions that made them Upload blurred images.

11. Also, the BIVAS machine doesn't have a focus adjustment feature. It cannot therefore even Upload a blurred image at any time, for any reason.

All the blurred images were uploaded by devices other than the BIVAS machine, an action in breach of the electoral act!!

12. The configuration of the BIVAS machine was to use GLO SIM cards, which allocated specific gateways or server routes.

This means that EACH BIVAS MACHINE DATA CAN ONLY TRAVEL FROM THE LOCATION OF CAPTURE OR USE.
IT CANNOT GO AND UPLOAD DATA FROM SOMEWHERE ELSE.

Meaning that: *A BIVAS MACHINE USED AT THE INTERNATIONAL CONFERENCE CENTRE, ICC MUST UPLOAD ITS RESULTS FROM ICC, NOT MAITAMA OR ASOKORO*

SO WHEN THEY PACK RESULTS FROM DIFFERENT POLLING UNITS, AND TAKE THEM TO MAITAMA AND UPLOAD THEM AS A BATCH FROM ONE DEVICE, THAT RESULT IS FAKE.

12. Many of the results were uploaded from devices other than the BIVAS MACHINE.

This showed in the resolution of some of the forms.

*ALL THE PICTURES AND IMAGES OF ALL THE BIVAS MACHINES SHOULD ALL LOOK ALIKE*

THE BIVAS CANNOT TAKE DIFFERNTIAL PHOTOS.

13. BIVAS machines used in Ekiti, Osun and Kenya are cases in point. You can compare their images and resolutions with those of 25th February presidential election!!

14. Google hosted CVR. Amazon AWS HOSTED iREV.

How and why did iREV results show up on CVR portal?

15. Bearing in mind that AWS had no technical issues and/or glitches at the backend! INEC had no reasons whatsoever to Upload House and Senate results on AWS iREV and part of Presidential on iREV and suddenly switch to CVR to Upload the remaining presidential results.

16. At at today, 1340hrs on 15 April 2023 INEC is has not uploaded results from 9,403 PUs and they have nothing to do with runoff or rerun.

17. As at today, INEC is Still uploading results of the presidential election that took place on 25th February 2023, but all these uploads are basically a cleanup exercise to suite the narrative of their announcements.

18. The results uploaded within 72hours of the 25th February 2023 presidential election were very credible and showed clearly that APC did not win.

20. The result from the backend and server log files of AWS will show the pattern of interference by INEC staff.

21. The guy in charge of INEC DATA was sacked from GTB and UBA over criminal activities. He is one of the henchmen of this treason committed against Nigeria.

When the majority of the public couldn't access funds from ATMs because of the new naira policy, certain men made special arrangements for their fellow crooks to use special access and get all the needed funds, especially the new naira notes. That informed the courtesy visits that we saw after the charade declaration.

Human rights activist, Mr Kayode Ajulo, has written a letter to the President, Major General Muhammadu Buhari (retd.), and the National Chairman of the All Progressives Congress, Senator Abdullahi Adamu, on the danger of picking a candidate with dual citizenship or past criminal record.

Ajulo said there was a plot by the opposition to ensure that the APC was disqualified on the basis of this just as was done in the Bayelsa governorship race in February 2020.

This was just as the APC on Sunday indefinitely postponed its screening for its 25 presidential aspirants.

According to Ajulo, at least 22 aspirants out of the 25 that are expected to be screened either have dual citizenship or criminal records and this would be used in disqualifying the APC.

The PUNCH independently confirmed that Senate President Ahmad Lawan has dual citizenship as stated on his form CF001 submitted to the Independent National Electoral Commission in 2018. Governor Kayode Fayemi of Ekiti State is also believed to possess dual citizenship.

In a letter titled, ‘Secret Memo to the President and Leadership of the APC on the Eligibility of Persons to Contest for the Office of President of the Federal Republic of Nigeria’ dated May 22, 2022, Ajulo said it was important for the APC to get its act together so that the party would not lose its deserved victory.

Ajulo asked the APC to take into consideration the 1999 Constitution specifically Chapter VI, Part 1, Section 131 and which outlines the basic requirements to be met by a candidate to be eligible for an election into the office of the President in Nigeria.

He said these requirements include: the aspirant must be a citizen of Nigeria by birth; the aspirant must have attained the age of 40; the aspirant must be a member of a political party and is sponsored by that political party; and must be educated up to at least school certificate level or its equivalent.

Ajulo added, “Section 137 of the same constitution as amended, goes further to illuminate this matter by providing for several situations which doth render a candidate ineligible to be elected as the President, stating that a candidate will be ineligible: If he/she has voluntarily acquired the citizenship of a country other than Nigeria or has declared allegiance to such other country.”

He noted that the constitution also disqualifies anyone that has been indicted for embezzlement or fraud by a judicial committee of inquiry or an administrative panel of inquiry or a tribunal and which the indictment has been accepted by the federal or state government; or if he/she has presented a forged certificate to INEC.

The lawyer added that the constitution disqualifies anyone who has been found guilty of an offence involving narcotic drugs or any other psychotropic substance by any court or tribunal in Nigeria or any other country.

Ajulo added that the opposition was already monitoring the situation with a view to taking advantage of the fact that only three out of the 25 presidential aspirants were eligible to contest.

When contacted, Yinka Oyebode, the Chief Press Secretary to the Ekiti State governor, said on Sunday that the allegation of dual citizenship against his principal was a non-issue.

Oyebode said, “It is a non-issue. Dr Fayemi is eminently qualified to contest for any position in Nigeria. He is a bonafide citizen of Nigeria. He has every right. He has been contesting in Nigeria since 2007. Whatever anybody is saying to the contrary is a non-issue.”

Also, the Spokesman for Lawan’s campaign organisation, Iyke Ekeoma, said the constitution permits dual citizenship hence, no one can be disqualified on the basis of dual citizenship.

He said, “I am not aware of the information that the Senate President has dual citizenship. However, Lawan wouldn’t have been running for the presidency if it were true that the constitution does not allow for a person with dual citizenship to be

The founder, Tinubu Support Group, James Faleke, did not respond to calls on Sunday.

Meanwhile, the screening exercise for the 25 presidential aspirants of the APC earlier scheduled to hold on Monday has been postponed indefinitely.

This is the second time that the National Working Committee of the party will be shifting the date of the presidential screening after it failed to hold last weekend.

The development was confirmed in a statement by APC National Publicity Secretary, Felix Morka, on Sunday night.

The statement said, “A new date for the exercise will be announced shortly. Any inconvenience caused is deeply regretted.”

The list of the aspirants who have so far submitted their nomination forms are the National Leader of the party, Senator Bola Tinubu; Vice President Yemi Osibanjo; former Minister of Transportation, Rotimi Amaechi; former Minister of Niger Delta Development, Sen. Godswill Akpabio; Governor Kayode Fayemi, Governor Ben Ayade, Governor Dave Umahi, oil magnate, Tein Jack-Rich; Governor Yahaya Bello and 16 others.

Olisa Agbakoba, a senior advocate of Nigeria (SAN), has said that Nigerians were held down by powers that had made it difficult for them to extricate themselves.
He described Nigerians as being in a cage and unable to free themselves.

Agbakoba, who spoke with BusinessDay in an exclusive interview, likened the condition of Nigerians to a situation where a lion is holding its prey.

“If a lion is holding you down, you are not likely to go anywhere. So, we are held down by a weight that we can’t shake off, and that is the problem,” he said.

According to him, “There are people who have captured the state; they are benefiting and don’t care what people suffer. So, we are unable to resolve it. It is as if it is a state capture.”

He also blamed the problem of Nigeria on the selfishness of politicians, saying, “They like failure of the system because it benefits them and when they benefit from the system they don’t care the way it impacts the economy.”

You have been commenting on the election since they were held by way of press statements and television appearances. Although cases are pending at the tribunal which means the elections are not yet over; may we know your assessment of the 2023 general election?

First, given what the chairman of the Independent National Electoral Commission, Mahmood Yakubu promised Nigerians, that the elections were going to be pains-taking organised elections, but it wasn’t so; we had expectations.

Even INEC itself has acknowledged its failure; all the major observers – both domestic and international- have said it fell below the standard of well organised elections. It was very poorly organised. One problem was logistic, late start, failure of the biometric and violence.

We all thought that the biometric was going to be a full-proof validation of what a candidate scores but it turns out that all the INEC chairman says is that the biometric is simply a process of accreditation, that we still rely on the old manual process and I then wonder.

That led me to review the state of the biometrics in the law and I found out that it was quite true. That what happened was that the National Assembly led us on a wild goose chase.

So, we thought that the biometrics was what it never turned out to be which has been invalidated by the decision of the court of Appeal in the Osun case.

What the court said in the Osun case is that the so-called proof of over-voting established by the biometrics is not sufficient; that it is necessary to connect the biometrics to the old primary count.

So, the biometrics has not been as effective as we all thought it was. INEC has actually failed because everybody believed the biometric thing is the standard solution. So, that has led to all manner of confusion where parties are aggrieved – Peter obi is aggrieved. Atiku is aggrieved; and they have all gone to court and as a result of the extremely slow judicial process many are worried (even though I am not worried) that what if Mr. Tinubu- because we have to recognise that he is the president-elect, is sworn in on 29th May, but there is still a petition.

So, that has given rise to a lot of suggestions – can it (the inauguration) be delayed? The issues of interim government which I do not accept because it is not in the constitution; Lai Mohammed’s comments and Obi’s response and all that about treason; a lot of confusion out there which has made the atmosphere toxic.

But I have a simple solution which is to say why is it that the legal teams of all the petitioners are not active? I don’t understand it; why is it that the Tribunal is not active? I don’t understand it, because the elections took place almost two months ago.

Kenya takes only 14-day cycle to finish their petition, but we take 240 days; why? If the Kenyans can do it in 14 days what’s wrong with us? We need to be pro-active. You see the problem with the Nigerian judiciary is that they are still steeped in the theory of 100 years ago, when the judge sits and does nothing unless counsels make an application. Now the judges are pro-active.

So, in Kenya; the Kenyan Judiciary Motto is ‘Sustaining Judiciary Transformation.’ They are proactive. If it were in Kenya, the judges would have said No, No, No, we can see the potential of Mr. Tinubu becoming president when the petition is still pending; let us hear it.

There are not too many issues to hear; complex as they are the question whether you need to win Abuja is one, the question whether you can be vice presidential candidate and senatorial candidate is another one, the question whether Mr. Tinubu’s qualifications are dated; these can be decided in one day.

All that the court does in case management theory which is to allot time, say – Mr. Obi, your lawyers one hour; Tinubu, your lawyers-one hour; this might be 9.O’cloclk in the morning; by 6pm they deliver a decision. Why can’t it be done?

What then do you think is the problem with our system?

The problem with our system is the selfishness of politicians. They like failure of the system because it benefits them and when they benefit from the system they don’t care the way it impacts the economy.

Look at the absolute nonsensical monetary policy of Godwin Emefiele. I can’t understand what that was all about. He didn’t care that millions of Nigerians are suffering. The economy was dove-tailing. He made a policy that he could not deliver.

He changed the currency. OK, may be, there are good reason; so, where is the money?

So, what is the problem with this country where people can’t speak. So, it is as if it is a state capture. There are people who have captured the state; they are benefitting and don’t care what people suffer. So, we are unable to resolve it.

The momentum in the entire Nigerians to say, you know what, let’s shoot the system down is not there. Like when people talk about revolution, like Sowore – it is not there. If a lion is holding you down, you are not likely to go anywhere So, we are held down by weight that we can’t shake off, and that is the problem.

Some people are saying that the election that brought in the late Umaru Musa Yar’Adua was also heavily flawed and that no matter how flawed the past election was, it doesn’t matter anything. What is your take here?

First of all, just like I have said, people who are in the process and those that are enjoying the flawed process have no interest to change it.

So, along came Yar’Adua (once in a long while you have a good man). So, Yar’Adua came and said this thing wasn’t proper; I want to now bring a credible process which I would put in place to remove the flaws.
I was on Uwais Panel, unfortunately he (Yar’Adua) died.
Since he died, not one of what we recommended has been passed. The Electoral Offences Commission has not passed; the question of electronic voting has not passed; the question that before inauguration takes place, all petitions should finish has not passed. Nothing has happened and since Yar’Adua died there has been no other person who has had the honesty and courage to admit “my election was flawed.’ That is the problem.

If you continue having bad people why would they be interested in changing the system? No bad man is interested in changing a bad system; so, that’s where we are. So, unless you can find someone who understands that Nigeria cannot continue in this rot and that it is sinking and that unless he as President does something, we will continue to go down.

With what is happening, some Nigerians are saying they may never ever again participate in the election voting process in the country. They have lost interest and faith in the system. What danger do you foresee for the country as a result of the flawed election?

What I think that might begin to happen is loss of faith in the Nigeria system. People are going to begin to say, this Nigeria experiment do we really need it, because it is the clash of ethno-religious interest that is at the heart of the problem.

Political restructuring was a tool that could create the space so that we all can have our spaces in order to express ourselves; but even that one is being constrained because those bad people don’t own the space, but they are enjoying the space.

So, I don’t know what is going to happen but potentially things can spiral down in a way that things can get out of control. It will not be like you see it coming like a rain; you can predict a heavy rain coming; because I am sure that 90 percent of Nigerians are seriously frustrated and they are now held down in a cage.

If you construct a cage in which you can put animals, they can’t come out.
It’s like what happened in the era of slave trade where people came and hunted human beings and put them in ships; they were helpless, that is how helpless Nigerians are, but the day they find a way to express themselves; to express their liberty, things will change. There is no doubt about it.

Many people have wondered why it appears that the fight between the APC and LP is threatening to tear apat the ethnic relations between the Yoruba and Igbo races. Other people are contesting the election and Atiku Abubakar of the PDP is also contesting the result at the Tribunal; why is the focus on Peter Obi?

I don’t understand it either. I really don’t know. It surprises me, because Peter Obi is only Number 3 that, actually, it ought to be the Number 2 man that should be in the picture. That shows you that there are lots of unspoken issues under the table that we are not seeing that is at play.

Clearly, the bad forces, as I call the, would want to use every possible opportunity to keep the system in check and Peter Obi’s heroic performance is a threat that this man is a guy to watch, because if he has done this; even if he loses the petition, there is a force, he has opened that cage that has been locked for a long time.

You have a lot of Nigerians held down in that cage and the forces are now saying, No, it is dangerous to leave this cage open. And that cage contains frustrated Nigerians, #ENDSARS type of people; unemployed youths- these types don’t care about tribe, religion or sentiments- they just understand that they are Nigerians; and they are not governed by these primordial sentiments, that’s the segments that Peter Obi represents. So, to keep him caged is very important.

Do you believe that president Muhammadu Buhari is the hero of the 2023 election?

No. How can he be the hero of the election? The hero of the election is Peter Obi. I don’t see it personally. The elections were flawed; they were not well organised. I can only say that in fairness to him, he has maintained a studied distance; that’s the way I see it. You can’t say he’s an APC man; and naturally he supports his own party; but I will not call him a hero.

From your own perspective, what are the possible challenges that the Tinubu administration will face?

One of the big challenges will be legitimacy. Theres’ a very strong feeling that the elections were marred and in fairness, Tinubu cannot be blamed. He did not organise the election.

You can’t blame him; he didn’t go about telling the INEC give me the vote. The person to blame is the electoral management body, the INEC; Tinubu has no blame.

Everybody that goes into a contest wants to win. The problem is that the election rather than unite has fractured Nigeria. That fracture has been coming because of the ethnic wars, religions killings; so the fracture has been opened and the election and the results have opened it further.

So, one of the key things is that assuming that Tinubu gets elected with this petition, the first thing he needs to do is to appeal to the conscience of Nigerians for legitimacy even though he won; because people are going to say ‘that your victory.’ He will need to really sell himself and get accepted.

For him to do that he will need to repair fractured state of Nigerians; he needs to heal the wounds.

The only way he can do it is to call for a government of national unity and address the question of political restructure so that the very things that keep us separate can be addressed; otherwise the challenges he will confront will be huge.

How would you react to the kind of things we hear; for instance, the Federal Government officials going abroad to say the kind of things they say about Nigeria and Nigerians?

Personally, I don’t understand why Lai Mohammed should go to America and be talking about treason merely because Peter Obi is expressing his constitutional rights to say ‘I felt cheated’. I don’t understand.

In any case, is Lai Mohammed not part of the outgoing government? The only battle now to be resolved is that of election petition; so everybody should be quiet.

When they continue talking they continue to heat up the already inflamed passion.
There is a call for interim government, because some people are saying, how can Tinubu become president and we are still having petitions.

So, why is it that everybody that is shouting, including lawyers on all the sides cannot see, these are very senior lawyers, they understand case management.

Case management means that the fundamental objective of resolving a dispute is to finish a dispute before inauguration.

So why are they not taking steps, to say to the court, we need to have this resolve before inauguration and we feel that these questions if reviewed might resolve it. But they filed the petition and they have gone home.

Then also on the part of the Tribunal, they also have a duty of their own power just like the National Assembly will say; ‘there is a motion of urgent national importance’.

They can also say this is an issue of urgent national importance and as a result “we hereby issue the following directives Peter Obi lawyers, you come on this day; Tinubu’s lawyers come this day; Atiku’s lawyers, come on this other day. We are taking on these things and when we take on these things, we decide it and everybody goes home; one way or the other.

What lesson, as a Nigerian do you learn from the botched CBN Naira redesign policy?

The lesson I learned is that Nigeria is a crazy country; that anything goes because I don’t understand the purpose of the redesign policy. It doesn’t make sense to me as a development lawyer. What were they trying to achieve? I can’t see it.

One lesson I have learnt is that this is just a Banana Republic where any senior officer in power abuses it.

What has happened to the CBN governor for taking us through this difficulty? There’s no consequence. Nobody is asking him anything. He is above the law. He passes a regulation that makes no sense; he doesn’t explain it.

The policy failed, and he doesn’t have the courtesy to say ‘Oh I intended to achieve this; but I am sorry! But because he is above the law, he doesn’t care that we are suffering.

But some people believe it’s Buhari handiwork…?

Well, Buhari is not the CBN governor. If he did it then unfortunately, then it means that Emefiele allowed himself to be used. I cannot see that it was Buhari, the person I saw do it was Emefiele. So, if he allowed Buhari to use him that’s actually his funeral.

What is your advice to Nigerians looking at the way things are in the country?

My advice to Nigerians is that they have to stand up for their rights. We have taken enough of this.

If we don’t make noise there will be no change. If people in power feel that they can do anything and get away with it, then it is what professor Nwabueze has called impunity.

What avenue can Nigerians vent their frustration since the powers that be still outlaw actions that gear towards civil disobedience, or even peaceful protest?

Nigerians have no power, they have been caged. They are all looking for their daily bread; they are so terrified by the state that has become so big.

When people are not able to organise they suffer in silence and agony. We have been torn apart by ethnic, religious and linguistic issues, and there are no national leaders that we can aspire to, say this person if you follow him he is likely to take us out. There are no leaders.

Everybody is selfish; everybody is fighting on his little corner for the little money they can make. So, people can’t say this is a moral leader like Mandela who if we follow him, even if it is 10, 15 years, we shall get to the promised land like Martin Lurther King.

We absolutely have nobody like that in Nigeria, we actually have political charlatans; that’s why we are where we are.
