Judicial Council Asks Salami To Retire by Idokojimmy: 5:06am On Oct 22, 2012
THE National Judicial Council (NJC), at its meeting on Thursday last week, resolved on early retirement with full benefits for the embattled president of the Court of Appeal, Justice Ayo Isa Salami, as a way out of the logjam over his career, Nigerian Tribune can exclusively inform.
Five months after the council had pardoned him for misconduct that got him suspended, multi-dimensional litigation, including his own, had stalled his resumption in office.

Salami, it will be recalled, had been out of office for 14 months and was due for retirement on October 14, 2013.
A reliable source told the Nigerian Tribune that discussion on his professional future at the council meeting was passionate, with a member from the South reportedly making an appeal for over 30 minutes for his resumption in office before the early retirement, in order to save his career.
Though other members were reportedly moved by the presentation, the suggestion that Salami be restored to office for three months before tendering his retirement notice was said to be rejected, due to pending cases which a source said had made the issue complicated.

The complex nature of the matter was also the reason given by the former chairman of the council and immediate past Chief Justice of Nigeria, Justice Dahiru Musdapher, in failing to restore Salami to office.

After the consideration of the options open to the council in resolving the lingering issue, it was said that members unanimously agreed that he should retire early with all his benefits paid.

However, the early retirement option by the council was reportedly dependent on the disposition of Salami to the idea, which he had reportedly rejected once.

The Chief Justice of Nigeria, Justice Mariam Mukthar, who is the council chairman, was reportedly mandated by the council to communicate the idea to Salami, in company with the council’s deputy chairman, Justice Mahmud Mohammed, a reason for the meeting of Friday in Mukthar’s office.

A source privy to the meeting said Salami did not give any definite response on the acceptance or otherwise of the option.

In another development, a source revealed to the Nigerian Tribune that contrary to the belief that President Goodluck Jonathan had not responded to the resolution of the council, reinstating Salami, the president had reportedly written the council, informing that he had actually taken steps on the earlier resolution asking him to retire Salami for misconduct.

It was further learnt that the president said the earlier decision of the council had been carried with the appointment of the acting president, Dalhatu Adamu, reportedly adding that the second leg of the council’s resolution, which is to ask the Senate to compulsorily retire Salami and nominate a replacement, was stalled due to the pendency of the suits on the issue.

Meanwhile, feelers from the council meeting showed that Justice Bola Ojo of the Osun State High Court is set to emerge as the next chief judge of the state.

It was learnt that with the decision of the council and the position of its chairman that the bench is a career-progression calling, strict seniority would be applied in choosing heads of courts, especially for those in the mainstream, like Ojo.

A source disclosed that though Ojo and Justice Gloria Ladoke; president of the Customary Court of Appeal, were appointed same day and the latter was called to the Bar before the former, Ojo would be considered the most senior in the state, by virtue of being in the mainstream and signing the register ahead of Ladoke during their appointment to the Bench.

All i have seen so far is that the Njc members are using their discretion instead of the written laws of the land. The president rushed to remove this man on weekend base on the resolution of the njc and has well over five months of the same njc recommendation to reinstate him been dancing. If a man of this status could be humiliated to this level in this country, what is then the hope for me and you? Could this be a justification why people resolve to jungle justice? We are building a wrong place for our generation yet unborn. It is this man today and it may be anybody tommorow.

Personally, Justice Salami"s reputation has been soiled by his inglorious political romance wit Tinubu, selling election disputes to ACN & choosing candidates for them like the case of Rotimi in Ondo, the man shud just go, he is corrupt.

I'm not a political 'hypochondriac', but I must say that the newly appointed CJN is just as hypocritical as her predecessor. There's already more to suggest her justiciary fantasy. What a pity for Nigeria and democracy!

Oga, you don't know what you are talking about. Salami is corrupt. He was paid to deliver Osun and Ekiti to ACN. That is a fact!!!

The call logs tendered as evidence were real. MTN was also part of the conspiracy and I'm sure they must have pleaded with PDP not to press charges against them.

What happened to all the "We don't need Jonathan to reinstate Salami" rants that came from some members of the NJC

This is a face-saving move for them for with their f[i]oo[/i]lish rants about not needing the president and having powers to unilaterally reinstate Salami(a man whose very sickening acts of bribery and corruption are being exposed on a very frequent basis,they had appeared to many of us as being very dumb and gullible or portrayed themselves to be in cahoots with Salami's sleaze

I think I was fooled to support this fraud in the first place. He must also be arrested for usurping the peoples mandate for selfish reasons. Tinubu was dashing him Lagos state's millions of pounds to make a mockery of the judiciary. The man should be ashamed of himself.

NJC can not be trusted because of their inconsistency. They say one thing today and reverse themselves another day. The same people that cleared Salami and said GEJ snould reinstate him are now saying Salami should retire. Should Salami heed NJC? He doesnt hav to, because the inconsistent NJC can come up with another recommendation asking him to be reinstated! God save Nigeria, many of these people are serving judicial officers but can not be trusted - in fact they dont even trust themselves. Pray u dont hav a case in court before these people and their ilk.

The call logs obtained from MTN shows that Salami is Corrupt and now i understood why ACN fought hard to get him reinstated so that they can continue buying State Elections. ACN is as corrupt as PDP and Salami but some people wont see it the way it is because they have been blinded with regional politics and godfatherism.

Their leader itself is a BIG Fraud #OBAMAGOLDCARD

Isn't Salami d judge who descended in2 d arena of conflict? Pls he shld be allowed d benefit of dust of encounter.

Am convince beyond all reasonable doubts that ur head remains intact and correct.
If Salami is found guilty by the NJC, he should be discliplined, de-Robbed and jailed.
If not, then re-instate him and let him continue his good works and let the whole world knows that u guys goofed.
I wonder why either of the two is so difficult to accomplish Asking him to retire with full entitles is like solving this judicial limbo by passing the back door. Is this the judicial reform we all are talking about?
Shame to NJC and the presidency. Until i see Salami well-discliplined, am not convinced that he is guilty. besides, i would love to read this repoort from another news outlet. Tribune are known to prepare most of their reports from wadata plaza in Abuja. Not to be fully trusted.
