Its simple, re- arrest him and frame another charge with Lagos State as the prosecution. The constitution is very clear and provides in section 3 as follows: " there shall be 36 States in Nigeria, that is to say, Abia (etc to Zamfara. Sub 2, each state "OF" Nigeria( not state of Lagos, or state of Osun).... State is OF Nigeria and cannot be State of Osun or Lagos. The latter denotes different meaning. No state in Nigeria belongs to a set of people so as to term it (The) State of Lagos(people) or State of Osun (people). Fashola is a senior lawyer and should understand this better when he is not playing politics.

In plain English, does University of Ibadan means the university belongs to Ibadan? There exist State of California in US yet it is not different from Texas State which was even an independent republic up to 1845 before it voluntarily joined the USA as the 28th state .

But like somebody already posted, legal meanings are not necessarily same as ordinary dictionary meanings.

@koruji. You are not entirely right that the constitution only listed the names of states without clarifying if they are 'of' or not. In the Schedule to the Constitution(same as where states are listed) but the one on the Oath of Office, it expressly states that Governor take oath as "Governor of _ _ _ _ State" not as "Governor of State of _ _ _ _". Same for members of the House of Assembly of a state or Judicial officials of a state's courts.

The judge is ignorant.

The "State" refers to an intangible entity that has the legal monopoly of use of violence/force. In secondary school subject of government, a state has four features: a government, a defined territory, a people and a constitution.(Hence the Federal govt, the state governments, and the local government even EU are each a trust for its state in their own rights respectively). So the state encompasses all these 4 parties but the government is the legitimate entity which acts on the state's behalf.

The government acts on behalf of the state within the limits defined by the constitution.

Matters usually taken to courts are usually between 2 parties. However, when a crime is committed, it is against the state, no matter who the crime victim is, and the government as the legitimate trust for the state prosecutes the offender.

Our constitution recognises the distinctiveness of each state. Sometimes the word state is used to describe a territory. And sometimes the word Lagos State can be interchangeably used as the State of Lagos.

This judge has only succeeded in bringing ridicule to the Lagos Judiciary which is supposed to be the most sophisticated of all the judiciaries within the second-tier (state) governments.

Does it means that transaction entered into by 'State of Lagos' is void? smiley (Thank God, I have collected my mobilization fee wink)
Does it means Lagos was illegally sold for the period it was referred to as 'State of Lagos'? smiley
Does it means the 'State of Osun' contravene the principle of federalism by selling the state to Nigerian citizens of Osun state origin?

Lagos state does nt have a 'state of Lagos' bt Ikeja local council area 'of Lagos', located in and belonging to Lagos state!
Something can never stand on nothing in law and d maxim 'Nemo dat quod non habet' means 'u cannot give a better title dan u have' .
Ds same Judgement is going to be brought against d merger party shld INEC go ahead and assign d acronym APC to them.

I agree with you, but this should be a non-issue for the judge except that he has a "PDP" ax to grind. All designations are equally valid: "Osun", "Osun State", "State of Osun".

i agree and vice versa also. The law also makes provision for such and that explains the reason why they can appeal against the judgement. I advocates for this and i hope its done. Lets test it properly within our laws.

I'm really not game for all the PDP vs ACN wars on NL, I tend to root for sound reasoning based on rational query... so is there a difference then between the state of California and California state? Just a question.... The ruling party is desperate to maintain a strong centre to carry on business as usual hence their blunt refusal to adhere to the tenets of true federalism which is really the crux of this issue.

Of course such high fallutin dribble sounds like logic when it is really fallacy. Let's start calling "Osun State" "State Osun" since the south of Sudan is known as South Sudan. Fact is all these designations are really equally valid since they are attempts to wrap a description into a noun. Osun, Osun State, State of Osun are all equivalent and should not give any judge heartache - except of course one under the PDP "umblella".
