Today, the 10th day of October 2024, the Court of Appeal, Abuja Division dismissed Appeal No. CA/ABJ/133/CS/2024 filed by His Excellency, the Governor of Rivers State against the judgment of the Federal High Court, Abuja Division in suit No. FHC/ABJ/133/CS/2023 delivered on the 22nd day of January, 2024.

It is important to state the facts and history of the case and the appeal thereof.
On the 30th day of October, 2023, after the failed attempt to impeach His Excellency, the Governor of Rivers State, the Rivers State House of Assembly became polarized into two factions. The faction led by Martin Amaewhule proceeded to the Federal High Court, Abuja Division and filed Suit No. FHC/ABJ/1613/CS/2023, on the 29th day of November, 2023.

Subsequently, on the 11th day of December, 2023, Martin Amaewhule and others defected from the Peoples Democratic Party that sponsored their election in the 2023 Legislative Assembly Election, to the All Progressives Congress.

By operation of Law, particularly Section 109(i) (g) of the 1999 Constitution of the Federal Republic of Nigeria (as amended), Martin Amaewhule and 26 others automatically lost their seats as members of the Rivers State House of Assembly on the 11th day of December, 2023, as Section 109(1)(g) is self executory as no court order is required thereof.
His Excellency, the Governor of Rivers State on the 13th day of December, 2023, presented the 2024 Appropriation Bill to the Rivers State House of Assembly, led by Rt. Hon. Edison Ehie, who was recognized as the Speaker of the Rivers State House of Assembly at the time. The Appropriation Bill was later passed into Law and became the Appropriation Law of 2024.

An Appropriation Law is a state law within the purview of the High Court of Rivers State.

Following the crisis in the Rivers State House of Assembly and the intervention by the President of the Federal Republic of Nigeria, that the parties withdraw their cases in Court, to allow peace reign, His Excellency the Governor of Rivers State obeyed the President’s directive and withdrew his cases and the processes he filed in Suit No FHC/ABJ/1613/CS/2023. Martin Amaewhule and others disobeyed the President and did not withdraw Suit No. FHC/ABJ/1613/CS/2023 and proceeded to obtain judgment against His Excellency, the Governor of Rivers State.

After the judgment of the Court of Appeal today, there is a gale of misrepresentation and misinterpretation that Martin Amaewhule & 26 others remain members of the Rivers State House of Assembly with Martin Amaewhule as the speaker thereof. This is patently false.

The defection of Martin Amaewhule and 26 others was not an issue for determination in the Federal High Court, Abuja and the Court of Appeal. What was in issue was the 2023 Appropriation Law and the National Assembly taking over the Legislative functions of the Rivers State House of Assembly.

Dissatisfied with the judgment of the Court of Appeal, Abuja Division, His Excellency, the Governor has directed his lawyers to file an appeal against the judgment of the Court of Appeal to the Supreme Court and also file an application for stay of execution of the judgment of the Court of Appeal. That maintains the status quo.

Accordingly, His Excellency, the Governor of Rivers State urges the good people of Rivers State to ignore the purveyors of fake news bent on misleading the good people of Rivers State.

As for the Speaker and passerby members, they are no longer Assembly members in Rivers State, the case still in court , this one is just mere distraction to give Wike Thugs something to talk about.

Maybe I should school you a bit on this..
For a start I reside in Rivers State since 2001.

Ameachi executed better project than wike both in physical project and human developmental projects.
For example , Songhai Farm ( That was targed as one of the biggest farm project in Nigeria), Boarding Secondary School in all LGA, revamping of all primary schools. He also build roads and building projects. He also provides foreign scholarship for Graduate student.
When wike resume as Governor, he stopped the farm from operating, stopped the Boarding secondary school and also stopped the funding of foreign students scholarships and he did not contribute nothing to the welfare of civil servants.
The only project Mr wike embarks on is limited to only road and flyovers and all of you started calling him Mr Project 😉 🙄.
Governor Fubara in his wisdom has commence revamping of the songhai farm that wike abandoned,( This is where the fight actually started from)he has commence Trans-kalabari Road, (this is the road that link several riverine areas and also to open up new cities), he has improve civil servant welfare, ring road construction has commence.
With what Fubara currently doing without making noise and despite the crisis here and there, I bet you what he will achieve in four years will beat what your Mr projec achieved in eight years.

LGA election is state responsibility not federal.

Fubara was not a party in that SC judgement and it's not binding on anyone.

Meaning Rivers LGAs not in Nigeria 😁
The declaration and directive from supreme Court is for all LGA in Nigeria.

SC made a proclamation on a different case other than that. It's a case of caretaker committee that the SC delivered on. The should wait or appeal the interim judgement because INEC n other organs responsible may decide not to recognize the elected members due to the court order and people will start shouting partiality.

There is no case of Caretaker Committee with supreme Court. The order for LGA election was made during the declaration for LG Autonomy.
This declaration stated that all states of the federation must conduct LGA election on or before 30th October 2024.( 10 stated already Adhere to the directive ).
Fubara is in the right part, lesser court can't override supreme court.
Also note that LGA election is state election not federal and Federal High Court has no business around it.

The word ingrate has become abused. If the October 30th 2023 impeachment had pulled through would you have called Fubara an ingrate? Because you sheltered me does not mean he will have to die for you even at a disadvantaged point. To the best of the Rivers man's knowledge, Fubara didn't lobby to become a governor. He was not a politician. He was not seen in the corridors of power lobbying for political positions or some sort of. Governorship came to him. And because it came to him doesn't mean he will have to die in it. Besides Wike did it for his interest. He had promised Felix Obuha. why did he not give him? He had Tammy Danagogo, why did he not give him? and the other heavy weights, What happened to them? If most of us were in Fubara's shoes, we would have done worse than him.

As much as we advocate for loyalty it should not turn into slavery. Fubara is not a saint, wike is neither. Since neither party has come forward to tell the reason for the fight in black and white, I will stand with Fubara for the progress of our dear state. Wike has ruled and we all loved him but he will never be our governor again. Besides empowering certain individuals, for whatever reason, which is a good thing. he doesn't have the green pen to make our state move forward. So We should with him, support him for the progress of our state.

Sim will disobey the judgement and go ahead with the election. But that will be a futile exercise as the Court will rely upon this judgement to nullify the election. Meaning that the LG allocations will not be released to the handpicked Fubara Chairmen. Fubara hasn't done well and can't succeed in his fight against his Boss.

Bro try to have full understanding of the process before arguing.
First and foremost President Tinubu fought and won for LGA Autonomy and Supreme Court declare that all state should conduct election within 3 months. As at now, over 15 states already do the needful.
So my brother, no lesser court can declare LGA election illegal unless supreme count reverse itself.
The judgement from River State hight Court ( go and read it) is in line with Supreme Court judgment so no other court will say otherwise.
What Abuja court is doing is called " Shakara".

Which Court order are you referring to?
Fubara is following Supreme court order which mandate all states of federation to conduct election within 3 months( Over 15 States already do the needful)
The River State Court order is also in line withe the supreme Court order.
But by your understanding, Fubara should forget Supreme Court order and follow Abuja Court order??

Fubara nobody is forcing you to not do whatever you like. But the Court Judgement has rendered it illegal, null and void AB initio. That means those people you will select as Chairmen will not see allocation accruing to the LGAs. You will have to be giving them your own money (which is entirely your business)😂

Supreme Court earlier declare that all state should conduct their LGA election.
The judgemnt of Rivers State High Court is a follow up to Supreme Court declaration, so no Court have power to stop LGA election.

Exactly what I stated here. The Rivers state governor keeps messing himself up in the name of he can disobey court orders. He will as usual disobey this but the election is already void if RSIEC does not follow due process. The only people I I pity are those who took loan to contest.
If Fubara doesn't have good lawyers, he can as well pick up the constitution and read for himself.
