Abdulazeez Usman of 82 Provost Company in Onitsha, Anambra, to Private for human rights abuse The Nigerian Army spokesman, Brig.-Gen. Sani Usman, made this known in a statement in Abuja on Friday. Usman said the demoted soldiers on Feb. 7, maltreated a physically challenged person, Mr Chijioke Uraku, on the street of Onitsha, Anambra, for allegedly wearing Army camouflage uniform, Usman said they were arrested, summarily tried on two-count charge and found guilty.“Consequently, both have been sentenced to reduction in rank from Corporal to Private Soldiers and 21 days imprisonment with Hard Labour, respectively. “It includes forfeiture of 21 days pay to the Federal Government of Nigeria. “The Nigerian Army has also reached out to the victim of their unjustifiable assault, Mr Chijoke Uraku (alias CJ), as widely reported by the media. “We wish to reiterate our avowed determination to ensure that troops conduct themselves in the most orderly and professional manner at all times. “Any act of indiscipline would not be tolerated,” he said.

A former Minister of State for Defence, Senator Musiliu Obanikoro, has returned a fresh sum of N30m to the Economic and Financial Crimes Commission, with a promise to pay a balance of N417m. The ex-minister, who returned to Nigeria in October 2016, after spending about 15 months in the United States, was accused of receiving N4.7bn from the Office of the National Security Adviser under the leadership of Col. Sambo Dasuki (retd.). Obanikoro had said in his statement of oath at the EFCC that after receiving the money in 2014, he gave N1.219bn to the then governorship candidate of the Peoples Democratic Party in Ekiti State, Mr. Ayodele Fayose, while N1.3bn was given to the PDP governorship candidate in Osun State, Senator Iyiola Omisore. He also confessed to giving Fayose a separate $5.377m at Spotless Hotel in Ekiti State in the presence of party stalwarts, including the then PDP state secretary, Mr. Tope Aluko. Obanikoro was said to have kept about N785m for himself, which he allegedly spent while campaigning ahead of the PDP governorship primary in Lagos State, which Mr. Jimi Agbaje won. However, the EFCC asked him to return about N584m, out of which he has returned N167m. At the Federal High Court in Abuja, presided over by Justice Nnamdi Dimgba, Mr. Alade Sunday, a manager at Zenith Bank, narrated how Obanikoro delivered about N1.219bn to Fayose’s aide, Abiodun Agbele, for onward transmission to Fayose. He had added that it took the cashiers about 10 days to count all the money. Sunday had said Obanikoro flew the cash to Akure airport and the money was loaded onto bullion vans. “When we got to the airport, we waited for some minutes before the aircraft arrived. When the aircraft offloaded its passengers, one of them appeared to me to be Senator Musiliu Obanikoro and the other one appeared to be his ADC, Adewale. “Agbele walked up to them and had a discussion with them. Thereafter, he signalled to me to bring the van. Bags loaded with cash were loaded into the van and Obanikoro’s ADC, I and Agbele drove back to the bank,” he had stated. |

Our attention has been drawn to publications on various online platforms indicating that the Nigeria Customs Service has reversed the ban on Rice importation through the land borders. These reports were attributed to a press interview purportedly granted by the Service Public Relations Officer, Deputy-Comptroller Wale Adeniyi. 2. It has become necessary to re-state the true position in view of the confusion which these online publications may create in the industry. It is even more expedient to provide this clarification given that the fact that the Service has taken a firm position earlier in the week through a joint press conference with Stakeholders. 3. First, we like to reiterate the position that importation of Rice remains banned through our Land Borders, and we have the commitment of Partner Government Agencies and Stakeholders to enforce this restriction. While this restriction is in force, Rice imports through the Ports are still allowed subject to payment of extant charges. 4. It is equally important to restate the confidence of the Nigeria Customs Service in the ability of Nigerian Rice Producers to fill the existing sufficiency gaps in the supply of the product. The Service has noted with satisfaction the ongoing Rice Revolution undertaken by many State Governments, and Strategic Interventions by Federal Government Agencies. The Service is convinced that the bumper harvests expected from these efforts will address the supply gap in 2017. It is our belief that continuous waste of scarce forex on a commodity that can be produced locally makes no economic sense, most especially at a period of recession. The Service will therefore advocate a total Ban on Rice Importation into Nigeria with effect from 2017. 5. It is worrisome that the publications that resurfaced this weekend were being attributed to a Press interview granted in October 2015. We strongly suspect that some powerful forces behind Rice Smuggling are at work, recycling an old report under a different circumstance to create confusion. We urge Nigerians to watch out for similar antics as the firm stand on Rice smuggling will pitch their selfish interest against our national interest. The Majority Leader of the House of Representatives, Femi Gbajabiamila, has described the suspension of former Chairman of the House on Appropriation, Abdulmumin Jibrin, as unconstitutional. Recall that the Lower Leg[color=#990000][/color]islative Chamber had last week suspended the Kano-born lawmaker for a period of one year after he failed to appear before the House Committee on Ethics and Privileges with regard to his budget padding allegations leveled against the Speaker of the House, Yakubu Dogara, and some other principal officers. However, Gbajabiamila questioned the legality of Jibrin’s suspension, stating that suspending a lawmaker means suspending a constituency from participating in the activities of the National assembly, ThisDay reports. According to the House Leader, “My concern on the suspension is the same that I always had, even when Dino Melaye and others, were suspended in the 6th Assembly. More so, as this was a one-year suspension. “Now what is this concern? I find it difficult as a Constitutional Lawyer, to accept that our rules can actually pass constitutional muster, if put to test. If you suspend a member for a year, you are effectively suspending his constituency and the people he represents, from participation in participatory democracy. “This, in my own personal opinion, violates the constitution which delineates the country into Federal Constituencies for effective representation, at the centre. For every constituency, it is a right to be represented in the national assembly, not a privilege that can be taken away. “The constitution says clearly that, all Federal Constituencies must be represented for 4 years, and lists, I believe, only 1 or 2 circumstances under which such a constituency can be unrepresented. e.g. by process of recall etc. Even at that, the vacancy is to be filled immediately. Our constitution does not envisage a situation where a Federal Constituency is unrepresented or underrepresented. “If, for instance, an issue comes up in a member’s constituency, that requires federal attention or legislative address, who do they go to? We cannot take away a mandate, given by the people or short change a constituency. In law, the seat of a representative is held in trust for the constituency. “This is why when a member gets up to speak, he goes through the formality of announcing his name and the constituency he represents. In fact, in other democracies and Legislatures, when a Speaker wants to recognise a Representative to speak, he addresses him or her not even by name, but as for instance, “the gentleman from so so constituency”. “That is the pre-eminence given to a constituency in a democratic setting. So it is not about Honourable Jibrin, it is about Beweji Constituency. I do not stand in the gap for Jibrin, or is this in any way a defence on his behalf. You may not know this, but Jibrin and I stopped relating as friends and colleagues, since March or thereabout. “However, I am not one to shy away from the truth and the rule of law. I believe that there are other ways that would be constitutional, if the House wants to discipline any member. On whether this was contempt of court, I believe that you are speaking about the Federal High Court decision in the Melaye case, when the Court said that the House lacked the powers to suspend the members. “I do not remember the basis upon which the Court made its decision, but I will definitely look at it again. I suspect it was on the basis of fair hearing, as provided in the Constitution. |
