With the statement credited to the Ekiti State Governor-elect, Mr Ayodele Fayose, as widely reported in the press last Friday, it is possible he was complicit in the desecration of the Temple of Justice and physical assault on its Ministers and Officials – that is, Judges, Lawyers and Judiciary workers – by his supporters. The invasion of courts in Ado-Ekiti by the alleged thugs of Ayodele Fayose last Wednesday and Thursday (Sept 24 and 25, 2014) ostensibly to stall his eligibility trial has taken the country several notches down in regard for the Rule of Law and Constitutionalism. The infamy is worse than the scandal of the seizure of $9.3m belonging to Nigeria by South Africa because the thuggery in Ekiti touched on the very foundation of the Constitution and soul of the nation. Now that the Ekiti State Judiciary has been shut down by thugs, as court proceedings cannot be conducted except they are appeased, I urge the plaintiffs to proceed to the Supreme Court without delay and plead that the apex court invoke its Original Jurisdiction to try the matter, within the context of Doctrine of Necessity. The eligibility of Fayose to contest the 2014 governorship election is purely a law issue. Was he impeached or not? Was his impeachment overturned by any court in Nigeria or not? Under what circumstance is someone impeached eligible to contest election? These are questions of law that would get to the apex court in one way or the other even if it had proceeded peacefully from the lower court. The Supreme Court should take notice of the state of anomie in Ekiti as regards the freedom of the courts to sit, invoke its powers and try the case expeditiously. If the petition is dismissed, Fayose must be sworn in on October 16, 2014 as Governor. If otherwise, the Speaker of the Ekiti House of Assembly will be sworn in and new governorship election conducted within 90 days.
