PRESS RELEASE
CONDEMNATION OF THE INVASION OF COURT OF JUSTICE AND ASSAULT ON ONE OF ITS JUDICIAL OFFICERS, LAWYERS AND JUDICIARY STAFF BY POLITICAL HOODLUMS ON THURSDAY 25TH SEPTEMBER, 2014 IN ADO-EKITI

PREAMBLE

Gentlemen of the Press, only yesterday the Bar in Ekiti State, through your medium, informed Nigerians generally and condemned the contemptuous and deliberate desecration of the hallowed temple of justice of Ekiti State by sponsored political thugs on Monday 22nd September, 2014.

The Bar had hoped that that unfortunate incident would be the last one. The Nigerian Bar Association, Ado-Ekiti Branch, is at serious anguish to inform the good people of Ekiti State and Nigerians in general that another abomination of greater proportion has just occurred today by the invasion of the same hallowed temple of justice by hundreds of political hoodlums. As stakeholders in the Justice Sector of Ekiti State and also in the well-being of the State, the Ado-Ekiti Branch of the Nigerian Bar Association (henceforth referred to as “the Branch”) strongly and unreservedly condemns this barbaric and unbecoming acts.
The culture of political impunity contemptuously unleashed on the temple of Justice, Hon. Justice J. O. Adeyeye, Lawyers and Judiciary Staffs today is unbecoming, primitive and crude.

Consequently, if by commission or omission, a state of helplessness or anarchy is foisted on the temple of Justice of the State (by not allowing the Judiciary of the state to perform its constitutional role), then a constitutional crisis will emerge. This is because until a governor is sworn into office by a Chief Judge of a State, then the electoral victory of any would-be Chief Executive of a state is inchoate by virtue of Section 185 (2) of the 1999 Constitution of the Federal Republic of Nigeria (as amended).

Additionally, it is needless to mention the constitutional duties of our courts in the current political dispensation. Both the outgoing and incoming governors should appreciate the fact that it is the Chief Judge of Ekiti State that is empowered by the constitution to administer an oath of office to any Governor-elect. In view of this, it would be a great jeopardy if this sacred institution, that is, the court is desecrated by any of the aforementioned governors.

Furthermore, the Branch wishes to unequivocally educate the general public that, whilst a litigant reserves his constitutional right to reap the fruit of his legal victory, his opponent EQUALLY reserves his own constitutional right to constitutionally challenge that victory. That exactly is the bottom line of the current political challenge in the State .Thus, it would be foolhardy of any litigant to, through political impunity, unbridled and unprovoked hooliganism, tries to circumvent the constitutional right(s) of his opponent.
Meanwhile, the President of the Nigerian Bar Association, Austine Alegeh, SAN, has directed the third Vice President of the Bar to come to Ekiti State on Friday 26th September, 2014 in respect of the matter.

BRIEF NARRATION OF WHAT TOOK PLACE TODAY (25/09/14) AT
THE PREMISES OF THE EKITI STATE TEMPLE OF JUSTICE

For the benefit of inhabitants of Ekiti State in particular and Nigerians in general (who may not know the basic facts of the acts of hooliganism that took place at the temple of justice of Ekiti State today), a brief narration of the event is necessary.

The findings of the Branch on the ugly events of today revealed, among others, that the courts premises at the Ado-Ekiti Judicial Division of the State was taken over by hoodlums (later discovered to be political supporters of His Excellency, Dr. Ayodele Fayose) as early as 8:15am. The hoodlums started moving from one court room to the other destroying their documents, assaulted a Judge, Lawyers and staff of the Judiciary of the State. Consequently, they became bewildered and helpless and they had to run away for their lives.

When Hon. Justice J. O. Adeyeye saw His Excellency, Dr. Ayodele Fayose surrounded by the rampaging political supporters, he summed up courage, approached and introduced himself as a Judge of the High Court of the State. Thereafter, he respectfully appealed to him to stop his political supporters from their acts.

His Excellency, Dr. Ayodele Fayose, saw the humble intervention of the Judge as an effrontery. With the response of His Excellency, Dr. Ayodele Fayose, towards the Judge, the political supporters saw that as equivocal and irrevocable authority of their principal and they descended on the Judge. Thereafter, they additionally descended on Lawyers and Staff of the Judiciary. They beat him up and he only escaped with his life by God’s providence.

As at 10:55am when the leadership of the branch went to the place to see things for itself, the hoodlums were still within and without the premises in their hundreds, highly charged and brandishing dangerous instruments. Although the Police Vehicle and police men were still around as at that time, they did not dispatch the riotous hoodlums, at least, with tear-gas. The findings of the branch additionally revealed that the molested Judge was not handling any of the political cases. The truth however is that the Pre-election Trial Conference in the ongoing Ekiti State Election Petition Tribunal came up today.

CONSTITUTIONAL AND NEGATIVE IMPLICATIONS OF THE CURRENT POLITICAL IMPUNITY AND SIEGE ON THE TEMPLE OF JUSTICE IN EKITI STATE
For the benefit of all and sundry, it is necessary to mention some serious constitutional and negative implications of the current and sustained political impunity and siege on the temple of justice in Ekiti State.

First, a serious constitutional crisis is coming in the State if by act of commission or omission an atmosphere of anarchy is encouraged on the temple of justice of the state. This is because that may have serious implication on the performance of the constitutional duty of the Head of Court in the State with respect to compliance with section 185 (2) of the constitution.

Second, if this sustained culture of political impunity is allowed, that is, without allowing the current legal suits against His Excellency, Dr. Ayodele Fayose, to get to their logical conclusions one way or the other, then a bad and dangerous precedents would have been created in the State, indeed, in the whole of Nigeria. In order words, all that any defendant in a litigation needs to do in future, whether in criminal, civil, political, chieftaincy etc., is to organize hoodlums to invade the Courts and scared away the Judges, if such Judges are lucky to escape with their lives. And that will be the end of such case(s).

Third, consequently, the end result of this culture of impunity in Ekiti State should be imagined rather than being experienced. For, if our leaders allow the populace to lose confidence in the Law Courts, they would be courting a serious anarchy in the system and the result of which nobody can phantom for now.

Fourth, if the current assault on the Judges of the Ekiti State Judiciary is allowed to continue, they would have lost the necessary independence that should be the bedrock of the performance of their constitutional duties.

SAFETY OF JUDICIAL OFFICERS, LEADERSHIP OF THE BAR AND OTHER LAWYERS IN THE STATE
In view of the fact that “truth” is always very bitter and Nigerian politicians generally are averse to it, they are ready to go to any length to deal with perceived persons or organizations who tell them the truth they need to hear. For instance, it is on record that in 2002, when the Onitsha Branch of the Nigerian Bar Association stood in favour of the truth in regard to the then political impasse in Anambra State, the Chairman of the Branch, Barnabas Igwe and his Wife,Amaka, were mysteriously murdered by armed political thugs in broad day light in September of that year.

Consequently, whilst the human protection comes from God, THEBRANCHWISHES TO CAUTION, IN ADVANCE, THAT IF ANY ADVERSE THING(S) HAPPEN(S) TO ANY MEMBER OF THE HIGHER AND LOWER BENCH IN THE STATE; LEADERSHIP OF THE BRANCH (AND MEMBERS OF THEIR FAMILY); AND, INDEED, ALL MEMEBERS OF THE BAR IN THE STATE, FROM TODAY, THEN THE POLITICAL CLASS IN EKITI STATE SHOULD BE HELD RESPONSIBLE. THE REASON FOR THIS IS OBVIOUS. THIS IS BECAUSETHE LEADERSHIP OF THE BRANCH CAN NOT BUT CARRY OUT THE DUTY OF LEADERSHIPIN THIS PERIOD OF ORCHESTRATED POLITICAL CRISIS IN THE STATE

RECOMMENDATIONS
In order to ensure political and legal sanity in the State and also the safety of Judges, Lawyers, Judiciary workers and litigants, the Branch makes the following recommendations:
a. A thorough investigation into today’s mayhem should be conducted and those found culpable irrespective of their status should be prosecuted and sanctioned accordingly.
b. All Lawyers representing litigants in all the political cases in Ekiti State should call their clients to order.This is because the Branch shall not hesitate to forward the name(s) of any erring lawyer(s) to the necessary quarters for professional misconduct and for failure to guide their clients on the need for civilized behaviours.
c. In view of the events of Monday 22nd and Thursday 25th of September, 2014, that is, the orchestrated political mayhem and desecration visited on the temple of Justice, its officers, lawyers and staff of the Judiciary of Ekiti State, the Commissioner of Police should beef up security within and outside the premises of the courts in the State.
d. The Branch additionally calls on the COP of the State to be alive to his responsibilities. This particular recommendation is informed by the fact of the passive attitude of his officers throughout the crisis of today and that of Monday 22nd September, 2014.
e. Lastly, the Branch calls on the Commissioner of Police in the State to extract letters of undertaking of good behavior and maintenance of peace in the state from both the out-going and in-coming Governors of the State.

CONCLUSION
