[b]Court stops Bayo Williams, ex-Lagos PDP boss, from ejecting w[/b]ife

A Lagos High Court sitting in Ikeja on Wednesday restrained former Chairman of Peoples Democratic Party (PDP)in Lagos State, Adebayo Williams, from ejecting his wife, Morunfayo, from her matrimonial home.


Morunfayo had gone to court seeking an interim injunction restraining her husband or his agents from forcefully ejecting her from her matrimonial home at 12, Wale Taiwo Close, Magodo, GRA, Lagos, pending the determination of the motion on notice for interlocutory injunction.


Justice Olubunmi Joseph Oyewole, in his ruling, said the circumstances of the case required urgent intervention of the court to prevent irreparable injury to the applicant and subsequently imposed an interim injunction against the former PDP boss.


Morunfayo had, in a sworn affidavit, said her husband deserted the matrimonial home since June, 2006, abandoning her and the four children of the marriage.


She stated that on May 15, the defendant, through his solicitor, wrote a letter threatening to forcefully eject her from the home, which they jointly built and moved into in February 2000.


She added that after her solicitors, Messers Bayo Osipitan, replied the letter, the defendant's solicitors later wrote a letter dated July 3 directly to her husband denying the existence of any marriage between them.


"The denial of the existence of marriage by the defendant's solicitors is a grand design to ensure that the children of the marriage and I are forcefully ejected from the matrimonial home," she stated.


She therefore prayed the court to restrain the defendant from forcefully ejecting her and the children from the home.


Oyewole also ordered the applicant to enter into an undertaking to indemnify the defendant in case it is found out that the order was improperly obtained.


The judge also granted leave to the applicant to serve the writ of sermons, statement of claim, other accompanying processes, the motion on notice for interlocutory injunction dated July 11 and all other processes on the defendant as well as his solicitors, Oluwatoyin Bashorun.
