  RE: UNILAG SUSPENDS UNION LEADERS

 OUR attention has been drawn to newspaper reports on the above subject. We wish to point out that no student was punished on the ground of solely engaging in the said protest.

The students were duly investigated for specific acts of social misconduct which they carried out. They were individually investigated for instances of wrongdoing in breach of the Social Misconduct and Penalties Regulations of the University of Lagos. Specific acts of misconduct during the protest for which they were punished include the following:

1              Locking the University gates

2              Locking staff inside the Student Affairs Office

3              Harassing Lecturers and disrupting lectures and/or examination

4              Assaulting and damaging the vehicle of a visitor and a student

5              Invading the premises of UNILAG Ventures and carting away products of the company.

6              Soliciting for funds externally under false pretence in the name of the University.

 

The students were also found culpable of other activities capable of damaging the reputation of the university and impinging on the integrity of the University.

 

We wish to correct the view that the student leadership were punished across board for the protest. Contrary to that report, only those who were found culpable of specific acts of misconduct were penalised.

 

Furthermore the University Senate considered the mitigating plea for a review of the penalties made by the Disciplinary Panel to Senate and commuted the penalties of those for expulsion to rustication.

 

No student will be unjustly punished at the University of Lagos where we are raising leaders IN DEED AND IN TRUTH.

 

We trust that our position will be noted and reflected.

Something is bothering my mind about the huge amount of money the court ask in granting bail to a defendant. We have seen them collecting 400million from metuh for eating out yam, 400million from dokpesi, 200million from fani kayode and from so many people who ate our yam.
my question is, where is the money paid as bail going to?
is it going to the judiciary account?
Or the executive
and how is this money being spent?

is it being added to our budget?.

The organised labour in Ekiti State has denied being part of the sharing of the federal monthly allocation coming to the state, contrary to the claims of Governor Ayodele Fayose.

The organised labour also expressed shock over the internally generated revenue figures reeled out by the governor, which overshot and were entirely contrary to that ever declared by the Accountant General at any of their meetings.

In a press release issued after an emergency meeting of the the Nigeria Labour Congress, Trade Union Congress and Joint Negotiating Council in Ado Ekiti, the labour denied reaching an agreement with government to pay only net salary.

According to labour, the Accountant General’s figures ranged between only N150m and N200m, except that of N268m for April, the highest so far declared by him.

These, they said, were against N267m for September 2015; N252m for October 2015; N195m for November 2015; N181m for December 2015, as well as N389m, N381m, and N302m, respectively declared by the governor for January, February and March.

Accusing the governor of blackmailing the unions to gain public sympathy, the labour leaders said the meeting is only “a briefing” and not “a cash allocation meeting.”

They added that suggestions made by them at the meetings had never been accepted by the governor.

“So, the idea of labour leaders sharing monthly cash allocation and the governor approving does not arise. There has never been any advice or suggestion given to government by the organised labour at this forum that has ever been taken,” the unions said.

The organised labour on Thursday began an indefinite strike to press home the demand for the outstanding five months salaries of workers among other issues.

But reacting, the governor on Friday said the state government will pay salaries only to workers not on strike from the little monthly allocation that came from Abuja.

However, the labour urged workers to discountenance the threat by the Head of Service, Dr Olugbenga Faseluka, that senior workers should resume work on Tuesday or face the dire consequences of their actions.

“The ongoing strike is not an ego trip or politically motivated, but about the rights of workers and pensioners who are dying daily out of hunger and frustration.

“It should be noted that Labour has neither suspended nor called off the ongoing industrial action in the state, hence we are using this medium to implore the entire workers of all categories in all sectors to stay at home and observe the strike action until the leadership of organised Labour gives further directives.”

The Federal Government has invited the leadership of organised labour to a meeting in the Office of the Secretary to the Government of the Federation on Monday to discuss the increase of fuel pump price from N86 and N86.50k to N145.

Representatives of organised labour and the civil society had, after a meeting in Abuja on Saturday, given the Federal Government till midnight on Tuesday to reverse the increase or face an indefinite national strike.

The group gave the strike notice in a joint communiqué issued by the Nigeria Labour Congress and the Trade Union Congress after the meeting.

The General Secretary of the Nigeria Labour Congress, Dr. Peter Ozo-Eson, told one of our correspondents on the telephone on Sunday that organised labour had received invitations via text messages from the Ministry of Labour on Sunday to attend the meeting with the government at the office of the SGF.

Ozo-Eson said while organised labour would honour the invitation to attend the meeting, the only thing that could stop the planned action was a reversal of the fuel price increase and the 46 per cent increase in electricity tariff.

He said if the Federal Government failed to reverse the two increases, the government should be prepared to meet Nigerians on the streets.

Ozo-Eson added that the first meeting between organised labour and the Federal Government over the dispute would hold at 3pm on Monday.

He said, “I have received a text message inviting us to a meeting tomorrow (Monday) at the office of the Secretary to the Government of the Federation, and we will attend.

‘‘We will attend those meetings but the notice given is not conditional to our action.  It is conditional on the reversal of the hike in the price of petroleum and the hike in electricity tariff.

“But we are saying that is not what is crucial; what is crucial is that we will mobilise unless there is reversal. If there is no reversal, we will meet on the streets.”

Ozo-Eson dismissed the reports attributed to the Minister of Information and Culture, Alhaji Lai Mohammed, that the increase was necessitated by the scarcity of foreign exchange.

He said it was inconceivable for the government to make an arrangement that would allow the black market exchange rate determine the price of fuel in the country.

He argued that there was nothing new in what Mohammed said as it was part of the presentation by the Minister of State for Petroleum, Dr. Ibe Kachikwu, which was rejected by organised labour.

He stated, “The nation does not submit to the pronouncement that the fate of Nigerians will now be determined by black market exchange rate because that is the bottom line of what they are doing.

“There is nothing new in what he is saying; we reject it and the position we are taking is based on part of that information. It changes nothing. It is unacceptable.”

A source in the Ministry of Labour and Employment, who confided in one of our correspondents, said the government was “reaching out to labour.”

The source believed there would be no strike as the Federal Government would make every efforts to ensure that there was dialogue.

“The Federal Government does not want strike, we will discuss. Government is making every effort to ensure that there is no strike,” the source stated.

The Special Adviser to the Minister of Labour and Employment on Media, Mr. Nwachukwu Ngige, said he could not reach the minister for his comment on the issue on Sunday.

But the Conference of Nigeria Political Parties on Sunday warned Nigerians not be deceived again ahead of the planned industrial action by organised labour over the increase in the pump price of petrol.

CNPP also urged Nigerians not to trust the labour unions, alleging that they had been compromised.

It said the planned strike, scheduled for Wednesday, wouldn’t last beyond Friday.

If further alleged that the labour unions were using the strike as a ploy to scuttle genuine actions against the increment in pump price as they did in 2012.

The umbrella body of political parties in Nigeria said these in a statement jointly signed on Sunday by its National Chairman, Alhaji Balarabe Musa, and the Secretary-General, Chief Willy Ezugwu.

The CNPP said, “What the labour unions are doing now by calling for a strike was what they did in 2012 during the Occupy Nigeriaprotests in response to similar increase in the pump price of petrol under former President Goodluck Jonathan.

“The labour unions later scuttled the action by purportedly entering into an agreement with the then government on behalf of Nigerians and ended up fixing the pump price of petrol at N97.00 per litre.

“We have it on good authority that the labour leaders have been compromised.

‘‘Recall that the labour leaders were at a meeting, where the decision to inflict more and more pains on the already impoverished Nigerian people by increasing the pump price was taken and never protested against it. Why the sudden U-turn by the same labour leaders?”

The statement added that the ever increasing hardship enthroned on Nigerians by the current government could not be tolerated.

“The Federal Government and its labour collaborators must be told that the CNPP, the masses and the civil society shall occupy Nigeria until the reversal of the pump price of petrol. Enough of more and more suffering under the guise of fuel subsidy removal,” the statement added.

JOINT COMMUNIQUE ISSUED AT THE END OF THE EMERGENCY MEETINGS OF THE NATIONAL EXECUTIVE COUNCILS OF THE NIGERIA LABOUR CONGRESS, THE TRADE UNION CONGRESS AND CIVIL SOCIETY ORGANIZATIONS HELD ON FRIDAY MAY 13, 2016

The emergency meeting debated extensively the implications of government's unilateral increase in prices of petroleum products, noting government's disinclination for consultation on issues of public interest and its obsession with protecting product marketers at the expense of the Nigerian public. The meeting expressed concern about government's neo-liberal policies which it considered a betrayal of its electioneering promises and observed as follows:

During the electioneering campaign last year, the Presidential Candidate of the All Progressives Congress ( APC ), Muhammadu Buhari, had promised that, if elected president, he would not remove fuel subsidy if there was any at all;

After his election, President Muhammadu Buhari had maintained that there was no subsidy in the petroleum product price regime and that even if there was, he did not see how its removal would be beneficial to the ordinary Nigerian, noting that the slightest product price adjustment often leads to inflationary spiral and unimaginable suffering for the people;

On January 18, 2016, the government further allayed the fears of the Nigerian people by reducing the pump price of PMS to N86:50, explaining that the reduction was in furtherance of the implementation of the revised component of the Petroleum Products Pricing for PMS and kerosene;

The Minister of State for Petroleum Resources, Dr Ibe Kachikwu had been speaking from both sides of his mouth. Whereas last year, he had strongly canvassed for the removal of "subsidy" in defiance of President Buhari, about a month ago, he claimed the subsidy had been removed through his ingenuity and that Nigeria was saving $1billion from this process;

Organized Labour wondered what has informed government's sudden and dangerous policy summersault and its desperate attempt to convince the public that Labour was part of the decision that led to this price increase;

In view of the fact that the board of the Petroleum Products Pricing Regulatory Agency (PPPRA), which is statutorily vested with powers to recommend prices, has not been reconstituted, the price variation announced by any officer of the agency or outside the agency is not only ultra vires and illegal, it is a criminal imposition on the citizenry;

The price hike from N86:50 to N145, representing 67.63% increase, is the height of insensitivity and impunity as there was no previous consultation with stake holders, especially the organized labour, or any justification for this reckless decision other than the fact that government believes it is accountable to no one;

The Minister of State for Petroleum Resources declared that marketers will have to source their dollars from the secondary market. The attendant pressure on the dollar will lead to unimaginable rise in prices of commodities and other services thus creating further hardship for the people. Due to the volatility of the black market, organized labour doubts that government would be able to maintain PMS pump price at N145 per litre were the hike acceptable or justifiable. At the time the PMS pump price was fixed at N145, the exchange rate at the black market was N320 to the Naira. Between Wednesday and today when the new pump price was announced, the Naira has further crashed against the dollar, first to N340 on Thursday, then N365 on Friday morning and N385 by close of business on Friday, all in 48 hours! At this rate, we believe it will not take long before the Naira becomes entirely useless against the dollar. It is thus morally and economically suicidal to have tied the importation of products to the secondary market exchange rate;

In view of the fact that in the past five years, there has been no increase in salaries or wages or pensions in the face of devaluations, spiralling inflation and other vagaries of the economy, this product price increase is unrealistic, unaffordable, unacceptable and is thus rejected;

Government is unable to justify this price increase other than the puerile explanation that marketers need to recover their costs, without a thought for the aggregate or larger national interest including the need for local refining and creation of jobs;

The government has remained incalcitrant in spite of a subsisting court injunction on the issue of the criminal increase in electricity tariff even in the face of ever-worsening power supply situation;

From the foregoing, it is evident that the neo-liberal forces in the government have taken over the government and we should expect more inhumane policies which will further degrade the living standard of the average Nigerian. The punitive electricity tariff and PMS product prices may just be teasers;

The implications are costly and far-reaching, with the first and most significant being that we have become dependent on massive importation of refined products to meet our domestic needs in contra-distinction to other OPEC members. Whereas most OPEC members significantly meet their domestic needs through domestic refining by an average of 80 per cent, Nigeria on the contrary, at the pace it is going, will continue to rely on about 90 percent of imported refined products in the foreseeable future;

And because we are dependent on importation, the end-user price will always be influenced or determined by external factors such as the cost of refining abroad, transportation and others denominated in the dollar. As the Naira continues to depreciate against the dollar, so will the woes of consumers in Nigeria continue to increase, a situation the Marketers in classic greed will exploit to their advantage;

Taking into account the utilitarian value of petroleum products in Nigeria, all sectors are going to be negatively affected by this mindless price increase as virtually all the stakeholders are agreed that the most significant contributor to the astronomical cost of doing business in Nigeria is the cost of energy.

NLC, TUC and other civil society allies are not unaware of the positions taken by the Unions in the oil and Gas Industry. A process of engagement will be put in place in order to ensure the success of the struggle to protect the overall interest of the Nigerian people.

In consideration of all of the above, we urge government to:

Revert to the old price regime in order to reduce the suffering of the people and to consider this singular act of mindless pump price increase as a betrayal of trust;
Revert to the pre-45 percent electricity tariff increase, make meters available to consumers and stop estimated billing;

Reconstitute the boards of PPPRA and NNPC without further delay and give them their statutory right to function alongside DPR in order to deepen the process of consultation, checks and balances in the downstream sector of the petroleum industry;

Intensify the prosecution of all those involved in subsidy scams with a view to recovery and sanctioning of the culpable;

Put in place enhanced local refining capacity within a specified period in place of endless importation as an enduring solution to the perennial problem of scarcity;

Reverse the entire deregulation and privatization process which foists on the nation, private individuals as drivers of the economy in contravention of the constitutional provision that says government shall be the driver of the economy and engage the organised labour in the process of negotiation on key policy issues;

Wean itself from the overbearing influence of the neo-liberal elements in its fold who have not only staged a coup but are determined to make this government collapse even before the end of its four-year tenure;

Uphold its electioneering promises to Nigerians instead of subjecting them to the vagaries of slavish policies such as full devaluation of the naira and total removal of subsidy as enunciated by the IMF and its agents in the system;

In the event government fails to accede to these demands on or before 12 midnight on Tuesday, May17, 2016, the Nigeria Labour Congress, the Trade Union Congress and their civil society allies resolve to commence the following actions with effect from Wednesday, May 18, 2016;
· Mobilize to the streets across the country, ordinary and helpless Nigerians to whom they owe the duty of protection;

· Shut down all Banks, Sea and Airports, Government and private offices as well as Markets.

· Commence indefinite nationwide strike action.

· Fight/resist the machinations and cruelties of the neo-liberal forces in the government as part of the process of saving the government from itself and the generality of Nigerians from slavery.

Nigerian are therefore advised to stock sufficient food items that will last for a while for the prosecution of the current struggle against neo-liberal agenda in Nigeria.
