Good prior travel can help, bad prior travel can hurt, but no travel history at all doesn't make a difference, especially for student visas. If the applicants can explain why they want to study at a certain school and how they'll pay, that's what the Consular officer will be interested in.

The good news is that if they apply and are refused, that will not have a negative effect on any future immigrant visa applications. (Unless of course they're refused because they have a criminal history, or for fraud, or for similar reasons that I'm sure don't apply in this case.)

I vote for just telling the truth at the student visa interview, if the officer asks about the I-130. Yes, officers are looking for immigrant intent, but we're trying to weed out the "students" who are just looking for a way to circumvent U.S. immigration law, not the ones who have legal paths to citizenship. Again, I'm not guaranteeing that these applicants will be successful -- there are many factors involved in each visa decision. But it sounds to me like it's worth a try.

It's not true that it's impossible to get a non-immigrant visa if you have a pending I-130. It does make it a bit more difficult. The extreme example would be someone who has a pending F4 (sibling petition -- the longest wait time) and, say, a K1 (fiance) petition that didn't get approved because the relationship didn't appear to be bona fide, plus a couple NIV refusals. That person is pretty clearly trying really hard to get to the US as soon as possible. The extreme example the other way would be someone with a lot of good prior travel to the US and a recently filed I-130 pending. If that person showed up for a non-immigrant visa, and his/her reasons for travel made sense, we'd likely go ahead and issue.

For students... my sense is that if they're qualified for what they want to study, and can talk about it credibly, and can show that they can afford it, I'd go ahead and issue even knowing that they intended to immigrate as F2As. We're interested in people who are immigrating legally, and entering the U.S. as a student and adjusting status is completely legal. I can't guarantee you that they'll qualify for the student visas, but the fact that their parent is there shouldn't work against them, all else being equal.

Per the bolded part above, these kids have never been in the US (never visited), could that be a problem during their interview?

Secondly, what if they are refused this student visa, will that be an issue if they appear for their F2A interview at the embassy? will that previous rejection ding them in any future IV interview such as the F2A? We are just trying not to lose at both ends...

Lastly if they go for this Student Visa interview and if they are asked about their immigration intent? Are they supposed to say "Well i have an I-130 pending but i want to study in the US and if the I-130 gets approved, i will adjust status" or Are they supposed to answer the question in the line of a typical F1 response "Well, i want to get back to Nigeria after my education and help develop Nigeria, blah blah".?

Of course the former response (the first response) is the honest truth and the right response but since CO's are sometimes impatient and are looking for immigration intent for F1, won't this response be a problem especially if the CO is not as patient and a listener like you? ??

Quick question. My Dad is a permanent resident in the US. He filed the I-130 for my siblings who are under 21, thus they are in the F2A category. We know its gonna prolly take 2.5 yrs for their visa to be available and this kids are at the age when they should be in college. As a result, my Dad is contemplating on filing for F1 visa for them to start their college education in the US atleast until the I-130 is approved and they can hopefully adjust status in the US.

The big problem is someone told me if you have a pending I-130 application, it is downright impossible to get a non-immigrant visa such as the F1? Is this true? These kids have their WAEC and the other qualifications needed. The problem is the "immigration intent" requirement of the F1 visa may preclude them, is that right? Lastly, from your experience, does the embassy come across cases like these? and how do you guys treat cases like these? do you guys issue non-immigrant visas to people with a pending I-130? Is it a slam-dunk rejection? etc

We are really concerned about this cos we dont want to end up spending tons of $ only for them to be rejected at the consulate due to the F1 "immigration intent" rule. Your candid reply will be really appreciated!

They came in around 2am. . I wasn't even sleeping then, i was on the phone doing midnight calls when i heard my 3 dogs barking furiously as if the world was gonna end. Immediatelyy, i knew that armed robbers were inside my compund. I told the person i was talking to that "e be like say dem boys don come o". As soon  as i said that i heard staccato of deafening gunshots. . It felt like the shooter was next to me.

I was aalready "mara-ing and panting" and questioning why i came to Naija o. They were about 10, they came with Ak's and a lotta other guns. Jesoul, they packed HEAT to the TILT!!!. . .no be Sara-Palin-moose-killing-type-of-heat-oooo. . . No be yeye NRA kind of heat. This guns looked like Soviet-made Cuban AK's. The types you find in Chechenya and Fallujah (pre-surge).

So they  were shooting inside my compound and they were screaming that we open. We didnt, as we all hid in our courtyard(very secured with iron doors), so they sliced thru our burglary (Kick-@ss, huh) to enter the house. We were still hiding. They were screaming and shoooting in my sitting room (the next day we found Bullet holes in the walls, sliding windows, kitchen everywhere., a lotta pellets/bullet inside ma house)

They were still unable to get into the court yard. . .one way or the other, they saw a tiny hidden window that leads to the courtyard and they saw us. Since they knew they couldnt break the metal doors and since they knew they couldnt pass thru that small window, they started firing at us from the courtyardwindow straight into the courtyard !!the place we were hiding and lyding down were riddled with bullets BUT nothing touched us! Thanks to God. So, we told them we would open it.

When they came in, they put a gun to my head (that stuff was as cold as a dog's nose) and were screaming that i was the one who orchestrated the resistance to open the door abi and that i was the one shouting Ole!!! In a split second and in a moment i would never forget EVER, my old woman (mom) pushed me aside and stood in front of the gun and faced the thieves and she was on her knees begging them not to shoot

We opened the door and they led us out to our respective rooms. They took Rikky Ricardo in too and stripped me of my hard earned monies and dispossessed my parents of their stuffs . When they were done, they left without hurting nobody. Thank God
