If you are his lawyer and you bring his confessional video as admissable due to the police making it public before the trial and that it infringed on his rights to a fair trial and his own constitutional rights, you must be able to demonstrate in court how this is the case and which rights were abused by the police and how the video of his confession has jeopardised his case.

6. The concealment and confidentiality of investigation is for the suspect(s) not have a tip off and for them to be easily arrested.

The police might choose to keep the information gathered from an ongoing investigation private so as not to tip off a main suspect and to build a proper case in court.

In the same US you are referencing, the Police department hold regular press conferences to notify the public on an ongoing investigation that is of particular public concern.

There's nothing confidential about a police report because it's final report will serve as the main evidence in a public court to try a suspect.

The Police in Nigeria usually release such confessional statements before arraigning the suspect to court so as to let the public know that they have apprehended the criminal behind a crime and that it is now down to the justice system to convict him.

The police are forced to do this so as to let the public aware that they have apprehended a criminal for a crime and to ensure the public see that there is no coverup by the police.

Once the matter gets to court, it's no longer in the police hand outside of providing evidence in court to prosecute the offender.

My problem with Nigeria is that they either argue to have something to say even when they know nothing about or because they want to circumvent the truth for their personal gains! Because no hospital will accept a patient of a capital offense like kidnapping and give the kidnapper treatment without police or any security agent presence or knowledge and once the start they will go ahead immediately to inform the security agency especially the police so there is high tendency that the person asking those questions is a security man and a police!

Thirdly, in the video the interrogator or interviewer clearly mentioned that it was the police that carried out the rescue operation it then means the person interviewing the suspect is a police officer and if he is not a police officer then the IPO of the case, his head of department and DPO needs to be fired for gross unprofessionalism, and incompetence because the IPO and other armed men must be together with the suspect especially for a crime of this magnitude and if he might be at the crime scene for further investigation or else where for another assignment the DPO or head of the Crime branch should have sent some armed men, get it! not man but armed men to guard the suspect and the management of the hospital and other patients because there is high tendency that if the suspect's syndicate knows he is alone in the hospital they will strike to either kill him or safe him so as he should not indict them and in doing so many lives will be lost or multiple casualties will be recorded.

Finally, if the person recording the suspect is not a security agent then himself needs to be arrested for making confidential investigation public! The simple rule according to ACJA is that a civilian or quasi security agency only have right to arrest any offender of a crime in their presence and hand them over to the police or other security agency and not to interogate them! So you see any angle you take it the security are indicted directly or indirectly! Can you see why I said I am too intelligent to speak like an arguer in a beer parlor?

There is no constitution that forbids that but I think the Administrative of Criminal Justice Act and many security Acts Regulations apparently frown on this actions because investigation is absolutely confidential... And what that security agent did is tantamount to very serious punitive measures and to some extent even he may be sacked and prosecuted... For commiting an offense of accessory after the fact.
