In practical terms:
Yes, a politician may move to another party after withdrawing from a primary process, but only if the new party’s primary and INEC deadlines legally allow it. It is not an automatic ban under the Electoral Act.

If a person withdraws as an aspirant during/before the party primary election, the Electoral Act does not expressly ban that person from later joining another political party and contesting — but only if the new party lawfully nominates him through its own primary process and within INEC timelines. Section 84 deals with party primaries and nomination procedures.

If a person withdraws from his party’s primary election (or leaves before emergence as candidate), the law does not expressly say “you can never join another party.”

But under the 2026 Act, parties must submit their membership register to INEC before primaries, and only eligible members in that process can be voted for under party nomination rules. That means moving late to another party may make lawful nomination difficult or impossible depending on timing and compliance.

So the practical answer is:
Yes, a politician may withdraw and contest under another party only if he legally qualifies under that new party’s nomination process and INEC requirements.

Di Nigeria Democratic Congress (NDC) don clear 12 qualified presidential and governorship aspirants after completion of screening exercise conducted by di National Screening Committee led by Dr. Mu’azu Babangida.
