Hello Visa Officers and thank you very much for your dedication and time.
I married an American and had a daughter while living in the US. I entered the US legally on a B1/B2 visa back in 1994. I overstayed my visa at the time for more than 1 year (14 years to be exact) which I believes comes with a 10 year ban. We left the US in 2008. Now we have applied for my immigrant visa to move back to the US. After almost 2 years I have a consular interview on Tuesday September 29th. The question is; Does the Consular Visa Officer have any leeway in issuing the Immigrant visa regardless of my overstaying, considering that I never committed a crime, I have been married to a US citizen for over 15 years, I have a US born daughter (both wanting to come back to the US), and that I (we) left the US voluntarily over 7 years ago, or must the Consular Visa Officer apply the 10 year ban. If the latter, will I still be able to visit the US?

The Consular officer will certainly find that you are ineligible to enter the United States due to your considerable period of unlawful presence there. As long as you have no other ineligibilities, however, there is a waiver available, which the officer will tell you about at the time of the interview. There's no guarantee that your waiver application will be approved, but you're free to apply. If it's not approved, from what you've written, your ban will expire in 2018.

I sincerely doubt that you will ever qualify for a B1/B2 non-immigrant visa again, as you are clearly an intending immigrant who misused the last B1/B2 you were issued.

It's also worth mentioning that if your spouse is the petitioner and he or she now resides in Nigeria with you, there's no reason why you should be issued a visa. The purpose of immigrant visas is to reunite family members who are separated, and your family lives as a unit in Nigeria. Even with a waiver or after the ban has expired, the officer will likely not issue a visa if the petitioner does not reside in the United States. At the very least, you'll need to convince the officer that you all intend to return together -- but the officer may require evidence that the petitioner has established a residence in the U.S. before a visa can be issued.

Eek, don't worry! smiley Knowing that you've had your interview, my interpretation has changed! I'm guessing your case is just fine, but the officer hasn't physically clicked the Print Authorization button yet so there's nothing for the computer to update.

(Often officers don't click the button until they know that someone will sit down to print visas in the next few hours -- otherwise some computerized parts of the case expire and have to be re-done before the visa can be printed -- it's a technological thing, and has nothing to do with the merits of the case. So sometimes an officer will say "Your visa is approved" and write that in the case notes and all over the folder the paperwork's kept in, but because she hasn't clicked the button yet, the status remains unchanged.)

No, I don't know. I no longer work in Lagos. If the Government of Nigeria has declared a holiday today, the Embassy and Consulate will be closed, though.

No, no need to wait for anyone to contact you. Based solely on what you've written here, you should be able to pick up your visa at the collection center in five business days from the date the status changed to show "issued." There could be other factors involved of which I'm not aware, though. Good luck!

Ma'am, I have no way of knowing. If I told you I changed the visa category, I did. But I don't know what your case number is and even if I did, I have no way of checking. If the visa has been issued, the first thing you need to do is check the visa itself -- there's nothing at all that can be done until you do that.

I'm assuming that your visa category is F1? Right now F1s filed on or before Dec. 15, 2007, are eligible to be scheduled for interviews.

You can check the status of your petition by entering your receipt number at https://egov.uscis.gov/casestatus/landing.do . The receipt number is a unique 13-character identifier that USCIS provides for each application or petition it receives. The agency uses it to identify and track its cases. The receipt number consists of three letters-for example, EAC, WAC, LIN, SRC, NBC, MSC or IOE-and 10 numbers. You can find it on notices of action USCIS has sent you. Omit dashes ( "-" ) when entering a receipt number. However, you can include all other characters, including asterisks ( "*" ) , if they are listed on your notice as part of the receipt number.

By the way, at the bottom of that page, you can also make an inquiry about your case, change your address, and see an estimate of how long it takes USCIS to process cases like yours.

In a few weeks i will be resubmitting my application for a b2(non-immigrant) visa and am overwhelmed with anxiety. My question is, will the fact that i have a long term partner who is a US citizen hurt my chances even though he is planning on moving to the UK. I am planning on going to the US to spend the upcoming holidays with my boyfriend and his family for 90 days because i have to be back in time for work in the new year so i can get my apartment i have been saving for. Since applying the first time my situation has changed, i now have a stable job, looking for an apartment and looking after my mother who has recently had a stroke, so as you can see there are factors that are tying me to my country. I am 18 and have never had a criminal record or even affiliated with the police plus i have a letter from my boss saying that i will be going back to work at a certain date. I do have american relations but i hardly know them at all. I was refused last time because my ties to my country were not strong enough mainly because i was fresh out of college, unemployed and looking to go on a 6 month gap year to see my boyfriend who i have been with for 4 years with £700. I now have $1000 and am only looking to go for 90 days to go back to a job and my family as well as the fact i have been very careful with my documents. Would you say my chances are better than last time or does the fact i have an american boyfriend hurt my chances? Also what is the shortest amount of time a b2 visa can be picked up after being accepted, just asking as a rough estimate? thankyou

It's valid for the same amount of time as the medical paperwork, so at most six months.

If you're unsuccessful in getting NVC to respond, you can add the children when it's time for your interview. Just e-mail LagosIV@state.gov after NVC notifies you of the interview date, and let them know that you have children. Especially if the children were listed on the original petition, there won't be any problem.

If you e-mail LagosIV@state.gov before you've been notified of an interview date, Lagos will have no record of your case and will refer you to NVC, though.

Legal Permanent Residents cannot file for their siblings. Only U.S. citizens can do that.

Have you seen the visa yet? I'd wait until he's received the visa, and then, if it says CR1 instead of IR1, e-mail LagosIV@state.gov and ask them to reissue it in the correct visa category. There's no fee if the error is on our side. But if you asked me earlier to change the category and I replied that it was changed, it should be fine.

I have no way of checking to see if the visa category was changed to IR1. If you see that it says CR1, please ask them to reissue the visa in the correct category, or your husband's status will be conditional.

There are so many reasons why a case can be placed under administrative processing, that there's no way I can hazard a guess as to why your case now shows that status. Your best course of action is to e-mail LagosIV@state.gov and ask for an update. Good luck!

Oh, yes, this is a huge red flag. Not once but twice, under oath, you stated that you have a wife and child here in Nigeria. Now someone else is claiming to be your wife. At this point you've established that you're willing to say anything in order to get a visa, and that you're smart enough to tailor your story to the visa category you're applying for; the officer will certainly have serious doubts about your claimed relationship with the petitioner.

If you and the petitioner truly are husband and wife, and the child is your child, you will probably successfully obtain a visa in the end. But it will likely take quite a while longer than normal visa cases. The only thing you can do is to be completely honest about everything and hope that the investigation moves along quickly.

Thank You for your response. I just talked with the NVC yesterday and they were telling a different story. Now they say that my Birth Certificate and Marriage certificate translation is not as per the requirement of NVC where as My Birth certificate is being issued from Govt. Of Pakistan which is both in English and Urdu where as my marriage certificate was translated by a competent authority endorsed by the notary public. One more thing what do NVC means by certified copy isnt the color copy is considered as certified copy?
I'm not familiar with documents from Pakistan. That said, are you asking if a color photocopy of a document counts as a certified copy? In that case the answer is no; the photocopy isn't certified just because it's in color. You might try e-mailing the Embassy or Consulate in Pakistan and asking them for clarification -- they know better than I do. Good luck!

No, this is normal. It can take several months for NVC to schedule a completed case for its interview.

This usually applies to people who are there on student visas, L1s, H2Bs, etc., but not to people who have B1/B2s. For instance, if someone were in the U.S. on a student visa, and while she was there her F2B petition (filed by an LPR parent) became current, she could apply for adjustment of status.

On the other hand, entering the U.S. on a B1/B2 non-immigrant visa with the actual intent of adjusting status can lead to a permanent inadmissibility under INA 212(a)(6)(C)(i), material misrepresentation, if it's clear that the applicant lied to a U.S. government official at some point. There are some exceptions, but I'm not going to get into that here because obviously anyone reading this thread does want to immigrate to the U.S., so I'm not motivated to give anyone pointers for sneaking in on a B1/B2. smiley

People in the U.S. illegally (including those who have overstayed a B1/B2 or who are no longer in student status) are not eligible to adjust status while in the United States.

On September 14, 2015, we approved your Form I-130, Immigrant Petition for Relative, Fiance(E), or Orphan, Receipt Number SRC###########. We will mail your approval notice. Please follow the instructions in the notice
Your visa category is IR1 or CR1, right? If your petition is approved and the case is documentarily complete, it will be scheduled for the next available appointment! smiley (This could take a few months, though. Again, I don't know what Lagos's schedule looks like these days.)

I have written the District name instead of the City. Is this very serious mistake? How to correct it now as the Embassy interview has already been scheduled for first week of October 2015.

There are 13 cities in my district.
smiley Don't worry. This is not a very serious mistake. You or your wife can let the officer know at the interview -- but the officer probably won't even ask.
