Section 39 of the 1999 Constitution grants every Nigerian citizen an unconditional right to freedom of expression while Section 40 grants freedom of association. Thus, Zakzaky and his members were well within their constitutional rights to hold a peaceful procession.


Ahlul Bayt News Agency - Lagos-based lawyer and human rights activist, Ebun-Olu Adegboruwa Esq, at the weekend, called for the immediate sack of the Chief of Army Staff, Major-General Tukur Butatai and his prosecution, over what he described as the cold blooded murder of members of the Shiite Muslims of the Islamic Movement group by the Nigerian military.

He stated that there is no justification for the cold blooded murder of members of the Shiite Muslims of the Zakzaky group by the Nigerian military.

“The excuses that we have been fed with so far is that the Islamic movement obstructed the convoy of the chief of army staff in a location in Zaria. What the chief of army staff was doing in Zaria at that particular time, we have not been told.

“Since coming into office in May, 2015, Major-General Muhammadu Buhari has instigated and received several procession of sycophants in his office in Aso Rock, in the usual fashion of chorus singing and solidarity visits and nobody has ever disturbed them.

“The relevant law applicable in the Zaria region is the Penal Code and if any member of the Zakzaky followers has breached any portion of that law, he or she should be dealt with according to law, not to be treated as animals or captured slaves, or be subjected to martial law. In this regard, it is totally barbaric and illegal, for the chief of army staff, to mobilise soldiers to invade a civilian territory, kill citizens at will, as if they are animals and then proceed to demolish their houses.

“In many of the photographs and videos circulating in the social media, Zakzaky himself was shown as having been shot and wounded and then conveyed in a wheel barrow, by soldiers, thoroughly dehumanised and traumatised, as if he was captured in the course of a war. This is totally unacceptable,” he stated.

Below is a copy of a release distributed by the members of the academic forum of the Islamic movement in Nigeria in Kogi state after having a peaceful protest over the Zaria massacre and the illegal detention of the leader of the Islamic movement in Nigeria Sheikh Ibraheem Zakzaky (H).

ZARIA MASSACRE: A CONSPIRACY OF UNRULY & VIOLENCE

No matter the level of corruption, poverty and penury in the society, Human society can never be without intelligent, positive, viable and free minded individuals who strive themselves to get raid of enslavement and create a vacuum where freedom to belief is Right, Right to life is Right and protection to properties is Right.

On the 12th December, 2015, there was a great Massacre launched on the Islamic Movement in Nigeria with the Conspiracy of Shi’ite – Army clash where over 2000 members of the movement were brutally killed including children, young and old, men and women while the Leader of the Movement Sheikh Ibraheem Zakzaky and more than 1000 members were still under illegal Military detention.

To cover the atrocities committed and justify the Evil and Inhuman act, mass burial was carried out on the numerous members killed by the Nigerian Army and some videos clip were edited and distributed to convince the public that they were peaceful while the members of the movement were violent and unruly.

On the 25th July, 2014, Nigerian Army on the same mission to kill, attacked a peaceful procession in Zaria to mark the International Quds Day which is observed annually by many people (Muslims, Christians, Jews and others) all the world in solidarity with the oppressed people of Palestine. That dastardly attack resulted in the murder of 34 people including 3 sons of the leader of Islamic Movement in Nigeria, Sheikh Ibraheem Zakzaky (H). Over a hundred others were severely injured.

There is no doubt; the present Massacre in Zaria is a well Evil planned act by the Enemies of Humanity before the Execution over the last weekend. No wonder! No legal trial of any kind was made before killings, bombing and demolition started after the alleged attack on the convoy of the Chief of Army staff.

The Hussainiyya Baqiyyatullah (centre) was bombed and demolished, Dahrul Rahman, where the Martyrs of the Movement were buried was destroyed by the Army and they proceeded to Gyllesu, the Residence of the Leader of the Movement and started shooting sporadically and killed people, bombed and demolished houses.

In general, many Nigerians were fed with blatant lies on Zaria Massacre but those individuals who possessed the aforementioned qualities will still analyzed and understand the tragedy without bias. If truly the Chief of Army staff escaped assassination as earlier claimed, were the assassins arrested and confessed that they were sent by the Leader of the Movement? They later claimed that the Road was blocked depriving them of passage, No member has ever blocked Road intentionally to deprive people’s passage but we are human beings and lives need to be protected and as such some members have to control traffic especially when there is program and that has been on without dispute for many years now.

Any Rational individual can think of this! If the Islamic Movement must have been known for violence, why would the Massacre in Zaria and illegal detention of the leader of the Movement attracted the world? There are Rallies and peaceful Protests in many countries such as India, Iran, China, UK, Pakistan, Ghana, Lebanon, Iraq, Palestine, Nigeria, etc with Strong and Common voice free “Sheikh Ibraheem Zakzaky”.

The Islamic Movement of Sheikh Ibraheem Zakzaky Yesterday is the same Islamic Movement Today and will still be the same Movement Tomorrow Allah’s willing. We Demands for Urgent and Unconditional Release of Sheikh Ibraheem Zakzaky.

IHRC has received further credible data and testimonies indicating that the Nigerian army has buried bodies in mass graves. IHRC calls on the African Union, the United Nations and the Commonwealth to suspend Nigerian membership and privileges, and to take imediate action to secure the release of all those detained.

You are doubtless aware of the killing of at least one thousand unarmed civilians in Zaria, Nigeria since the weekend. In the aftermath of these killings numerous people are missing, others are illegally detained either by the army or police.

At least one detainee has given birth whilst in custody, another has died having been shot and then denied medical attention. Many others are injured and it is unclear as to whether they are getting proper medical attention.

I urge your office to send a delegation to Nigeria immediately to demand access to all the prisoners including the leader of the Islamic Movement, Mu’allim Ibraheem el-Zakzaky who is both injured and detained. Your office must demand the immediate release of all those held. In the meantime your office must suspend Nigerian membership of your organisation as well as any privileges it may have.

One week after the deadly carnage in Zaria, Kaduna State, involving the Nigerian Army and members of the Shi’ite Community, President Muhammadu Buhari remains silent. For a President whose preferred method of public communication has been widely described as “body language”, the message telegraphed by his silence is less than eloquent, unsettling and disquieting.

The exact sequence of events leading to the encounter between the Shi’ites and the Army will, hopefully, be unraveled by the judicial commission of inquiry to be established by the government of Kaduna State. Some things are already quite clear however.

Many people were killed in the encounter. Some have described it as a “massacre”. The victims included young children and women. The leader of the Shi’ites, Sheikh El-Zakzaky, has not been seen since then. The army initially said it took him into “protective custody”. At best, this is not a lawful procedure under Nigerian law. Subsequently, the army claimed it handed him over to civil authorities for prosecution for as yet undisclosed crimes. The army is not a prosecutorial authority for civilians. So on what basis are they deciding that he should be prosecuted?

Rather unfortunately, and quite oddly, in a presumed secular state, the Shiite movement, like many islamic and christian religious organisations, appears to have its own long-term history of breaking the law, and of impunity, that had not been called to order by previous administrations, especially by holding processions or taking over and blocking major roads with utmost disregard for other road users.

Yet the reaction of many, including Nigeria’s bilateral and multi-lateral partners has coalesced around the view that the conduct of the military in response was both brutal and disproportionate. From within Nigeria, many people and institutions, including the Supreme Council for Islamic Affairs (NSCIA), as well as the Christian Association of Nigeria have called for an independent investigation.

Even more, Hakeem Baba-Ahmed, a former Permanent Secretary for the Interior and Joint Intelligence in Nigeria’s federal government, himself from Zaria, has regretted the fact that the “military does not appreciate the fact that it handed over to the Shi’ites a victory it will exploit to the detriment of national security”.

Amidst this rising crescendo of condemnation and concern, and whilst considering the fact that President Buhari must be awaiting a report of what transpired leading to the massacre, his studied silence appears quite disturbing. He ordinarily ought not to foreclose the need for showing concern by talking to Nigerians about the ill-fated incident.

And, in line with democratic governance, it behoves the President to constantly engage with the public on matters of national interest. Yet, since the incident, the only response from the Presidency has come from a text message reportedly sent by an official spokesperson of the President, Femi Adesina, to a newspaper in which he described what happened as a “military affair”, whatever that means.

The president’s silence is disconcerting for many reasons. First, the Zaria Massacre is the latest in a long and gruesome list of military operations since 1961 that have ended in civilian bloodbath. It occurred in the same weekend that the President went to Kaduna State, first, for a music festival and, then, to accept an honorary doctorate degree from the Kaduna State University, a curiously dubious conferment from a university that does not itself run any doctorate programme. That the lethal sequence that followed is associated with the presence of the President in the state should surely be of concern to him.

Second, President Buhari is not just anybody. He is a two-time Commander-In-Chief, a retired army General and one of the most respected and decorated officers in the history of the Nigerian Army. As a General, what happened in Zaria must be of interest to him. As Commander-In-Chief, he has command responsibility for what the military did. This is not a mere military affair. It is his affair. By keeping quiet, he reinforces the impression that he explicitly instructed the military operation in Zaria or implicitly condoned its manner and outcomes. If this is not the case, then he should say so.

Third, there is disturbing evidence in his silence that far from learning from the mistakes of his predecessor, President Buhari appears willing to repeat the errors that turned Nigerians against the administration of President Goodluck Jonathan. It bears recalling that President Buhari rode to the Presidency on the crest of public revolt against the way his predecessor showed scant regard for the lives and sufferings of Nigerians in the hands of Boko Haram extremists. To this attitude, President Buhari promised change. He did not promise being mute. Rather than offer change on this occasion, he has chosen to go mute.

Fourth, President Buhari’s answer to allegations of Shi’ite lawlessness cannot be an outlaw army. His silence could encourage open-ended military operations against unarmed civilians. The state can contain citizen lawlessness, but state lawlessness invites anarchy.

Above all, as the only officer under our constitution elected – no less – by Nigerians from every state and the Federal Capital Territory, President Buhari swore to protect Nigeria’s constitution and the values that underpin it, including the obligation to run a humane government, respect human life and guarantee due process. When citizens are killed in encounters with the armed forces, the responsibility of government is engaged. The people who died are Nigerians. A humane government must show that it cares. By remaining silent, the President appears inhumane and encourages the impression that he neither cares about human life nor about his oath of office.

It is already late but there is still time for the President to correct the course of happenings. The President who promised change cannot keep quiet when soldiers under his command leave scores, perhaps indeed, hundreds of killed civilian citizens in their wake. He needs to speak to Nigerians and the world urgently and reassure everyone about his commitment to the values of constitutional government.

The whereabouts of the leader of the Shi’ite community, Ibrahim El-Zakzaky, must be disclosed. He should be released from custody forthwith or charged before a court for crimes known to the law. Contrary to their claim, the Nigerian constitution has no place for the military to hold a citizen in “protective custody.” Any persons, civilian or military, implicated in the incident in Zaria, should be held to account resolutely.

While PREMIUM TIMES acknowledges the right, as indeed salutes, the Kaduna State government on its initiative to set up a judicial commission of inquiry into the incident which occurred within its state borders, as announced by Governor Nasir El-Rufai, still we need to be aware that the scale of the problem is national, and the army, as one of the parties involved, is a national institution.

Hence President Buhari, as Commander-In-Chief of the Armed Forces needs to get proactive in the national engagement with what transpired and in achieving justice for those unjustly violated and murdered. If he fails to do this urgently and resolutely, his promise of change could begin to ring hollow.

Some stakeholders have asked the Federal Government to constitute a panel to investigate July 25, 2014 violence in Zaria, Kaduna State, in which 35 people, including the three sons of the leader of the Islamic Movement of Nigeria, Sheikh Ibrahim El-Zakzaky, were allegedly killed by soldiers.

The stakeholders said that the army should not be allowed to investigate the incident because it could not be an umpire in a case in which it is involved.

They particularly asked the government to check arbitrary killing of innocent citizens by security personnel.

The stakeholders spoke following claims by El-Zakzaky that the Federal Government had yet to sympathise with him over his sons’ killing.

The sect leader, who alleged that his three undergraduate sons were specifically targeted by soldiers, denied that the group confronted the troops before the killing.

El-Zakzaky said he was angry over the incident, but vowed to remain peaceful.

The army, speaking through its spokesperson, Maj.-Gen. Chris Olukolade, said the military would investigate the issue, adding that soldiers do not take delight in killing innocent people.

Describing the killing as painful, the Secretary General of the Nigeria Supreme Council for Islamic Affairs, Prof. Ishaq Oloyede, particularly said that El-Zakzaky would stand by his statement.

Oloyede, who spoke during the week with Saturday PUNCH on the telephone, said he was on his way to condole with the Sheikh.

He said, “El-Zakzaky is an upright Muslim; he must act according to the Islamic tenet. Accepting to seek redress through peaceful means is a painful thing to do.

“I personally share his pain; I have known him for 40 years and I am sure he means what he said. The Nigeria Supreme Council for Islamic Affairs will want the Federal Government to set up a commission of inquiry to probe the killing. It is not enough for the army to claim that it will investigate the matter because the army cannot be an umpire in a case that involves it.

The governor of old Kaduna State, Alhaji Balarabe Musa, said El-Zakzaky’s anger was justified, but his decision to tow the path of peace to seek redress was commendable.

Musa said the killing had serious implication for the nation’s leaders, both political and religious.

The Christian Association of Nigeria also aligned with other stakeholders, saying the government ought to have sympathised with the bereaved Sheikh.

CAN Chairman in Osun State, Revd Elisha Ogundiya, said, “Losing three children to killing could be painful; it is not always easy to lose one’s children. Government, whether local, state or federal should have shown concern to appease the bereaved.”

ZakzakyOn Friday the 1st of Aug., 2014 More people troop to the resident of Shekh Zakzaky for condolence and prayers for the souls of the martrys. Crew from LibertyRadio Kaduna was among the groups who paid sympathy visit too.

The 7th day prayer was attended by thousands of Muslims from far and near. There were recitation of holy Qur'an, the supplication of Kumyal, Ziyarats as well as matam on the Karbala tragedy.

The Leader of the Islamic Movement said whatever calamity befells a believer should remember the calamity of Karbala as it was the highest form of calamity in the history of humanity adding that the calamity is very minute compared with the calamity of Abi Abdullahil Husain(Alaihis salam).

Among those who paid condolence visit include Sheikh Nur Das, Sheikh Saleh Zariya and Sheikh Bashir Lawal.

Quds Day shootings: How the military targeted my sons

After the Eid prayer at the Hussainiyyah Baqiyyatullah Zaria, Leader of the Islamic Movement in Nigeria Sheikh Ibraheem Zakzaky further narrated the indiscriminate shootings of peaceful protesters during the Quds Day procession in Zaria, and how the military targeted his sons.

He was speaking on the backdrop of the current wave of killings in northern Nigeria, saying that the Quds Day shooting clearly indicated where the orders are coming from. “There is nothing like a religious group taking up arms in Nigeria as they are trying to make us believe. On our own part, they came in broad dalight in their military uniforms, fully armed with military inscriptions on their vehicles and committed arson and murder. From this you will understand those killing innocent citizens either in Birnin Gwari forest or Zamfara and other places.”

Sheikh Zakzaky said, it is unbelievable that sporadic killings were going with a democratically elected government assuming ignorant of the issue and lacks control. “There is nothing like Boko Haram killing people, we cannot be fooled. Those in authority are the sole authors of the atrocities”, he added.

Commenting on how his sons were targeted, Sheikh Zakzaky made the following statement: “As they targeted my sons for arrest, in the process killed one, Mahmoud, whom they shot in the abdomen and he died. They also arrested three others, Ahmad, Hamid and Ali. Through a link we demanded them to release them to us, but the Commandant of the Basawa military barrack said he would not release them but rather will take them to ABU Teaching Hospital, Shika for medication. They were in good condition when they were arrested. As they were boarding them into the vehicle, he shot Ahmad three times and threw him into the vehicle. He was alive and talking then, they broke his arms and legs. They started beating Ali, while Hamid was trying to protect him, they turned to Hamid and stabbed him several times with knives, even on his head. Ahmad was already dead, but Hamid was still telling them words and they shot Ali on his legs. When they realized that Hamid was still talking, they continued stabbing him with knife until they made sure he was dead before they reached the hospital. The name of the person who shot them was Brigadier General S. Okuh, he is the C.O. Engineer of Bassawa. When i demanded for the release of my sons through the GOC 1 Mechanized Division, Okuh said he would release them but not alive. By Allah’s infinite mercy, Ali is alive, he saw how his brothers were brutally murdered before his eyes. He is presently receiving medical attention, as a result of compound fracture on his leg, from the several shooting on his leg.

When this happened, people really sympathized with me without the usual display of diffrence instilled in them. This is another calamity they brought among the Muslims. They created groups fighting one another on the basis of sect, but with this nasty event the idea was eradicted completely. We received several condolences from the government circle and even past leader.

People should look outwards for their enemy, not from within. They should know We have a common enemy, emerging in different colours and shapes, sometimes in a religious aspect. They could not find the people to do this for them here, so they decided to do it themselves. As we witness this, we should all come back to our senses and revert to Allah and break the imaginary barriers among us as Muslims. We should know that all Muslims are brothers. Yes, we have differences, but it is not a difference of belief and disbelief, but rather minor difference among Muslims themseleves. You should then weigh, who is really your brother and enemy, between an outsider who sees you as enemy and a brother with minor difference in your fold? When you are fighting an insider, you do not need the intervention of an outsider. The enemy has now resorted to doing damage on us, then blame it on us.

We pray that Allah deliver us from this degradation we found ourselves in Nigeria, who boast of having the highest population of Muslims. We are in a situation where Islam and Muslims are identified as the enemy of the state and a threat to the society, and the Muslims helplessly accepted the situation for a token or leadership.

Sheikh Zakzaky: Nigerian Security Killed Sheikh Albani

Sheikh Ibraheem Zakzaky in his weekly lecture on Nahjul Balagah, on Monday, categorically revealed that Nigerian security operatives killed Muhammad Awwal Albani Zaria to actualize a selfish agenda.

According to him, followers of Albani are all aware of the killers but could not speak out for fear. “Without any fear from anyone, we say the government killed Albani Zaria”.

The Leader equally said, the government wanted to creat discord among Muslims with the death of Sheikh Albani, by stockpiling weapons into Gyellesu area and used it as evidence to implicate the Islamic Movement in the killing of the Zaria based scholar. He said the security presence in Gyellesu area exactly a week after the assassination was a clear sign of unintelligence which shows to the whole world the foolishness of the security. “What brought them? Who are they protecting? Why Gyellesu? Obviously, they were there with a mission to kill as they did exactly a week after. Their foolishness was so obvious”.

He said, he was aware of all the sinister plans and attempts of the government to shoot him whenever he goes or come back from lectures at the Hussainiyyah Baqiyyatullah, in Zaria. “Many of their plans we do not expose, but let it passed, for it only stops at the planning stage, execution was impossible for them”, he explained.

Responding to the alleged complicity of the Islamic Movement in Nigeria over the killing of Albani as alleged in some quota, Sheikh Zakzaky reminded the people of deeply rooted long tradition of the Shi’ites of following the guidance of learner scholars, who must be an Ayatollah, who gives permission to carry out capital punishments and Jihad. He said Shi’ites are so organized that it becomes impossible for enemies to infiltrate or create terror cells among them, just they are doing with other Islamic groups who lack guardianship of the jurists.

He recalled that, members of the Islamic Movement in Nigeria have suffered untold hardship, intimidation, imprisonment and deaths by government security agencies, and yet they have never retaliated or took the laws in their hands in the form of vengeance.
He said the Movement had no issue of dispute or discord with Albani, and that if killers of the Shi’ites are still walking freely, why should the Shi’ites kill someone who had not done anything to them?

He reminded the Nigerian security that, the power of the gun is not all that it is. “We have that which is more powerful and sophisticated than the gun- Allah the Almighty Allah; the true teaching and practice of the Holy Prophet (s) and his Pure Progeny (A’imma). This is the religion of truth, let anyone who disputes bring forth which is more truthful than this”.

The leader of Nigeria’s Shiites Sheikh Ibraheem Zakzaky of the Islamic Movement of Nigeria, whose three sons were killed yesterday Nigerian troops in Zaria said the Shiites were armless and never armed themselves in their history.

Zakzaky said in a brief telephone interview: “We were armless during our procession, and they shot us after we ended our procession, the whole world knew our history, we have never armed ourselves. We are waiting for the lies that they will tell.

“We were just helpless while the soldiers shot us with impunity; we have children, women and even the aged in our procession. We had this procession in many parts of the country, and nothing happened and for almost 40 years we have been doing this.

“They shot our brothers and sisters; my son Mahmud, who came from a university in Beirut, was shot on his stomach and died on the way to the hospital. They came back and arrested three of my sons alive and killed two while in their custody. How did they arrest my children without resistance? Our submission to the Nigerian authority is not in doubt hence they took them away. And so what lies are they telling?

“They took Ahmad, Hameed and Ali with them; Ahmad and Hameed are chemical and neurotics engineering students in China. It was my fourth son there, Ali, who had a gun wound that confirmed that the soldiers have killed his two brothers, and they were all arrested alive.”

He also said that, the action of the soldiers was premeditated and clearly clearly extra-judicial killing: “If you are accusing someone of committing an offense, you must carry out prosecution according to the law of the land, but why kill people with impunity? Even if you say we have breached the law, then you must look for the leader and try him in an open court. What have we done?

“My appeals to all our brothers and sisters to be calm and I will soon address the press and you will receive our stand, thank you and wish you the best in New York.”
