The Deputy Governor of Ondo State, Alhaji Ali Olanusi, who is reported to have been impeached, has warned that there is a subsisting court order that the status quo‎ be maintained in respect of that office.

In effect, the Deputy Governor insists he has not legally been removed from office.

According to his lawyer, Oluwole Kayode, the court order was granted last Thursday, April 23rd, and he emphasized that it touches and affects the office and the holder.

“Another action in respect of the same office and the impeachment process is pending in court and will come up on the 7th of May 2015,” he said, noting that that the hurried nature of the impeachment process is suspect.

“I think public office holders and people who are put in position to defend the constitution must be law abiding,” Mr. Oluwole said. “In the light of this disobedience to court order and the impunity displayed in the course of the impeachment proceedings, the Deputy Governor is on solid ground.”

There are several things wrong with this impeachment.

On a procedural level, the deputy governor wrote to the governor that he was travel on a medical trip on Monday 20th April, 2015.

The State House of Assembly went ahead to serve a person who is not in the country a notice of impeachment that he is supposed to respond to within 7 days.

I believe that equates 7 working day because the HOA doesn't seat on Saturday and Sunday.

In less that 6 days, a panel has been set up. The panel sat within 2 hours and the Deputy Gov who was not in the country wasn't given fair hearing. The panel wrote and submitted a report within that 6 days and impeached him when he hasn't exhausted the duration of time he has to respond to the notice of impeachment.

I'm sure he will legally fight this to a standstill and Mimiko has definitely erred this time.
