By Virtue of section Section 68 (1)(g) of the 1999 Constitution as amended.
The section reads, “A member of the Senate or of the House of Representatives shall vacate his seat in the House of which he is a member if -
(g) being a person whose election to the House was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected.”

Ex speaker contravened section (68)(1)(g) by defecting when there is a subsisting court injunction to the effect that there is no division in the PDP

security details is in order. Section 68 (1)(g) made it clear that a lawmaker who defects when there is no division in his party shall vacate his seat.
“The legal advice is that the operational word there is ‘shall.’ That section of the constitution is self-

“It therefore means that based on that constitutional provision, Tambuwal is no longer a member of the House. Since he is no longer a member, then he cannot be the speaker.

I just went through my copy of the constitution and I've come to realise that Tambuwa has breached section 68 (TENURE OF SEAT OF MEMBERS) sub section g: which states that 'being a person whose election to the house was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that house was elected;
provided that his membership of the latter party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored

The issue here is about speakership and not essentially about being a member of the house. Section 50(1) and (2) of the CFRN 1999 specifies how a speaker is appointed and vacated respectively.Those laws did not provide that once a speaker cross carpets, he ceases to be the speaker. Section 68 (1) of the CFRN 1999 which the Acting IGP refers to(which talks about how a member shall vacate his membership of the House) is not in tandem with the issue at hand which is that of speakership. Moreover it is not the duty of the Acting IGP to say whether Tambuwal is no longer the speaker or a member of the House. That duty at best is for the members of the House to decide and if they cannot, then the Court will do that. No law says that a speaker shall be a member of the ruling party or must come from the party occupying majority of the seats in the House. I understand the hasty approach of the PDP and GEJ in the treatment of this matter but whatever it is, the law must be obeyed. There are several minority members of the house that have joined the PDP in recent times, what did PDP say about them? By law, PDP should have read Section 68(1) g of CFRN 1999 to them but I never heard them do that.

APC supporters, can u guys explain more abt section 68 (1) (g) of the 1999 constitution? Ya lame excuse is bringing Mimiko into dis issue n u can't quote wia in d constitution dat state a Governor shud vacate his/her seat wen he/she cross carpeted.

Bro I disagree with your opinion though am not happy with the way and manner of pdp approach to this issue but there is nothing one can do because it is what we all (as a result of majority carry the vote) want and be clamouring for. The use of brute force approach, disregarding the stipulated laid down rule to follow.

Back to issue, Bros one can not be a speaker of the house without first being a member of the house. The rule says the speaker must be appointed among and from within the entire membership of the house.

Tambuwal would have score an A+ if he had honourably resign his position after defecting knowing what the law says concerning defecting from a party that's not in division or merger.

Almost four years he was in that place and he didn't occurred to him and his associates to do something about that clause in the law, instead of concentrating their effort on making laws that will benefit all and making sure effective check and balance system was put in place they were busy pointing accusing finger at the executive and ridiculed him every opportunity they get.

I keep saying to those who have ears and i will keep hammering it "Jonathan is not the problem of Nigeria, neither is he a bad ruler and neither is he a saint but among them all he is an angel"

To solve the problems of this country, we need to check the system currently in place and the first step to that is to thoroughly revise the constitution and who are the people to do " the lawmaker which tambuwal happened to be a or once a member.

Vote in buhari tomorrow, the problem will still persist and get worsen. The way things are it will be very hard even for a saint to come out without a blemish.

The case of a Governor is quite different,because of their immunity. And the fact that APC, LP or APGA has refused to take action against their lost members, doesn't mean PDP can't... The constitution is very clear on this.
Tambuwal is no longer a member of the House of Rep not to talk of being the Speaker.
