Olubunmi Ojoko, on Wednesday, narrated how a former Head of Service, Mr. Stephen Oronsaye, used the Federal Government’s N190m which he allegedly kept in a secret account in his capacity as the then Chairman of the Presidential Committee on Financial Action Task Force. Ojoko was testifying as the second prosecution witness in Oronsaye’s ongoing trial before Justice Olasunbo Goodluck of a Federal Capital Territory High Court in Maitama, Abuja. The witness said she was the Access Bank’s officer in charge of the account, which the former Head of Service was said to have unilaterally opened in the name of the Presidential Committee on FATF without the approval of the Accountant-General of the Federation. The account was also said to be unknown to other members of the committee. The Economic and Financial Crimes had on March 15, 2016 arraigned Oronsaye on two counts of breach of trust which he allegedly committed between 2013 and 2014 by defrauding the Federal Government of N190m using his position as the then Chairman of the Presidential Committee on FATF Oronsaye was accused of converting the N190m to his personal use through the investment of the fund in Access Bank Plc’s Banker’s Acceptance for a tenor of 90 days at 9 and 12 per cents interest rates “in violation of the extant financial regulations”. The defendant, while still serving as the Head of Service of the Federation, was appointed as chairman of the PCFATF, which was set up to ensure the passage of the anti-money laundering bill and countering financial terrorism, among other terms of reference. Ojoko opened her testimony shortly after the first prosecution witness, Ngunnan Kakwagh, an EFCC investigator, was cross-examined by the defence team led by Chief Kanu Agabi (SAN) on Wednesday. Kakwagh in her earlier testimony on March 15, had alleged that the ex-Head of Service unilaterally operated the Access Bank account in the name of the PCFATF and received a total of N240m from the CBN through the account. She had said Oronsaye also made “five structured payments” of N9m each, making a total of N45m, into the account in one day in September 2013. She said from the total of N285m, of which a chunk of N240m was paid into the account by the CBN, Oronsaye invested N190m in fixed deposit and converted it along with the accrued interest into personal use. Ojoko, led in evidence by the EFCC’s lead prosecuting counsel, Mr. Ufom Uket, began her testimony on Wednesday, narrating how Oronsaye opened the Access Bank account on behalf of the PCFATF in 2012, without obtaining an approval from the Accountant-General of the Federation. She said, “He (Oronsaye) called me that he needed to open an account on behalf of the Presidential Committee on Financial Action Task Force. “I met him at his residence in Asokoro, where I handed him the documents for the account, including the Access Bank account opening request of the committee signed by him, his passport photograph, copy of his passport and documents that set up the committee by the then Secretary to the Government of the Federation. “I scrutinised the documents and discovered that the Accountant-General of the Federation’s approval was not included. So I asked him for it and he said it was not necessary. I asked for the Accountant-General of the Federation’s approval because it is needed when opening a government account. Since he said that it wasn’t necessary, I took him by his word. “I took the documents to the bank and the account was opened.” She confirmed that she never met any other member of the committee, including Mr. Jalal Arabi, a counsel in the presidential Villa, who served as the secretary to the committee, throughout the period the account was operated. She said there were a total of four lodgments into the account from the CBN and other cash deposits. She said the lodgments totalled N280m, part of which were invested in fixed deposits with part of the interests that accrued re-invested. She said as of the time the account was closed, Oronsaye had withdrawn from the account about N150m which was partly the accrued interests on the investments, through cheques which he allegedly issued in favour of himself and various beneficiaries. She said besides “the direct withdrawals” by Oronsaye, “there other various beneficiaries”. Ojoko said, “The first transfer was N50m in October 2012. The second was in April 2012 was N90m from the CBN. In May 2013, there was cash lodgment of N45m . The fourth lodgment of N100m came in December 2014 from CBN. “After the first lodgment (of N50m from CBN) several cheques were drawn by the defendant (Oronsaye). Punch report today that Ex-Niger governor Abdulkadir Kure was arrested on wednessday for recieving six hundered million naira (N600m). Accordin to punch report the arrest took place on wednessday and Dasuki told punch correspondent that Kure was arrested on Wednesday and has been undergoing intense interrogation. CIVIL servants and pensioners on Wednesday besieged the Rivers State Secretariat in Port Harcourt to protest the non-payment of their salaries and pension arrears by the state government. The protesters had moved in droves to the secretariat at about 9am, even as workers refused to attend to anybody that sought their assistance at the secretariat. The protest caused a gridlock for some minutes as workers and pensioners chanted war songs, calling on the state government to pay their salaries and pensions. One of the leaders of the protesting workers, Mr. Tony Ochiagha, told journalists that the protest became necessary as a result of the two months salaries owed them by the state government. Ochiagha pointed out that it was the first time in the history of civil service in the state that workers would be owed for two months, adding that the third month was already approaching. He stated that pensioners, who were owed five months pension arrears were also going through tough times as they could no longer afford to pay their bills and feed well. Ochaigha said, “We are talking to the Rivers State Government who is our employer. The civil service is the engine room and the platform on which every administration functions. So, why would they play on the impulse of the civil service?” Also, the state secretary of the Nigeria Union of Pensioners in Rivers State, Mr. Joseph Agbo, said pensioners in the state had not been paid for five months. Agbo urged Amaechi to pay them before leaving office, adding that apart from the five months being owed pensioners, other arrears such as the 14 per cent, 15 per cent and 38 per cent increases had not being paid, even when they had been computed and sent to the governor for action. “Pension is a right and not a privilege. Before the governor came on board, salaries of civil servants and pensioners were regular, but all these are no more. “We have, on six occasions, had demonstrations in the past over the anomalies and our members are dying without getting their entitlements,” he added. www.ladieswinds.com is serious loaded with political issues |
A Federal High Court sitting in Lagos has fixed May 27, 2015 to decide on a fundamental rights enforcement suit filed by the senator-elect for Ogun East Senatorial District, Mr. Buruji Kashamu, seeking protection against the alleged plot to extradite him to the United States. Kashamu, in the said suit, accused the Inspector-General of Police and 11 others of plotting to abduct and forcibly transport him to the US to face trial on alleged drug-related offences. He alleged that he had uncovered plans by the defendants doing the bidding of former President Olusegun Obasanjo to arrest him during his swearing in as a senator and to transport him to the US in a private plane to face trial before Judge Norgle. He therefore prayed the court to declare the alleged abduction and extradition plot as an infringement on his fundamental human right to liberty, freedom of association and freedom of movement as provided by sections 35, 40 and 41 of the Constitution. Moving the application on Friday, Kashamu’s lawyer, Dr. Alex Izinyon, said his client had rushed to court to seek protection because “when you see a danger coming, you don’t have to wait until it takes place.” He said the law allowed an applicant to seek the court’s protection when he sees that a danger “has been, is being or is likely to be” unleashed on him, adding that Kashamu fell within the perimeter of “likely to be.” Besides, Izinyon argued that none of the 12 respondents sued had controverted the alleged plot to abduct his client. But counsel to the Inspector-General of Police and the Interpol National Central Bureau, Mr. David Igbodo, said Kashamu failed to show any proof of the alleged move to abduct and extradite him. Igbodo, who described Kashamu’s action as speculative, urged the court to dismiss the suit. “My Lord, what the 1st and 5th respondents are simply saying is that this application is speculative. The 1st and 5th respondents have not made, are not making and are not likely to make any attempt to abduct the applicant as alleged by the applicant.” Igbodo added that abduction is a criminal offence, which the IGP, as the foremost law enforcement agent in the country, would never engage in. The other respondents who, through their counsel, urged the court to dismiss Kashamu’s suit were the Chairman, National Drug Law Enforcement Agency, Chairman, Economic and Financial Crimes Commission; Director General, Department of State Service; and the Attorney General of the Federation. Others were the Clerk of the National Assembly; the National Security Adviser to the President of the Federal Republic of Nigeria; Independent Corrupt Practices and other Related Offences Commission; Nigeria Customs Services; the Nigeria Immigration Service; and the Nigeria Security and Civil Defence Corps. Earlier, Justice Okon Abang refused an application by the counsel for the Clerk of the National Assembly, Mr. Joshua Okah, to join Obasanjo as a respondent in the suit. Okah said, “My Lord, we have perused the affidavit in support of the applicant’s originating summons and we observed that Chief Olusegun Obasanjo featured prominently and serious allegations were levelled against him; we have brought this application that he should be joined as a necessary respondent for the complete and effective determination of this matter.” But Izinyon, who described the application as an abuse of court processes, said it was an aberration for a respondent in a suit to seek to join another respondent. Ruling on the arguments, Abang upheld Izinyon’s argument and dismissed the application to join Obasanjo as a respondent in Kashamu’s suit. Kashamu is seeking, among other reliefs, an order of the court directing the IGP to “provide a security detail of at least six armed police officers to protect the applicant at all times of the day and to prevent (him from) any attack or abduction.” He also prayed for an order directing the Clerk of the National Assembly “to accord the applicant every facility, right and privileges due to a senator-elect of the Federal Republic of Nigeria until he takes his oath of office and thereafter as is due to a senator of the Federal Republic of Nigeria.” He prayed the court to restrain all the respondents and their agents from preventing him from entering the National Assembly hall. see more info news at: http://www.omozar.com/category/ng-info-news |
