A court has ruled that he was snuggled back illegally so cannot stand trial so he may be right. You cannot build legality on an illegality.
As far as the law is concerned he was not properly extradited. That alone nullifies any charges against him.
He must be returned to Kenya and properly repatriated before he can be tried.
