Is this some sort of sick joke? Since when did FG parastatals/facilities pay takes to bloody state govts? Has Oshiomole gone mad? Kudos to the IG for ordering the arrest of the EIRS Chairman. Everyone who partook in that act must be included in that arrest warrant. Nonesense.

Have you ever heard of the word PAYE? FAAN staff benefit from every thing any citizen leaving in edo state benefits from, so why should you think they be exempted from paying personal income tax.

Please try to read simple Nigerian taxation laws before contributing to issues like this wink


There is PAYE for which the FAAN ( or other companies ) in Edo state are suppose to remit to the state which I believe in this case, they have failed to do so.

PAYE is quite different from Company Income Tax which is remitted to the FG wink smiley



For the guy to say they don't pay tax to EDO STATE GOVT is laughable and shows that he is not suppose to occupy that sit smiley

So if they are other states that do not have OR have airports better than Edo state, Oshiomohole should turn a blind eye to tax evaders?

I need a good laugh this morning. Perhaps this analogy would suffice:

Tax officials/EFCC/or any other MDA shuts down (seal up) a branch managers office in a bank and the branch manager decides to shut down the banking operations of the branch by ordering the security men (bank guards) to shut the gates/entrance to the bank.

Sealing the airport manager's office (irrespective of the location) is tantamount to sealing the airport.

I think issues such as these are handled and resolved by the Joint Tax Board (JTB). I think we just love unnecessary drama in this country.

The Board The Joint Tax Board has over the years continued to contribute to the advancement of the tax administration in Nigeria, especially in the area of harmonization of Personal Income Tax administration throughout Nigeria.

Establishment of the Board
The Board is established by section 86 (1) of the Personal Income Tax Act cap. P8 LFN 2004.

The membership of the Board

The Executive Chairman of the Federal Inland Revenue Service as the Chairman of the Joint Tax Board;
One member from each State being a person experienced in income Tax Matters nominatedby the State;
Co-opted as membersare, the represenative of the following bodies:
FederalRoad Saftey Comission (FRSC);
Revenue Mobilization Allocation and Fiscal Commission (RMAFC);
Federal Capital Territory Administration;
Federal Ministry of Finance; and
Federal Inland Revenue Service
A Secretary, being a person experience in income Tax Matter appointed by the Federal Civil Service Commission.
A Legal Adviser who is also the Legal Adviser to the FIRS

Functions of the Board The Board meets on quarterly basis to appraise the performance of the members and to deliberate on Tax issues of National Importance to develop new strategies to carry out its factions which include:

Advising all tiers of Government on tax Matters, so as to evolve an efficient tax administration system in the Country;
Resolving areas of conflict on Tax Jurisdiction among Member State.
Using it’s best endeavors to promote uniformity in both application of the Tax Laws and in the incidence of tax on individual through out the Country.
Imposing it’s decision on matters of procedure and interpretation on Income Tax matters on member State.


Activities of the Board Apart from the quarterly general meetings and committee meetings, the Board also organizes retreat for members. The retreat is usued as an avenue to discuss other vital issues that cannot be accommodated during the normal meetings. All members of the Board are mandated to attend the Boards meetings and other activities. Representation all the time is not encouraged.
Joint Tax Board Committees It should be noted that the Board operates through committees and these committees report to the Board accordingly. Members are assigned to these committees and at present each to a minimum of two committees. Members are expected to be actively involved in the activities of these committees and be always ready to contribute meaningfully.

To the ignoramuses and the over sabis, the truth of the matter is as follows;

i. It is compulsory for all adults employed or self employed to pay Income Tax i.e PAYE to the state where such income was earned. THis apply to all adults, Nigerian or otherwise with the exemption of the military and members of the diplomatic corp. It is criminal to evade tax and to cause to deduct tax from employees and fail to remit same to the appropriate authority is the more criminal. In civilized environments, tax evasion is a serious criminal issue.

ii. Rule of Law dictates that no one is above the law be it a federal agent/agency in any of the confederating state or vice versa.

iii. Independence of the Judiciary implies that the judiciary must be respected by all and sundry right from the president to the ordinary man on the street. A notice from the judiciary should inform some sort of reverence or at least respect and not disdain and contempt.

iv. It is an abuse of power, office, privileges, authority etc for any body to use organs/agencies/apparatuses of the federal unit to oppress and intimidate agents of the composite units. It is not only undemocratic, it is anti-federal system of government. It is barbaric and unheard of in a decent democratic federating system.

v. Of course there will always be friction among the centre and the federating units in a federation, the judiciary is often at hand to resolve such as provided in the guiding constitution.

v. Nigerian Federation is fast becoming ''gangster-ic'' and may God Help us All!

Authorities of the Federal Airport Authority of Nigeria (FAAN) have apologized to the Edo State Government and air travellers over the incident which led to the closure of the Benin Airport on Tuesday.

Managing Director of FAAN, Mr. George Uriesi led other management staff to governor Adams Oshiomohole in his office in Benin City to tender the apology.

“We deeply regret the events of yesterday and we will like to find out how we can avoid a situation like this arising in the future, because it is neither in the interest of FAAN nor in the interest of Edo State Government for the Airport to be closed down, because there was a lot of hardship and serious economic consequences as a result of the shutdown and there is need to settle this matter.

“I want to assure Your Excellency that FAAN is a good corporate citizen. I am convinced that there was a misunderstanding and I want to get to the bottom of this misunderstanding so that it does not happen again.

“If we have any obligations, we will meet them, and I hope that in the future if there are issues of misunderstanding, we will be able to talk about them quickly without them leading to delays and inconveniences to the public. So, sir we are here to reassure you of our respects and desire to be good corporate citizens and partner with the State Government to deliver services to the people of Edo State,” Uriesi said.


Gov. Adams Oshiomhole, Edo State Governor.

In his response, Governor Oshiomhole noted that tax law was a federal law which the state government was only trying to implement.

He noted that the tax which FAAN defaulted on was the Pay As You Earn (PAYE) which even the President and Governors pay.

Oshiomhole said the State Board of Internal Revenue got a proper Court Order to seal the FAAN Manager’s Office, noting that the FAAN Manager on his own decided to seal up the Airport to gain public sympathy.

The Governor said the problem with Nigeria is not immunity, but impunity as people often violate the law and get away with it.

He insisted that anybody who works and lives in Edo State must pay tax as a contribution to the development of the State, adding that to avoid a re-occurrence of the ugly incident, FAAN must comply with the law.

He however, expressed his displeasure with the FAAN Manager, Benin Airport, Mr. Ayodele Sunday for dramatizing the issue, saying “I hope in future, this sort of thing does not happen.”

Others in the entourage included Mr. Yakubu Dati, General Manager, Mr. Kolawole Adefomiwa, Deputy General Manager, Mr. Adeboye Festus, the Chief Security Officer and Mr. Ayodele Sunday, Airport Manager.
