I see.., In my wife's case, her passport became invalid after 6 months, she was instructed to do all the legal procedures with the ministry of internal affair during the 6 months period.
By the way, she is not a Nigerian.
Ok. Maybe that why. Mine is still valid. Probably it's different for some countries. They had no problems renewing in my maiden name. Although I had to provide my marriage certificate for my daughter's passport. And I also obviously included it in the visa application.

I also got a passport and visa for my daughter who bears her father's name. I think that's as much valid as it can get. If u ask me..

Hello, pstfrancis,

I got married in 2012 and have done a change of name in the newspaper and all of that bit. But cos I refused to go to abuja in Nigeria to change the name, I renewed my passport in my maiden name. Rmbr in the newspaper change of name notice, it states that all documents remain valid. All ur wife need do is to include her marriage certificate and the newspaper clipping in her applications or whatever. That covers it. I've never had a problem with this for over 2 and a half yrs.

pls i got a sponsor to UK with my family under tier 2 Religion and my wife passport has expired, we were thinking of just renewing the old bearing her maiden name instead of changing it to the new name she is bearing, pls i want to know if their is any danger in still retaining her maiden name even though we are married with a child. will it affect us in UK or it doesnt matter. the reason we still want to just renew her maiden name is because of the stress involve in doing change of name.

Ur spouse has to be ready to move to another eu state for about a period of 6 mths tho. So we chose Ireland. He is there already waiting for us. We can.start our family life now. Just read up on it u will understand it better. It's very easy and cheap and has no stringent rules. They don't ask for any acct or anything. Inis.gov.ie. http://eumovement./directive-200438ec/

If you can not get a UK visa then
no "back door" through illegal entry from Ireland.
You will be spotted and deported.
Worry, they definitely share information but u are so wrong as per back door or illegal entry. It's called EU treaty right. Going the surrinder Singh route. I applied for a join eu spouse/parent Irish visa which i got without any stress. And the only requirements were my husband's passport data page and our marriage certificate. The visa got to my doorstep in a mth. Mine and my daughters. I declared all the refusals and even put in the refusal letter. U know what they say a nan who doesn't read is the same as one who cannot read.
It's not a matter of backdoor read up on ur EU rights. Also on inis.gov.ie. As long as ur spouse is ready to exercise their treaty rights u r fine. And in 6 mths or so u get ur 5 yr eea family permit. No threshold. Visa should be free so we don't pay visa fee. Only the vfs service charge

Hello everyone,

After the frustration meted on my husband and I in regards to the settlement visa, we thought of an alternative route. We have a baby now so it's enough to be proactive. We decided to get an Irish visa and go to the surrinder singh route. I got the Irish visa for both our daughter and I, so we will be applying for an EEA family permit when we get in.
I wanted to share this just in case anyone would consider it. The visa was very easy to get and although it's supposed to be free of charge, we only paid service charge to vfs.
I'm finally ready to go and start life with my family which is the most important. And by the grace of God in about six months max we get our family permit.
Anybody who is interested can so their research on Google. Google has been good to me.
Just wanted to update y'all.

They finally replied. Said that the case is going to court. So that means that they will send the bundle to court.

That was all they said so I guess that means that they didn't overturn their refusal.

I thought the EU directive supercedes all of the national laws. Am I wrong? What's ur take? At least they don't have financial requirement and the requirements for the join spouse visa makes it seem so straightforward.

Mainly financial. They claimed not to see some documents. We thought they will overturn it but we haven't heard from them. And the date they gave us is Feb next year.

I'm applying from Nigeria.

We are intending to go through this route after over two years of separation and a baby.

Any ideas if the previous settlement refusals can affect my join spouse application? Also how long does the visa take to come out?



justwise: Its not easy to take that route if the sponsor got a job already in the UK, moving to another EU country to start life afresh briefly is not an easy decision to make.

@DUNIQUE they sent us two letters. One with the court date and one to tell us that the home office hasn't sent the bundle.

The bundle will be sent from home office to tribunal not to u.

These pple are just crazy jare no point thinking for them. Just keep praying they may still overturn before the court date.


DUNIQUE1: sorry @ Sunnychic, who is asking who to send the document, is it the tribunal that will be asking the homeoffice in that case or who? Because I haven't received my bundle yet, my partner called the tribunal and they gave her the date.
So basically the letter I will receive for court will also state that the home office should send my bundle or what exactly? Please don't get tired of me or my questions oh.

DUNIQUE, if they have sent ur bundle to the tribunal then they have most likely reviewed it. But if u got a letter asking them to send the documents along with the one they sent ur court date in then I guess they.have not reviewed it..

Lucky u, November is just round the corner. Let's all keep out fingers crossed and keep praying. There is nothing God cannot do.

girlfio: This whole process is so hard. It's difficult sometimes to give advise because they keep changing the goal posts. When we were going through the appeal process, as the UK based spouse I just had to fix in my mind to fight for my rights. The bottom line is, u are entitled to a family life and as long as u meet all of the requirements, you are well within your rights to pester them for answers, results and updates. Above all things, get close to God. He is the only one that will lead and guide you in to all truth. I could not have made it through without His favour, His Joy and His peace. Don't put your lives on hold because of these people. Gather your evidence, stay in contact with them and don't let up. Most importantly, take it to The Lord in prayer, put it in His hands, He will make ways were there appears to be none.....u will make it to the other side. Hebrews 13:6 reads "So we say with confidence, The Lord is my helper; I will not be afraid. What can man do to me?" Stay strong my friends.

I get u, Ikato3540. If it has been reviewed, they will have sent the bundle to the tribunal I guess. Or they would even have replied me or my husband.

I was thinking about your case today you know... And I think that it may be possible that it may not even have been reviewed by an ECM ( possibly aka another ECO)
So they cld still overturn it- they cld be busy and it's not unheard of that they overturn it at ANY time before court date.
The most important thing is for you to go over your refusal reason(s) and your appeal. If you have a simple case and you have strong appeal grounds, then take a chill pill.
Some people have more serious cases like where a refusal is under one of the tough sections of para 320.
They cannot tell how their case would go in court.
So it depends on the simplicity or complexity of your individual case.
Do u actually think the HO would turn up in court, if you actually 100% meet the financial requirement, and you have produced the evidence beyond reasonable doubt to prove this?
I can put money on it that they wldnt bother. What wld they come and say?
It's just the time, and uncertainty of knowing when IT would happen. That creates anxiety.
At least you get to see your husband which is good and which I'm sure helps.
So pray and I pray for you in my heart that things would resolve sooner than later.

U guys read me right oh. They sent a letter to my husband and gave us a court date of February next year. Seeing as visa office hasn't contacted them why won't they do such stupidity?

I was refused on that they didn't see some documents which we sent and which we sent again with the appeal. They know they can get away with it so why bother being humane?

I am still yet to hear from the visa office. Also the visa office hasn't contacted the tribunal. And yes, it's getting worse with these immigration issues. We have to explore something else. I have had it up to here with being separated from my husband

What I said is that the visa office hasn't replied my mail but the tribunal sent a February date. But they said the visa office hasn't contacted them.

They didn't update us too. Just sent that revised do-nothing email.

We sent our appeal sometime in Jan. So u cn imagine getting a February date. Its the height of unfairness if u ask me.

@DUNIQUE, I got that same mail. The do nothing.

@ justwise we will contact them during this week. We got the letter on Fri.

@hopeforallone they claimed not to see some documents sent in with my application. P60 and some pay slips and employers letters. Which we sent. So we sent them with the appeal

DUNIQUE1: My partner earns more than the required amount, the issue is that we left out some payslips and that has been included with the appeal, my initial application was refused on the basis that my relationship wasn't genuine and that they are not satisfied with my partners earning because some documents were missing, I wasn't suppose to be part of the people on hold because they already included the financial requirement in my initial refusal, so this new email is either a duplicate or they are just being lazy as usual, but I am confident I meet all the requirement, so I just need to clarify that with them.

The letter we received, the tribunal said they have not heard from the Sheffield office. But still went ahead and sent the letter as per the deadline date. But they said they haven't heard from the visa office. This visa office have still not replied us.
Why ain't they replying us or even the tribunal? Is it still this backlog? What do we do now?
