The police is only doing it's job.
If your name is mentioned by a suspect,no matter how frivolous it may seem,its the duty of the police to invite you for you to clear your name.

Section 388 of the Penal code talk about adultery by a woman, while section 387 talk about adultery by a man.

But, you should know that all law enforcements are subject to the discretion of the arresting agency. If two friends are driving over the speed limit and only was arrested and prosecuted, saying that the other person should have been arrested is not a good defense and the Judge will throw that argument out, unless you want to proof that, you were unlawfully targeted, which is a very tall order, especially when it was evident that you committed the offense.
