If your entire fee for running the program has been paid for, sure but u need to prove that u can support yourself and ur accompanied dependant.

When is the appropriate time for her to file. ? She just moved there about a year ago and she will be resuming classes for her RN program in june

So when is the appropriate time for her to file in the petition because she just moved there about a year ago. She will be starting her RN program in june/July whicj invariably means, she won't have enough funds to help the petition

Thanks for that response, my kids miss their mum and would like to be where she is and even if she files for us am of the fear that I might ruin their chances of the kids reuniting with their mum because of my previous and many refusals. So my question is, can she file for the kids alone and leave me out for now and since the DNA would prove if their hers or not? I am not bothered about going to the states for now but my kids are the ones that am bothered about.

She never claimed to be married, she entered the U.S as single, we were not legally married when she was selected.

Dear V.O since the mother of my kids can't file an i-130 petition to enable us reunite. Can I apply for a fiancé visa? I have applied for a non immigrant visa severally and i have been consistently denied am even of the fear that I might have been banned for misrepresentation and may not have been duly informed. Other embassies states clearly on refusal note issued to applicant if they are banned from future application be it immigrant or non immigrant. How does an applicant know if they banned probably for misrepresentation.
