Crime / Re: Zainab Duke-Abiola Who Assaulted Police Orderly Remanded In Prison, Denied Bail by Understudy99: 8:48pm On Sep 23, 2022 |
While we all want justice for the police officer in this case, I feel the court erred in denying this woman bail. I believe none of the charges proffered against her is an unbailable offence. While the NPF might be forgiven for being "heavy handed" in dealing with anyone that assualts an officer, the court on the other hand cannot and should not. That the court schedule does not allow for the hearing of her case right away, or the prosecution needing time to investigate and present her case is none of her doing, hence the reason why bail is the solutions for administrative/bureaucratic delays. From my limited knowledge, all but a few charges (Treason comes to mind) are bailable pending trial. A stringent bail condition(s) would have been enough for the court to show solidarity with it's counterparts in law enforcement. A denial of bail by the court is tantamount to an injustice in the pursuit of justice in this case. That said, @NPF, justice in this case should not stop at prosecuting all those responsible for the assualt on the young officer. We need to see you parade and demote the senior officer who signed off on assigning this officer as an orderly to a civilian, non-political office holder. And you need to communicate to the public who qualifies for police orderly, so people can help point out those currently enjoying these unjust privileges at the expense of all tax payers, so your officers are not subject to abuse of this nature in the future. 1 Like |
Education / Re: Students Block Airport Road In Lagos To Protest Ongoing ASUU Strike (video) by Understudy99: 1:48pm On Sep 19, 2022 |
Why LOS and not ABV though? I know both belong to the FGN, but one would assume protesting a government's action and inaction, would have been best targeted at the government seat of power. Neither ASSUU nor the FGN ( the two parties whose inability to come to terms is the reason for the protracted strike) is headquartered in Lagos. None of the parties involved in this negotiation or constitutionally empowered to intervene in resolving the impasse between the parties is headquartered in Lagos. So the choice of LOS is quite bemusing. While I empathize with all the young men and women whose future have been put on hold, and the universities workers whose livelihood has been jeopardized due to this protracted strike, I would implore NANS and it's decision makers to be careful of actions that would not pass a political litmus test. I hope this strike issue is resolved sooner than later. 1 Like |
Politics / Re: PDP Crisis: Ayu To Go, Wike’s Camp To Produce Replacement From South West by Understudy99: 5:26pm On Aug 27, 2022 |
Whatever they agree to, they should just make sure it is a legally binding agreement. I don't know how HE Wike will at this point take the word of Atiku or the PDP as worthwhile after all the moving goalposts of the past. In the famous words of GW Bush, fool me once.....! |
Politics / Re: Lamido Blasts Wike: The Emperor In Rivers Is A Bluff, Leave Him Alone by Understudy99: 1:57am On Aug 24, 2022 |
While it is understandable that Atiku's camp are probably tired of this lingering issue, almost 2 months after the primary--they probably expected everyone to have kissed the ring and fallen in line behind the candidate by now--they might want to be on the lookout for saboteurs. Lamido might just have his eyes on personal, rather than party's interest in this duel with Wike. Why would Atiku want to turn a potential ally into a certain foe in the run up to a general election. Atiku will is the only person with something to lose, should Wike be able to play a spoiler. One might argue that Atiku's last hope to be The President of the FRN is on line here, while Lamido has literarily nothing at stake. In fact, we could equally argue, that he would actually inch closer to his goal of one day becoming the president of Nigeria if Atiku were to lose again, possibly for the last time. 1 Like |
Politics / The Senate And Insecurity: Inanis Verborum Torrens, Contra Facta, Non Verba by Understudy99: 6:43pm On Jul 28, 2022 |
inanis verborum torrens We have all been reading of the latest impeachment threat to the president of the Federation by the Senate of late over the failure of the former to secure the lives and properties of Nigerians and failure to secure her sovereign borders from foreign invaders. While this is a welcome development on their part and a reawakening of some sort to their roles and responsibility, it nonetheless, amounts to an empty threat. This is simply because an impeachment of an elected official is always politicized and rightly so. Unless the president will be impeached solely by members of his own political party, any opposition championing the impeachment of the president over the security situation will be almost always have their motive questioned, and rightly so, by the citizenry. I mean the situation did not occur in an instant, security analyst across both private and governmental agencies have been predicting this for months, if not years now. Facta, non verba The senate in a show of true solidarity with their constituencies in denouncing the presidency's handling of the nation's security, should instead take actions that sends the same message, yet not politically divisive or viewed as politically motivated. One of such actions is going after the heads of the security agencies. This includes all service chiefs, IG, The Chairman of the police Service Commission, Ministers of Defense and even the minister of the Interior. While most of these cabinet level members serve at the pleasure of the president, they all needed to be confirmed by the Senate. Hence the Senate can recall, withdraw or vacate their confirmation based on performance. The next sets of appointees will have 60-90 days after taking office to solve the national insecurity issue or be equally recalled. In fact this should be the fate of every one of the service chiefs and heads of security agencies, until peace is restored in the land. This in my opinion will not only get the support of Senators from both sides of the isle, it will also be devoid of any politicization that will accompany any attempt to impeach the president of the federal republic. My Humble submission. 1 Like |
Politics / Re: Wike Warns Julius Berger After Paying 80% Upfront For Road Contracts (Video) by Understudy99: 5:58pm On Jul 27, 2022 |
As I have said before, I have no issue with Governor Wike, I wish more politicians had his sense of fairness and equity. That said, if you are in his inner circle or have access to people that are, they should please advise him not to just take people for their words. Legally binding contract is the only enforceable agreement there is. Most people who live and die by their words, assume others, especially prominent members of society, are equally the same. Any by the way, there's nothing woke about contracts and paying attention to the fine prints. Shikamaru1: |

My only issue is that his lawyers/state lawyers could have easily had JB exclude rain/rainy season from the list of acts of nature clause, if he so intended to hold them to the delivery by date guarantee. Corporations live and die by the terms of agreement, if you drop the ball on the terms of agreement, hope for the best. I hope JB can get these projects completed before the end of his tenure. He's not building it for himself after all, but for the people of his state. I just wished his people/lawyers had done the needful with the legalese. BTW, rain (weather) is consider an act of nature in the construction industry. AmazingELixir: |

I am not saying JB is incapable of delivering on guarantees; however, they are well capable of protecting themselves and their profits against acts of nature/Force Majeure. So unless, the Governor made them assume that risk by waiving that protection, empty talk on TV is not what is going to make JB deliver this project as scheduled, rather a cooperating weather, and JB being good at what they do. Hence, Governor Wike should spear us the narratives. AmazingELixir: |
Politics / Re: Wike Warns Julius Berger After Paying 80% Upfront For Road Contracts (Video) by Understudy99: 2:09pm On Jul 24, 2022 |
Only if it is explicitly stated in the contract, not verbal guarantees. All of those positives you mentioned, if not explicitly stated and agreed upon by JB, if JB didn't waive the act of nature clause protection--which I can tell you categorically right now, that they did not--simply invoking that clause, negates all of that pluses you just enumerated. JB is no magician, road constructions have seasonal aspects and variations to it. As it stands, if it's a major work, like every contract delayed due to seasons, it will be subject to reviews, variations and inflation--paying 80% upfront guarantees nothing. HE just got played by JB's contract lawyers. AmazingELixir: |

Can someone please inform this guy that everything is not abut talk. I bet if we review the contract he signed with JB now, you will see all kinds of "acts of nature/Force Majeure" clauses. What you will not find anywhere in the contract or addenda is JB waiving their rights under the aforementioned clauses and assuming those risks, in return for 80% upfront payment. Nigerian politicians getting played by JB with contract terms that a first year law student can see coming from kilometers away, and they will come and be disturbing our peace with useless talk. To all "His Excellencies" that will not let capable lawyers review contracts before rushing to sign it in the dead of nights, take this one: https://www.amazon.co.uk/Contract-Law-Dummies-Scott-Burnham/dp/1118092732/ref=asc_df_1118092732/?tag=googshopuk-21&linkCode=df0&hvadid=310843183616&hvpos=&hvnetw=g&hvrand=10734520217358572371&hvpone=&hvptwo=&hvqmt=&hvdev=c&hvdvcmdl=&hvlocint=&hvlocphy=1006886&hvtargid=pla-492152189504&psc=1&th=1&psc=1 |
