Fubara did not lost appeal but withdraw the case earlier, SC judges only answer the prayer, it's a normal practice in law since 2024 budget is already academic exercise, it's past and no more issue will be discuss about it after today.
The next judgments is about defection , wait for it as everything will be put to rest that day.

Both the Federal High Court and Court of Appeal had in their separate judgments faulted Fubara’s presentation of the 2024 appropriation before a five-member House of Assembly led by Hon. Edison Ehie.

Fubara had predicated his decision to present to the Ehie-led House of Assembly on the grounds that the Amaewhule-led faction having defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) ceases to be lawful members of the state assembly.

But both the two lower courts held that he cannot present the budget before a five-member House of Assembly, especially when he did not present any evidence that the faction of Amaewhule 27 lawmakers defected from the PDP to the APC.

Displeased with the judgments of the two lower courts, Fubara had last year approached the apex court for an order setting aside the concurrent judgments ordering him to represent the budget to the Amaewhule-led faction.

I will remind you in the next 3 month if Amaewhule will be there as speaker.

The supreme court has ruled on the matter despite Fubara's team wanting to withdraw their appeal before the court.

What this means is that Fubara acted contrary to the constitution by :

1. Presenting the budget before a House that did not meant up to the minimum members that should form a quorum.

2. By the judgement above, that means the suspended members are expected to resume back to their sits in the House and you should expect them to first sack the current five man kangaroo assembly and reinstate the former Speaker. After this is done, Fubara will face impeachment for operating an illegal budget for the fiscal year 2024.

Governor Fubara had withdrawn the case yesterday against Martins Amewhule and others, by this withdrawal, it shows that the appeal court judgement that Amaewhule is the authentic speaker still stands and Fubara was fined N2m.
You may want to ask why the governor withdraw the case? Ofcos now there is another case in federal high court in Rivers state following the defection of the speakers, Supreme court has nothing to do with this case, cos the case today was about authentic speaker and not defection.
So in the coming days, expect the federal court to sack Amaewhule and his friends, and if this judgement happens, it automatically means the supreme court ruling will not be obeyed.
