The cenotaph is erected on ground where a warehouse perished Troubled businessman who lost huge investment properties including a furniture warehouse, printing machines, huge volumes of warehoused books and other equipment to the fateful crash of Dana craft operated as flight 0992 on 3rd of June, 2012, Mr. Daniel Omowunmi has caused a court summon to be issued on the Lagos State Government for illegally acquiring his land to erect a cenotaph without consultation, relocation or compensation. The summon, dated 23rd July, 2013, a copy obtained by 9ralife.com, joins the commissioner for Lands, Housing and Urban Development and Attorney General of the State (who doubles as the Commissioner for Justice) as defendants. Mr. Omowunmi, still agitating that the management of Dana Airline restores his business perished in the fatal crash, received yet another slap from the Lagos State Government which took the land without prior consent. Governor Fashola, on 3rd of June, 2013, exactly one year after the fateful crash which killed 153 passengers on board and another 10 victims on ground, unveiled a cenotaph on the site to mark an anniversary of the air tragedy. Residents of the site apparently were forced to despise their properties. Mr. Daniel Omowunmi’s business site was also caught with the Lagos State Government’s land acquisition exercise. The portion in the fenced perimeters of the crash site where the cenotaph stands was the land area where Mr. Daniel had his business warehouse. Mr. Omowunmi’s legal action is seeking court’s declaration that he is still the owner of the land; a declaration that Lagos State Government’s revocation of owner’s occupancy was wrongful, arbitrary and unconstitutional and an order of court that Lagos State Government and other defendants compensate the claimant with N45million as the claimed worth of the four-plots landed property – among other demands. Alternatively, Mr. Omowunmi is asking court through the action to order the Lagos State Government to allocate him another land proportionate to the one it illegally encroached on the crash site; an order of injunction restraining the State Government from further trespassing on the land and an award of N20million in General damages. Earlier on his grief with the Dana Airline, Mr. Omowunmi had protested at the Dana Airline’s office in Ikeja. But soon after, he individually shot the gate of the Airline’s office in lone protest, restricting entry to the Airline’s business office in Ikeja. “They have kept me out of business since 3rd of June last year, so shutting down their office for only half a day is to let them feel little of what I experience everyday”, he told policemen who were immediately called in by Dana management to curtail his action. The Airline, it was learned, called Mr. Omowunmi to a meeting afterwards, but he might still file other suit against Dana as there are indications their discussion stalemated. The latest troubled to be encountered by the businessman is the outright acquisition of the land by the State Government. Commenting today on the development, a social analyst says the Lagos State Governor, Mr. Babatunde Raji Fashola has a pedigree of arbitrarily taking over people’s properties without due consultations. “Fashola swooped on the Makoko slum and just as the dust is yet to settle, Ijora, Badia east is the new pain injector”, the commentator told 9ralife.com today. “How can Government take over my property without my consent and without thinking how I should be compensated?”, the businessman said to 9ralife with bitter mood. >> 9ralife.com/cenotaph-on-dana-crash-site-governor-fashola-issued-court-summon-over-illegal-acquisition-of-land/ |
