AS a journalist, politicians have, over the years, regaled me with narratives of superlative ideas about governance. They always paint beautiful pictures of what they want to transform the society into if they are voted into power. Unfortunately, none of my interview subjects, who ended up in public office, was or has been able to walk his or her talk. The narratives constantly change from things they would do to those things that made it impossible for them to do the things they promised to do. They are wont to rationalise failure to live up to the governance ideas they so much espoused before stepping in the saddle of leadership. To be sure, nothing is new in the different ideas that are canvassed and romanticised in or outside government. Most times, the ideas are essentially the same; whereas, lack of integrity is the problem that bedevils governance in our nation. Integrity has the capacity to redefine officialdom’s work ethos and guarantee transparency and accountability in the management of public finance. Saturday (Saturday, Feb 4), the media offered the nation a space of relief when it carried the expected news of a mutual accommodation reached by the organizers of the demonstration planned for tomorrow Monday February 6th. The theme in summary: public discontent with the state of the nation and its governance. From the beginning, the organizers had cited quite an extensive list of such areas of concern and demands for urgent attention. To my personal consternation, today’s (Sunday) the same media countered that announcement with a stiff repudiation from the apex of the Police command – the office of the Inspector-General. It is such a huge disappointment, and a disservice to the cause of democracy, tolerance of dissent, and principle of inclusive governance. An unnecessary but important reminder: the battle for the right of lawful assembly of citizens in any cause, conducted peacefully, has been fought and won several times over. It is time that this contest is gracefully conceded. It must be consolidated by its routineness as a choice of action at the front of any people’s democratic participation. This battle has been won legally, constitutionally, and even morally. It enjoys near global acceptance as one of the means of actualizing the protocols of a people’s Fundamental Human Rights. Speaking with newsmen ahead of the release of his second book, ‘Demand by Terror’, Mumuni said the ex-NSA’s role in sharing funds meant for the procurement of ammunition for the Nigerian military empowered the dreaded Boko Haram militants to kill thousands of Nigerians and destroy property worth billions of naira. ‘Demand by Terror’ is the sequel to ‘Global Terrorism and its Effects on Humanity’ by the same author, and would be launched in the United States of America in September to commemorate the 9/11 attacks on the World Trade Centre Twin Towers by terrorists fifteen years ago. According to the author, While Boko Haram embarked on the brutal and indiscriminate killing of the Nigerian citizens, the Jonathan administration, through the ex-NSA, was busy sharing money meant for the purchase of arms for our military. At the time Boko Haram was taking over cities in the Northeast, the military was helpless; not that they couldn’t fight but they were using substandard weapons. Money laundering is a crime, but this is a greater criminal offence because under their nose, they allowed Boko Haram to thrive. They aided terrorists by stealing money meant for arms to fight the same terrorists that have wrecked havoc in Nigeria and other neighbouring African countries. “Once they are done with the money laundering charges, Dasuki should be charged. Jonathan too should be tried becuase he knew how the money was distributed. All other beneficiaries involved should also be charged for war crimes. They would have curtailed the activities of the group if they had done what President Buhari is doing now,”he noted. The 2011 Lagos State governorship candidate of the defunct Congress for Progressive Change (CPC) commended President Buhari for his anti-corruption campaign, which led to the discovery of the massively looted cash embezzled by the last administration. He said;“President Buhari should be commended for his anti-corruption campaign. I have known him for close to 2 decades. We were together during our days in the defunct All Progressives Party (APP). When he founded the now defunct Congress for Progressive Change (CPC), we were together. I know him very well. He’ll never disappoint Nigerians. All we need to do is support, encourage and pray for him. Mumuni however cautioned the Nigerian military not to rejoice in the fight against Boko Haram, stressing that it is not over, until it’s finally over. According to him,“No doubt, FG is winning the war against Boko Haram insurgents, but it’s not time for celebration because the sect members are now widespread, recuperating somewhere; and they can strike whenever they want to. That’s why the military should continue their search for them, especially within our land borders. “Remember the Maitatsine crisis in the 80s? They metamorphosed into what we know today as Boko Haram with the help of cross-border terrorists. They are not Nigerians. Most of them are not even practising Muslims. They are cross-border terrorists. That’s why we need to strengthen the security in our borders. I was not surprised when I read that some Boko Haram members were apprehended in a church in Lagos. If we fail to tighten the security of our land borders, many of them will still find their way in and continue their nefarous atrocities.” Sambo Dasuki Comparing the Niger Delta Avengers (NDA) to Boko Haram, Mumuni, a chieftain of the All Progressives Congress (APC) stated that the former is not a terrorist group, but are fighting for their rights in violent ways. He said;“The NDA are not terrorists. They are fighting for their rights and if you’ve been to their regions, you’ll feel for them. However, they are going about it in a wrong way. Their modus operandi is totally unacceptable. It falls under terror, even though their reasons are justifiable. They should have dialogued with the government instead of going violent. “This is an act of terrorism and Nigeria is too big for a small group to hold government into ransom. They can’t fight government and win despite their access to ammunition. If government descends heavily on them, they’ll pay dearly for it, and it might even lead to war crimes. “They have forgotten that their state governments collect derivation funds and other allocations from the Federal Government. They should hold their governments responsible for the poor level of development in the their region, because some people are directly benefiting from such. They should dialogue with the government. Violence begets violence. The President Buhari I know is a listening president,”he stated. He said:“It’s a global phenomenon. Terrorism has been existing before we started experiencing it in Africa. The qualifier is not an English word; it originated from French. Like I said in my books, terrorism has different faces, from State Terrorism to Religious Terrorism to Cyber Terrorism, among others. Terrorism will not fade out overnight, as they will always attack soft targets to achieve their goals. “But its risks could be reduced through enlightenment and providing means of livelihood for the people. When you fail to provide for them, they indulge in criminal activities. They become instruments for the devil. In fact, some of these people receive stolen goods from these terrorists. They help them keep their guns. Once they provide them food, they keep mum. The terrorists have informants among them. Most of the villagers are benefitting from the terrorists because of the level of poverty in the country. Government needs to provide for them before embarking on literacy programmes.”

Kerosene, which is commonly accessible to rural and urban women in Nigeria, is going beyond the reach of the common man, thereby increasing inflationary trends in the country. Most families in Aba, the commercial hub of Abia State, have resorted to the use charcoal for cooking, an alternative to kerosene, which they said is now beyond the reach of the common man. The price of the product, which dropped minimally to N97 per litre, few months ago in most filling stations, has gone up again to N220 per litre, a development residents observed, portends serious danger for the people, as it would promote product adulteration. They noted that the same situation in 2015, resulted to fire outbreaks, leading to loss of lives and property. Rosemary Onwuka, a single lady, who lives with her elder brother at Ogbor Hill area of the city, decried the development and described it as unfortunate. According to her, kerosene now takes a large piece of our house upkeep and urged the Federal Government to address the situation fast. “In the past, I could use N150 to purchase three litres of kerosene and still have some money left for other things, but that has changed, as I now spend money meant for other things for kerosene,” she said. Oge Ezeugo, told BDSUNDAY that she now uses firewood or charcoal as she could no longer afford kerosene with her meager salary. In her words, “I have so many needs contending for my salary and so, I would not expend it only on one item.” She urged the Federal Government to ensure that the product is available at the official price of N50. Ezeugo is not alone in this; so many other residents have since started using firewood for cooking. Happiness Uzoechi, an IT instructor, affirmed that she had since changed to firewood for her cooking. |

The association advised federal government to take seriously the threat by Avengers that oil workers should vacate oil fields and terminals. Francis Olabode Johnson, its president stated this at the third Women in PENGASSAN National Conference in Abuja. But we also want to implore government that a situation that we have agencies and oil companies behaving as if they are more powerful than the government is not acceptable to the union. Everybody in the union is all Nigerians. “You cannot have an agreement with the minister, standing in for the President of the Federal Republic, and when it’s time to take action, you say no. We only suspended our strike, if these issues are not addressed properly, we may have to resume the strike. OPC hands Niger Delta militants 14-day ultimatum. – OPC has handed Niger Delta militants a very severe warning – The pan-Yoruba organization issued a 14-day ultimatum to militants – OPC issued the warning in reaction to recent attacks The reformed Oodua Peoples Congress (OPC) has issued a 14-day ultimatum to suspected Niger Delta militants. Niger Delta militants have been advised to stop attacking communities in the Southwest. OPC warned the militants to desist from attacking communities in the South West, else the Ijaw people in the region would gear up for reprisal attacks. The pan-Yoruba organization issued the threat while reacting to recent attacks by suspected militants on Imusin and Ogijo in Ogun and some riverine communities in Ikorodu area of Lagos state. Daily Post reports the group in a statement by Comrade Dare Adesope entitled,‘‘Incursion of Ijaw militants into Yoruba land: Enough is enough,’’threatened reprisal attack if the suspected Ijaw militants failed to end the incursion into the South-West at the end of the ultimatum. According to the group, the attack in the South-West was an affront on the Yoruba nation and it would not be accepted. The statement reads in part:“Enough of these invasions, killings and kidnapping of our people right on our own soil. We of the Oodua Peoples Congress (Reformed) have waited for this long, hoping that the government would curb the deadly acts of the Ijaw people on our kinsmen in their fatherland in Ogun and Lagos states. But, it has now dawned on us that the lives and properties of our people and, indeed, the masses are of no importance to those in authorities and the marauding militants. Before now, it was the Fulani herdsmen, now it is the Ijaw people that are on the prowl. Enough is enough “Consequently, we are giving the Ijaw militants a 14-day ultimatum to allow peace to reign in our land. If they fail to heed the warning, it will henceforth be an eye for an eye and a tooth for a tooth. We will prove to them that Lagos belongs to the Yoruba and not a no man’s land that they tend to erroneously claim. “If they must care to know, we have information and facts about where their leaders’ properties are situated in the entire South-West and where their people reside in our midst as well.” Meanwhile, the national coordinator of the Oodua People’s Congress (OPC), Gani Adams, says his organisation has been reluctant to engage suspected militants and pipeline vandals who have been terrorising some communities in Lagos and Ogun states because they have been demonized by people. According to The Punch, Gani Adams, speaking during a press conference on Thursday, July 7, in Lagos condemned the recent spate of attacks by suspected militants and pipeline vandals in South-West Nigeria. The OPC leader who described the attacks as criminal said though some affected communities have been seeking the support of the OPC on the issue, he had to be sure that its members would not be criminalised for any actions taken. He accused the people, including those of Yoruba descent, security agents and the media of demonizing OPCin the past.

The Nigerian Navy (NN) said it had arrested a suspected member of the Niger Delta Avengers. This is contained in a statement signed by its Director of Information, Commodore Christian Ezekobe, and made available to newsmen in Abuja. According to Ezekobe, the suspect who was picked up on July 11 at about 11 a.m., is believed to be a major logistics supplier to the group which had claimed responsibility for attacks on NNPC and Chevron pipelines in the region. “The arrest was made following a confessional statement obtained from an earlier arrested suspect who gave details of the involvement of other collaborators in the attacks. “Preliminary investigations also revealed that the suspect recently supplied 10 batteries, five large coils of wire and other materials purportedly used for the attacks,’’ the director said. The NN said it would continue to partner with sister security agencies and members of the public to eliminate all forms of economic sabotage such as vandalisation of pipelines and piracy.

Buhari’s approval rating for June has plummeted to 39% from the 48% he received in May, This Day reports. It indicates the lowest approval rating started 13 months ago. The president’s rating was highest in October, peaking at 80%. “This latest score represents a 9-point decline when compared to the rating in May which stood at 48%,the investigators said. In February, President Buhari’s rating, according to the poll, stood at 57%. The economic analyst told journalists that there is no doubt that the economy is currently facing a lot of crises. The report also disclosed a decline in the approval of the country’s leader across 5 geopolitical zones, when compared to the month of May. “The North-east, zone with 59%. On the other hand the South-east and South-south zones had the least approval rating of 8% and 24% respectively,” it added. A national survey by the Centre for Democracy and Development entitled the Buharimeter Report, had said:“We can also infer that there are still gaps between campaign promises, public expectations, government policies and actions. These need to be aligned properly going forward.”

We need to show that we believe in this country by patronising things produced here. “We are just using our resources to develop auto industries of other countries and abandoning ours. Yet, we are quick to complain that the naira is losing value everyday. Naira crashes to N368/$1 at parallel market Nigeria’s currency, Naira crashed to its lowest level at parallel market since the start of the new foreign exchange regime, on Wednesday, July 20. The naira’s black market value which had stayed unchanged for two days at N365/$1, dropped 3 points to trade at N368/$1 in the early hours of today. Currency traders blamed the poor performance of the naira to the scarcity of the greenback, adding that the demand for dollar far outstripped its supply. According to a Bureau De Change operator in Lagos, the naira instability at the parallel market this week could be traced to the activities of the CBN. The BDCs can be empowered by giving us access to the CBN window.” The local currency has been on the downward swing following a plunge in crude oil prices and a consequent decline in Nigeria’s foreign reserves. Disappointment was written all over the faces of Nimbo residents over the weekend as their hope of playing host to fiery Enugu priest, Rev. Fr. Ejike Mbaka was dashed. As early as 7 am, anxious residents had lined up gallons of water to be blessed by the charismatic priest in charge of the Adoration Ministry, Enugu. It could be re-called that suspected Fulani herdsmen launched a serious attack on Nimbo community, Uzo-Uwani Council Area of Enugu State in April, killing scores and wounding several others. Residents of the community, who expressed sadness over Fr. Mbaka’s inability to visit the community as promised, said it was owing to security concerns. A community source disclosed that Mbaka’s decision followed fresh herdsmen attack on Uzo-Uwani community within last week. It was gathered that a woman, who had gone to her farm to harvest grain and vegetable, received matched cuts from the herdsmen. The victims, simply identified as Mrs Ogbobe Monica (popularly known as Mama Ejima) was said to have gone to the farm alone when she was accosted by a herdsman, who ordered made attempt to rape her. Why Nigeria MUST NOT let the Igbos leave this union I have tried to measure the contribution of the Igbos to the development of the Nigerian project and the conclusion I have reached is that Nigeria must do everything possible to get the Igbos to remain in the Nigerian union. They (Igbos) have contributed unprecedentedly to the development of Nigeria in EVERY sector. The Igbos are an exceptional Nigerian race; they are born entrepreneurs, geniuses, capitalists, industrialists, academics, adventurists and you name it. A Nigeria without these set of people and their drive for economic success might be boring and uninteresting. Industrial Spirit: The Igbos are probably the only tribe that has built several indigenous industrial estates in Nigeria. In 1997, an Igbo engineer by the name Ezekiel Izuogu produced Nigeria’s first indigenous prototype car in Imo State. Africa was excited by his ingenuity. However, due to financial constraint and dirty Nigerian politics, the Izuogu Z-600 car model could not hit the Nigerian market in mass produce. His workshop was later vandalized and his efforts destroyed. The dream died. Few decades later another Igbo by the name Innocent Chukwuma launched his Innoson cars, making him the first indigenous car producer in and from Nigeria. Anambra and Enugu alone has over six indigenous estates. By indigenous I mean industrial estates built by indigenes and with little or no government support. Nigeria’s first indigenous car is made in one of those estates- Nnewi precisely. The industrial estates are a host to several indigenous manufacturing companies. One of those estates houses one of the biggest plastic manufacturing plants in Africa. You will be shocked to see what the Igbos are producing in their indigenous industrial estates. It will not be wrong to say that Igbos are driving the indigenous manufacturing sector of the Nigerian economy with little or no government patronage. The first indigenous Nigerian company to produce Nigeria’s first internationally certified branded computers – Zinox is Igbo by the name Stanley Nnamdi Ekeh from Imo State. The Igbos dominate the electronics market and have built series of what they call ‘computer village’ across Nigeria. Nigeria’s leading pharmaceutical companies are Igbo owned; Emzor, Juhel, Orange, Rico, etc. Anabel Mobile is the first indigenous Nigerian phone manufacturer; Igbo. There are several countless industrial breakthroughs the Igbos have made for Nigeria that I cannot go on to list here. On Trade: The Igbos are the most successful traders not just in Nigeria but possibly around the world. Across Nigerian cities they not just control various markets, they equally dominate certain industries. In Kano, Lagos, Port Harcourt, Abuja, and many more Nigerian cities, the Igbos not only dominate the markets, they control certain sectors of the trade business. They are synonymous with the phrase ‘importer’. Their natural drive towards capitalism has driven them across the globe in search for opportunities. There is barely any country in the world where there is no Igbo man doing one legitimate or illegitimate business. The Igbos have proven to the rest of Nigeria that beyond reasonable doubt they are not a lazy people. In Literature: The father of modern African Literature is an Igbo man by the name Chinua Achebe. His work titled ‘Things Fall Apart” has remained one of Africa’s most read book which brought international attention to Nigerian literature. Chinua Achebe remains an inspiration to most African writers. Nigeria gets the glory. In Politics: The Igbos are the first and only tribe in Nigeria to have successfully coordinated and executed Nigeria’s first and only political revolution; other military revolutions (coup) that followed were merely revenge and hunger for military political power. In 1966, a group of senior Igbo officers executed Nigeria’s first set of corrupt politicians in a bloody coup. Although their plan was to install an imprisoned opposition leader by the name Obafemi Awolowo as president, unfortunately the coup was altered by another senior Igbo officer by the name Aguiyi Ironsi who not only distorted the plans but ended up making himself a military ruler and at the same time ended Nigeria’s federalism by decreeing unitarism. The Igbos laid the foundation for political revolutions in Nigeria. And they have paid dearĺy for that move. Today, they are demanding for an independent nation. The Igbos like to fight for what they believe in and they always do damn the consequences. The Igbos control a fair share of the oil & gas servicing industry in Nigeria. The biggest indigenous oil servicing contractor in Nigeria today is Igbo owned. The first indigenous and independently (without government funding) owned gas power plant is built by an Igbo in Aba – Geometric Power Limited. From haulage to logistics to procurement to real estate, finance, sports, entertainment, manufacturing, engineering to medicine, science and you name it. The Igbos have made Nigeria proud; locally and internationally. The Igbos might be arrogant and even exploitative in their quest for profit and expansionism yet Nigeria cannot afford to lose them. They technically control the formal and informal sector of Nigerian economy and they are everywhere, with or without political patronage, they are making progress. I was shocked to find out sometime last year that Igbos still engage in rural-riverine-onshore trading across the remotest villages of the Niger Delta. At this remote village near the Atlantic ocean in Bayelsa State that is only accessible by water and air, these Igbos designed a floating market. They bring in their goods, dock their big boats once in two weeks, make sales and move to another village along that dangerous terrain. A business idea the indigenes of that area have not considered venturing into. The Igbos are risk takers! The Igbos are that successful and they always do remember home. The Igbo influence in the Roman Catholic Church worldwide is amazing. An Igbo by the name Cardinal Arinze was once rumored to become the first black Pope! The Igbos have a strong affinity with the Roman Catholic Church and they have made a mark globally. Anybody who think the Igbos cannot survive as an independent nation might need to have a rethink. Just less than four decades after they were defeated in a bloody civil war and denied their property and work space across Nigeria, the Igbos have risen to produce one of the highest number of billionaires, entrepreneurs, industrialists, etc in Nigeria. They have risen from being a defeated tribe to become the dominating factor of Nigeria’s economy. They have built indigenous industrial cities, turned out to be the most literate people in Nigeria, dominated several industries and have made Nigeria proud in the world scene. If a people can rise to achieve these with little or no government support, one can only imagine what they will become as a republic of Biafra. Enugu has sufficient coal to power the coal need of an industrial country. Anambra, Abia and Imo states have abundant reserve of crude oil and natural gas. They also have access to the sea through the Imo and Niger river. Anambra has three commercial and industrial cities concentrating on manufacturing and trade. Ebonyi is the agriculture base of Igbo land; producing rice, salt, and other farm produce. Abia has Aba and over 100 untapped oil wells with series of indigenous manufacturing firms. In contemporary politics, the Igbo states have managed to stay afloat and sustain recurrent and capital expenditure even when major oil producing states are already endangered. Anambra, Enugu and other Igbo states have proven that there is an economy beyond federal allocations and free oil money. They have scored high in security, education, health care, job creation, entrepreneurship, sports, trade, etc. Many people have argued that the Igbos would lose their investment across Nigeria if Biafra happens. This is an archaic and primitive way of thinking. An independent Biafran nation will not alter any Igbo socio-economic relationship with the outside world, Nigeria inclusive. An independent Biafran nation will not stop Innoson vehicles from been sold in Nigerian market. It will not stop Juhel pharmarcy products from been sold in Nigerian market. A new Biafran nation will not stop any Igbo man from being a landlord in Abuja, Kano or Port Harcourt. It will not stop an Hausa man from still trading at Onitsha. An independent Biafran will only give the Igbos a political status in the world order which will in turn further stimulate the orientation of profit repatriation, sustainability, economic diversification and the need to further develop homelands and eradicate the perception of federal neocolonialism by the skewed federal government of Nigeria. An independent Biafran Nation has the potential of becoming the Japan of Africa. The Igbos want autonomy and control of their life without feeling been marginalized and oppressed. Nigeria can give them this sense of autonomy without necessarily losing them. This is the direction every sensible federal leader should be looking at. How do we satisfy the desire for autonomy by the Igbos and other Nigerian tribes without necessarily losing them as members of Nigeria? This is where true federalism comes in. True federalism will not only give the Igbos the sense of autonomy but will equally position them to further drive the national economy through healthy competition and regional integration. True Federalism will enhance the possibility of Igbo land becoming the Japan of Nigeria. It is possible. Nigeria has a choice to restructure or let the Igbos go. If the Federal government does not make this choice right, the Igbos will make it for themselves and Nigeria will be the loser. The determination of the Igbos towards their sovereign nation should not be undermined by the federal government of Nigeria. I believe boundaries should be destroyed and not further created in our time, this is why I believe in restructure rather than secession. The Igbos have nothing to lose with their secession agenda, it is Nigeria that will lose. This is why Nigeria should now be proffering solutions and not fuelling the agitation. I believe the Igbos will be better positioned under a restructured Nigeria. I do not believe in secession as a solution even though I respect their right to secession. I believe true federalism will fix Nigeria and give the Igbos their desired autonomy while remaining as Nigerians. I believe we all have a choice to make true federalism happen ASAP before Nigeria gets to its elastic point. Again I repeat, Nigeria must not let the Igbos leave the Nigerian union.

It is widely read that Festus Keyamo, a legal luminary, whose name appeared on the list of nominees for the conferment of rank of Senior Advocate of Nigeria but was refused, argued in THIS DAY, that Ikpeazu’s continued stay in office is unconstitutional in view of the Order of the Federal High Court -Abuja which INEC complied thereto. It is quite unfortunate, with all due respect, that a legal practitioner of his standing refused to advert his mind towards the latest judgment of another jurisdiction of the same Federal High Court which confirmed that Ikpeazu REMAINS the Governor of Abia State. While Nigerians expect lawyers ( Ministers in the Temple of Justice ) who are conversant with the true position of law to educate Nigerians or speak on how to resolve the “seeming” conflicting judgments of the Federal High Court, some members of our noble profession have resorted to making public statements that are capable of provoking crisis or causing breach of peace in Abia State. With all due respect, the submission of Keyamo is not without fault. It is completely misleading and dangerous and can never be cited as a precedence in any jurisdiction within the Common Wealth. Dr Okezie Victor Ikpeazu remains the Governor of Abia State of Nigeria based on a thousand and one reasons. This is so irrespective of the CERTIFICATE OF RETURN hurriedly issued to Dr Uche Sampson Ogah by the Independent National Electoral Commission pursuant to the Order of the Federal High Court, Abuja. The reasons for the above assertion include but no limited to: (1) Whereas the judgment of the Federal High Court Abuja which Ordered Ikpeazu to vacate office has been subjected to proper scrutinization by the Court of Appeal with accompanying Motion For Stay of Execution which Notice thereof has been brought to the attention of the parties in the matter, the judgment of the Federal High Court Owerri is yet to be subjected to such scrutiny. In furtherance, there was a clear pronouncement from the Federal High Court Owerri that Ikpeazu remains the Governor of Abia State. I have read it over and over from some of my learned friends that since Justice Okon Abang refused to hear Motion For Stay of Execution, the Order, whether rightly or wrongly issued, still stands. That is the law. After all, INEC has already complied by issuing Certificate of Return. The pertinent questions to ask and answer are now as follows: ( A ) What is the legal status of the Certificate of Return vis-a-viz the Motion For Stay of Execution yet to be heard and must be heard at the Court of Appeal? ( B ) What is the effect of the Order to vacate office considering the existing Motion For Stay of Execution which will now be heard at the Court of Appeal? With regard to the first question, one may argue that the question is already settled with INEC’s compliance to the Order. Having issued the Certificate of Return, it makes nonsense of the Motion For Stay of Execution. It is now a completed act that can only be resolved by the Court of Appeal on merit. Stay of Execution cannot lie against a completed act.I agree. However, in view of the pending appeal, the certificate of return is hanging in the air and will so hang till the final determination of the appeal. On the second question, it is important to state the true position of law. Our highly respected Senior in this noble profession- Mr Festus Keyamo, has posited that Ikpeazu’s stay in office is unconstitutional. With all due respect, that is not correct. That submission lacks thorough legal research. The ORDER of the Federal High Court Abuja asking Ikpeazu to vacate from office has been challenged and the Appeal Court must hear the Motion For Stay of Execution of that Order. Any attempt to compel the Governor to vacate the office will foist a situation of fait accompli on the Court of Appeal who is now properly seized of the whole matter. It was because of the imminent danger caused by the hurry in issuing the highly controversial order contrary to Order IV(1) 2 of the Judgment Enforcement Rules that the Attorney General of the Federation warned that all parties should await Court decisions. Those who still argue that Abuja Federal High Court’s refusal to hear Ikpeazu’s application for Stay of Execution makes his continued stay in office unconstitutional lack vision and must return to the law library. Let me quickly refer them to the Supreme Court decision on Mohamed Vs. Olawunmi ( 1990 ) 2 NWLR ( Pt 133 ) 458. Let me briefly report that the Respondents in that matter filed an application for stay on the 8th May, 1991. The learned trial Judge on the 9th May, 1991 with full knowledge of the application made to the Court of Appeal dated 8th May, 1991, proceeded to pass sentence on the Respondents. It was not in dispute that the application of the Respondents leading to the appeal was filed on the 8th May, 1991. It was not equally in dispute that on 21st September, 1988, the learned trial Judge found the Respondents guilty of contempt of Court but suspended sentence for 14 days. ALSO READ Buhari To Give Niger Delta Avengers Another Amnesty Programme Is Impossible, It Is Very Expensive – Adviser To Buhari The Supreme Court decided that being aware that the Motion dated 8th May, 1991, and unless the Learned Trial Judge wanted to pre-empt the Court of Appeal, one would expect that having waited almost 3 years to pass sentence, he would have waited a little longer to have the application of 8th May, 1991 disposed by the Court of Appeal more so that his attention was drawn to it before passing sentence. According to the Supreme Court, what the Trial Judge did on the 9th May, 1991 was to foist in the Court of Appeal a situation of a fait accompli thereby rendering it impossible for the Court to arrive at a decision one way or the other on the merits of the application before it or render any decision it might take on the application nugatory. The Courts have always frowned on such conduct. While addressing the issue of neglect on a pending Motion For Stay, the Court referred to the celebrated case of Vaswani Vs Savalakah ( 1972 ) 1 All NLR 922 where G.B.A COKER JSC in circumstances not dissimilar observed at pages 927930 of the report that: ” In the present case, there is no doubt that the writ was executed and possession wrested from the applicants whilst their Motion to the Court for a stay of execution was pending and awaiting a date to be assigned by the Court for the hearing of the application. It is true and correct to observe that the Notice of Appeal filed would not operate as a stay of execution and section 24 of the Supreme Court Act makes this more clear; but it is equally correct to point out that the section does not prescribe in favor of any execution being carried out during the pendency of an appeal. Indeed, by its provision, it postulates that during the pendency of an appeal, the Supreme Court has got the jurisdiction to accede to an application for stay of execution conditionally or otherwise. The section does not give any license directly or indirectly for the issue and execution of any process which may ultimately be offensive..” In view of the above decision of the Supreme Court of Nigeria, what then are we talking about? INEC denied service of Motion For Stay of Execution but there is an existing PROOF OF SERVICE of same in the Court’s records. This is the reason I earlier submitted that the Certificate of Return issued by INEC, when juxtaposed with the proof of service of the Motion For Stay of Execution and the pending appeal, is obviously hanging in the air and will so hang till the Court of Appeal decides. It also follows that having drawn the attention of all parties to the existing MOTION FOR STAY of execution of the judgment of the Federal High Court which is now before the Court of Appeal, no party or authority has a right in law to execute the Order of the Federal High Court seeking to vacate Ikpeazu from office. This is the true position of law. Any submission in the contrary must be properly checked and/or investigated to know the remote cause. (2) The second reason is that Dr Uche Sampson Ogah is yet to be sworn in by way of taking oath of office. Certificate of Return without more does not confer the legal status of a GOVERNOR on a person. It is a Constitutional matter. The day Dr Okezie Victor Ikpeazu collected his Certificate of Return from INEC was not the day he became the Governor of Abia State. The former Governor- Senator T.A ORJI was still in charge of the State till the day Ikpeazu took his oath of office pursuant to the provisions of the 1999 Constitution. As it stands at the moment, there is an ORDER from the State High Court restraining the Chief Judge of the State or any other Judicial officer from swearing Dr Uche Sampson Ogah into the office of the Governor of Abia State. And that Order is yet to be vacated by a Higher Court. Whether it was rightly or wrongly issued, it still stands valid. (3) The latest judgment of the Federal High Court Owerri wherein Ikpeazu was unequivocally pronounced as the Governor of Abia State obviously makes any opinion in the contrary irrelevant and generally unacceptable. I hereby respectfully plead with our fellow lawyers to desist from issuing statements capable of causing breach of peace and orderliness in Abia State. Let us be patient till the Court of Appeal or Supreme Court decides. Ikpeazu has suffered much distractions and we hereby persuade everyone to desist from causing further distractions through any means whatsoever. Boroh not sabotaging FG’s dialogue with Avengers – N’Delta elders Paul Boroh Many elders and traditional rulers in the Niger Delta have absolved the Chairman of the Presidential Amnesty Programme, Brig.-Gen. Paul Boroh (retd.), of sabotaging dialogue between the Federal Government and the militants. They contended that Boroh and the Minister of State for Petroleum Resources, Dr. Emmanuel Ibe Kachikwu, had toured some communities in the region to consult and secure ceasefire from the Niger Delta Avengers. They, however, maintained that the slow pace and perceived frustration noticed in the take-off of the dialogue was caused by some dissidents and their sponsors in the region. The elders and monarchs, under the aegis of the Progressive Elders Forum for Peace and Progress, in a statement on Monday by their leader, Chief Joseph Whyte, argued that those blaming Boroh were unfair, mischievous and wicked. They said, ‘We were shocked and bemused by the claims by some elders from the region accusing Boroh and Kachikwu of frustrating the planned dialogue between the militants and the Federal Government. “They are wicked and paid elders who have no shame. Most of those involved in the campaign of calumny are failures in the positions they held in the past including the Niger Delta Development Commission. “They claimed Boroh discussed with fake militants. At least, it confirmed the fact that Boroh is working and doing something on behalf of President Muhammadu Buhari to link the militants with the Federal Government. Advertisement “If they claim he discussed with fake militants after relocating to the creeks, they should be honourable to own up and show us the genuine militants they paid to destroy the region. “Negotiation is always open but the sponsored dissidents have vowed to make the proposed dialogue fail.The Federal Government should monitor and investigate these so-called elders and their sponsors.” However, another set of elders in the region, under the aegis of Bayelsa Elders for Progress, Peace and Good Governance, led by their Coordinator, Chief Ayibatonye Goodnews, and the Secretary, Chief Lucky Ebifaghe, had on Saturday accused Buhari’s aides including Boroh of frustrating the proposed dialogue. They had expressed concern over the alleged show of deceit, insincerity and discordant tunes among the presidential aides from the region. They had also claimed that the development was creating a huge doubt between the militant youths and the Federal Government. They also insisted that Buhari should investigate the genuineness of the purported meetings held between Boroh and Kachikwu. They had wondered, “How can they claim to have met stakeholders and the militant attacks continue? They met some fake militants and stakeholders and wasted scarce resources of the Federal Government on a jamboree.” “Buhari should investigate the money expended on the jamboree without result. Ozekhome faults FG’s non-implementation of National Confab recommendations Mike Ozekhome Mike Ozekhome, legal practitioner and human rights activist, has faulted President Muhammadu Buhari’s non-implementation of the over 260 recommendations of the 2014 National Conference, blaming it for the lingering problems in the country. Ozekhome spoke at the First Edo Heroes and Heroines Lecture Series organised by Edo Forum of Patriots in Benin City over the weekend. He said that he was highly disappointed that since the end of the National Conference in which notable Nigerians selected from various parts of the country discussed the issues bothering on the state of the nation, no part of the recommendations had been implemented. Ozekhome said, “I am greatly disappointed that the recommendations have not been implemented and for as long as we continue to overlook the recommendations in that confab reports, for so long we are going to have our problems, because we have over 260 recommendations that can redo and re-engineer a country that is in need of vision of mission. President Buhari has not done himself any good by saying he has not even read it and that he will not even read it, that N9 billion was wasted on it. “That is the more reason he should look at it. That confab was made up of the best first eleven elements of Nigeria from all the six geopolitical zones; all the thirty-six states; all the seven hundred and seventy-four local governments areas; Emirs, traditional rulers, professionals, senior advocates of Nigeria, medical doctors, retired police officers, military officers, the physically challenged, the youths and the women. Every segment of the Nigerian society was reflected at that confab. Advertisement “And we disagreed on many occasions but we still agreed to agree before we finally arrived at those over two hundred recommendations and you are telling me that you do not want to implement them. That is why we still have the problem; for what he is looking for in London, is under his trousers and that is the truth,” Ozekhome said. The human rights activist further noted that there was need for the country to practise true federalism so that the people from the different parts of the state and ethnic groups could feel the significant impact of whatever is produced or generated in their locality rather than being marginalised. He said that the country’s federal system was lopsided of which he said was part of the reason Nigeria as a country was suffering. “The point I am making is that the federalism we are operating now is a lopsided one. It is tilted in favour of the big ethnic groups, particularly the Igbo, Hausa, Yoruba, and the Fulanis. And I asked the question, ‘what about the three hundred and seventy ethnic groups?’ Are you now continuing to use the tripod of Igbo, Hausa, Yoruba, Fulani? A tripod is not a balanced object. I think that is why Nigeria continues to wobble and fumble. “We need to have a truly balanced federalism restructured in such a way that each state should be able to take care and manage its own resources with its own constitution, its own police force. Police used smoke bombs to clear demonstrators blocking Interstate 94 in St. Paul late Saturday night during a protest sparked by the recent police killings of black men in Minnesota and Louisiana. The smoke was used after about 200 protesters refused to leave the roadway just after midnight as police in riot gear slowly moved in. The St. Paul Police Department tweeted that arrests were made, but didn't indicate how many, and said at least five officers suffered non-serious injuries when hit by rocks, firecrackers and bottles thrown by protesters. Meanwhile, in Louisiana prominent Black Lives Matter activist DeRay Mckesson was one of several people arrested Saturday night during protests in Baton Rouge that called for justice in the wake of the fatal police shooting of 37-year-old Alton Sterling, who was black, by two white police officers. In Minnesota, Mike Martin, who wore a guitar on his back and said he was trying to promote peace, was pepper sprayed by a police officer on a pedestrian bridge overlooking the interstate. He said he was trying to move the crowd along and keep the peace. "I guess I wasn't moving fast enough for him," said Martin, who estimated the officer was six feet away and sprayed without warning. "He just got it out and bam, I saw a cloud. It's burning pretty bad." A leader on a loudspeaker urged the group to march to the governor's mansion, where protesters have gathered since the fatal police shooting on Wednesday of Philando Castile in suburban St. Paul. She said she saw about 30 people being peacefully taken away by officers, who said they warned protesters they would be subject to arrest if they didn't disassemble. A new Coordinator of the Joint Media Campaign Centre has been posted to Operation Delta Safe as part of reorganisation of the joint military force in the Niger Delta, the News Agency of Nigeria reports. NAN recalls that the defunct Operation Pulo Shield was reorganised and replaced with Operation Delta Safe in June 2016 to address current security challenges in the Niger Delta.
