With the striking out by the federal high court,he can now approach the appeal court to get the stay of execution via an exparte order pending the determination of the substantive appeal already filed before the appeal court. That's the process.

If he had approached the appellate court directly for the stay of execution,they may likely refuse it and refer him back to the high court that issued the original ruling thereby making him not to get appeal on time.

But I can see some people here already jubilating without understanding what really happened. Lol
