You always put a smile on my face each time I read ur response to my enquiries....we ar just tryin to see how possible it is for me to be there on or before the end of march which is my wife's due date....
I WISH u will tell me "apply for non-immigrant and we will grant it"!!!!!!! (I KNOW!!!)
Anyway...am hopin we don't experience the delays we had durin d k1 process due to backlog and RFE (due to over looking a question...smh)...it is well

Greetings! They have equal approval chances because they're based on the exact same thing -- a petition filed by a U.S. citizen spouse. A K3 requires the I-129 petition, which can only be filed after the I-130 petition has been appoved by USCIS. K3s usually get interview dates sooner than CR1s, because CR1s are scheduled by the National Visa Center (NVC), whereas K3s are scheduled by the applicants themselves online; but CR1s are generally processed so quickly that you only save a month or so by going the K3 route. (That said, NVC is experiencing processing delays due to a sudden increase in their caseload; but by the time you file, I think they'll have everything back to normal again.)

We generally don't allow petitioners into the waiting room. You probably noticed how full our waiting room was when you came to your interview -- and that was a slow day, as I recall.

My wife is bac in the US and will file d i130 asap..
On the dept of state website..it says "The K-3 nonimmigrant visa is for the foreign-citizen spouse of a United States (U.S.) citizen. This visa category is intended to shorten the physical separation between the foreign-citizen and U.S. citizen spouses by having the option to obtain a nonimmigrant K-3 visa overseas and enter the United States to await approval of the immigrant visa petition."
It also says the i129f should be filed after receiving d NOA1..not after waiting for approval of i130...
Dear VO , I know at d end of d day the consular officers hav d last say as to who gets a visa and when so I will go wit ur advice on this....I really hope I can get dis process done with ASAP!!!

The best way to accelerate the process is to make sure all necessary documents are submitted to USCIS along with the I-130!

My wife is in d country so we can perform d registry. Due to d short duration of her stay (just 4 days) I opted to have us do the registry ceremony in lagos instead of benin wher I reside and due to d closeness to wher we put up in lagos I registered for the wedding at festac registry..
Fast forward to this morning..a friend calls me to tell me that the US embassy only recognise certificates from Ikoyi registry so I should go there to register...it was a very laughable suggestion/observation...but out of curiosity and to educate d public and also to hear from "the horses" mouth..am posin d question to u..does it matter wher I do my registry marriage?

You should have received a letter from us at the time of your interview. Did it specify that you are already married and thus not eligible for the K1? If not, that would be within my authority to issue.

The good news for you is that our computer records already indicate that we believe your relationship is bona fide and that you are in fact traditionally married. That means that when you appear for a spouse visa, it's unlikely that anyone will question your relationship with the petitioner. (I know that this doesn't make up for the delay, but I hope it alleviates some of your worries.)

No I dint receive any report from d officer...I will b very grateful if u can issue this ...basically for records purpose....thank you so much for your help ...at least this will make d waiting period a lil less stressful....

To my case and more questions.....my wife is arriving naija this month so we can hav d registry marriage and begin d k3 petition asap....we also hired a lawyer to help identify and clear any grey areas in d process......my question is....after spending almost 10 months and plenty of $$$ on the k1 process....is it too much to ask dat we get a written report about the reasons for the denial of the k1 petition?
Oh...and am tempted to invite u for our court wedding!!!!!!

Hello VO, tanks for ur prompt response as usual...my wife and I ar still heartbroken from d denial hence we ar really desperate to get this sorted out asap...she plans to come before d year runs out so we can do the court weddin to enable her start d filing process..so the timeline for cr1 is between 9 to 13months..

Dear VO, pls permit me to bother u once more...a sibling of mine says she went alone to the registry to get d marriage certificate without her spouse accompanin her...my fiancee just started a new job and it will b difficult for her to get a break and travel bac and forth due to her present condition..what if I can get the certificate on her behalf..will it be honoured by you?..thnks for your response

Now der is overwhelming evidence to suggest that we ar married because I filed for k1..I guess when we file for spousal...I may need to show more "overwhelming" evidence to show we are married!!! It is well...

VisaOfficer: I've read the officer's notes and I agree with the conclusion that your ceremony constitutes a traditional marriage. There is also independent evidence that the petitioner in this case refers to you as her husband, so it will be difficult to convince us that you're not married. The petition will be returned to USCIS with a memo recommending that it be revoked; since it's a K petition with a short period of validity, USCIS will probably close the case without contacting the petitioner. I'd advise the petitioner to file the I-130, Petition for Alien Spouse.

Just got bck from the embassy...I was denied...the consular says my "wife" should have petitioned for spousal visa instead of fiance visa..
All we did was a traditional introduction ceremony which her family came from the USA to attend...
I plan to appeal...what do u think...thank you for ur support

Thank you for ur response....yes am applying for a k1 visa..pending? I hav heard of cases dat ar placed on pending for "ages" even after the requirements ar met...it is well...I will do as you say..

Hello visa officer...I have been a guest here for over two yrs until this moment. U ar d reason I hav joined d best indigenous website so far..my interview is thursday and I hav been unable to get d. Birth certificate from NPC until this moment even though I paid for express..I hav been told that I caant get it before thursday. But a stamped request form was given to me to show as evidence that I am in d process of getting the doc. Pls will this serve the purpose or lead to my being denied because I would rather reschedule the interview and wait for the certificate dan hav d visa denied because of this..will appreciate ur advice. Thank you
