Article 134 (2) of the Nigerian Constitution stipulates that a presidential candidate will be duly elected after attaining both the highest number of votes cast; and has received at least a quarter of the votes at each of at least two-thirds of all the states and the Federal Capital Territory (FCT) of Abuja. If no candidate satisfies the requirement, a second election will be held between the two leading candidates within seven days from the pronouncement of the result.

Its self explanatory, apart from having the highest number of votes, d winner must garner at least 25% in at least 24 states even if he loses in some of d states.

It will perhaps help you understand the spirit and principle of the rule first.

WHY HAVE THE 25% PROVISION?
In a country as diverse as Nigeria, this policy was put in place to ensure that any leader that is elected enjoys the mandate and support of a large part of Nigeria.

Basically, it is insufficient to have a large number of votes from one part of the country. For example, even if I won 100 million votes from Kano state alone, I would still need to demonstrate that I have support from the rest of Nigeria in addition to the large votes I got from Kano.

I would need to get at least 25% of the vote in 2/3rd of the states in Nigeria.

Nigeria has 36 states today, so I would have to get 25% of the votes in 24 states.

NOTE that I don't need to win the 24 states. I just need to get 25%.

So, to recap, to win the presidency in Nigeria, I need

1. A simple majority of the vote which I could get from a small section of the country (or even one state)

ALSO

2. Demonstrate I have support in a large part of the country by showing that at least 25% of voters in at least each of 24 states supports my candidacy.

the law as relates to the election does not regard
region or province. it's all about the 36 states + abuja

it then follows:

that the 2/3 of 36 states is = 24

2. the winner must obtain the highest numbers of votes cast
in any of the states not region

3. in each of the 24 of 36 states, the candidate must obtain atleast 25% of
valid votes. e.g 25,000 of 100,000

therefore, buhari has met all the requirements
and thus, is the winner

It mean he must have more than 25% of the total vote cast in at least 24 states...meaning even if he lost a state to GEJ, he must have 25% of the total vote casted in d election. Even if he loses at that state
The essence was to ensure the President was accepted nationwide and not on ethnic grounds

Course Title: ELECTORAL SYSTEM EDUCATION!!!

Course Summary:

1. Criterion 1: A presidential candidate must secure at least 25% of votes cast in each of at least 24 states of the Federation before he could have a chance of winning an election.

2. If a candidate has the highest number of cast votes nationwide but fails to satisfy Criterion 1, he won't be declared the winner. Instead, the candidate with a lower total votes but meets Criterion 1 will be declared the WINNER.

3. Where there is no winner, a RUN-OFF election between the two closest candidates will be conducted within 7 days of the first election.

4. Criterion 2: From the re-off election, winning is by simple MAJORITY i.e. the presidential candidate with the higher number of votes cast will be declared the WINNER even if it is just by one vote.

where did you get the 2nd aspect of your number 2? That stuff is not in our Constitution. Where the candidate with the simple majority fails to meet the 25% in 2/3 States, the next option is a runoff election.

Criterion 1 - A Presidential elect must have 25% in 2/3. means the winner must record 25% in 24 out of 36 states in NIGERIA.


Criterion 2 - Total numbers of votes casts...

therefore GMB have qualified for CRITERION 1 and he was clearly leading in CRITERION 2... SAI BABA

Not surprised at this, our over sabi is second to none all over the world and in most cases, they are for fraudulent purposes.

Now, what the law says is that the winner must not only score the highest number of votes but must also score at least 25% of the votes cast in 2/3 of the 36 states not in 2/3 of the states where his opponents won.
