Court Restrains Senate, Police From Arresting Maina by Nobody: 9:13pm On Mar 27, 2013
A Federal High Court sitting in Abuja on Wednesday vacated the arrest warrant issued by the senate against the sacked chairman of the Pension Reform Task Team, Abdulrasheed Maina.

Delivering judgment on the suit filed by Mr Maina, Justice Adamu Bello held that the arrest warrant issued by the senate did not comply with section 88 of the 1999 constitution as amended.

The court further held that it was regrettable that the defendants failed to make available the National Assembly Journal or the official government gazette, containing the process leading to the issuance of the arrest warrant.

Justice Bello also held that “the lack of these documents means there is no evidence to show that the arrest warrant actually emanated through due process in accordance with the law”.

He added that the senate does not have unlimited powers as their powers are limited by section 82 of the 1999 constitution.

The court therefore issued an order of perpetual injunction restraining the senate and its committees, including the Nigerian Police from attempting to arrest or harass Mr Maina in relation to his failure to appear before it on the pending investigation into the rot in pension administration.

We will soon get to that stage where most of these guys will be shot on sight since the court now aids these criminals in robbing us blind.

That will be extra-judicial. However, I do believe that our laws (constitution, criminal code, court procedure) have to be strengthened to ensure that public sector criminals don't get off the hook easily.

It is not enough for the court to bar the NASS from issuing an arrest warrant... A serious judge should specify the right process for instituting arrest proceedings. If not the NASS, then who? The police? Attorney-General? SSS?

Judgements like this resonate very badly with the common man. They send a message of nonchalance of the judiciary with regard to ongoing efforts to rid Nigeria of this monster called corruption.

But what kind of sane court would free a man that stole billions of naira. If the senate did not follow due process does the court not have the judicial right to hold him in custody if the defendant is guilty

Due process has to be followed. It is only the law enforcement agencies (EFCC, Police) that can prosecute an accused person in a competent Court Of Law.

Another charade in this dilapidated theatre called Nigeria where impunity reigneth supreme. The arm empowered to make laws do not understand the usage of the law, and the judiciary is another cesspool of shiit! If a criminal can easily execute dastardly scheme against pensioners who have laboured hard and get away with it, I see no reason why corruption shouldn't be made legal so that there will be no monopoly on corruption where everyone can have a level playing field in the acquisition of extra-legal wealth.
