ABUJA -The Peoples Democratic Party, PDP, has
lost its bid to declare seats of the four ‘rebel’
governors that defected to the All Progressives
Congress, APC, vacant.

In a ruling Friday, the court dismissed the suit
against Governors Rotimi Amaechi (Rivers); Rabiu
Kwankwaso (Kano), Aliyu Wamakko (Sokoto), and
Abdulfatai Ahmed (Kwara).

Though PDP originally dragged five governors
before the high court, however, following the
impeachment of Murtala Nyako of Adamawa
State, his name was accordingly struck out from
the suit.

Justice Gabriel Kolawole struck out the suit
against the governors on the grounds that the
originating processes filed by the PDP to
initiate the action were invalid.

The court upheld the arguments of the plaintiff
that the originating processes were wrongly
issued and served on the defendants.

Justice Kolawole held that failure of the plaintiff
to seek court’s leave to serve the governors
through substituted means by publication in the
July 3, 2014 edition of This Day newspaper
contravened provisions of Section 96 of Sheriff
and Civil Processes Act.

Besides, he maintained that absence of
endorsement on the processes violated Section
97 of the same law.

He held that irregularities in service of a process
on a party could only be ignored if such party
decided to wave his rights.

The governors had through their various
lawyers, challenged the legality of the court
papers PDP served on them through the National
Secretariat of the APC in Abuja.

Uncle uncle Bad governance is causing all this defection cus d governor knows his behaviour will bring badluck nt to only them but pdp in general.

Music to my ears!! So will their nose be bloodied in 2015!!!

Whatever it was, they would've lost the suit, but I'm all for judgements based on merit and not mere technicalities like wrongful filing of suit and all that. Our judiciary needs to up their game.

Notice to all lovers of the nigeria project, the saTAN is at it again. The strategy of pdp and saTAN was that immediately the general wins they pay online rodents, vanguard, nta to start propagating lies hoping to bring him down. If buhari is responsible for terorism as they claim why has he not be trial and jailed,or is the president clueless, or scared of one man. He should be bold enough to do it. Since Buhari has become APC candidate, If I were Jonathan (God forbid), I wouldn't even bother contesting.

Instead, I would seek a refund of the money I used to buy PDP presidential form and use it to repair prisons across the country and renovate it to my taste.

That is the only way he and his gang of thieves can enjoy life after his tenure, in prison.

When people defect from another party to PDP, no problem but from PDP to opposition, its alike a taboo and they try all means to get back at those that tries it.

Its a fair judgement.

I can't fathom why the topshot lawyers representing PDP should make such a grave error.
Its elementary law that before you serve through substituted means, you should obtain the leave of court. And we are even talking about service outside jurisdiction which is governed by the SCPA!

Non-service is very fatal as it even affects the court's jurisdiction to try the matter.
The learned silks should have known this.
I'm very, very surprised.
