KADUNA – A Kaduna State High Court yesterday
threatened to jail the Commandant of Nigerian
Defence Academy, NDA, Kaduna, Major General
Muhammed Inuwa Idris over contempt of court
order.
The court’s warning was contained in ‘Form 48′,
dated 25th May, 2015 and signed by the
Registrar of the court Abubakar Habib. It was
said to have been served on the Commandant
through courier since last Thursday.
The court document, titled; ‘Notice of
Consequences of Disobedience to Court
Order”, reads: “To Major General Muhammed
Inuwa Idris (Commandant of Nigerian Defence
Academy, Kaduna).
“Take notice that the judgement creditors will on
18th day of June, 2015 at 9am in the forenoon,
apply to this court for an order for your
committal to proson for having disobeyed the
perpetual order of injunction of this court made
on 10th April 2014, restraining the defendants,
especiall the 2nddefendant, NDA, whether by
themselves, agents, servants, workmen, officers,
privies and assigns whomsoever and howsoever
otherwise from trespassing upon or disturbing
the 1st and 2nd plaintiffs enjoyment of the
properties known as Flat 4, no 11 Gongola Road,
Barnawa and flat d, no. 36A Gongola Road,
Barnawa, Kaduna.
“And firther take notice that you are hereby
required to attend the court on the fore
mentioned day to show cause why an order for
your committal should not be made”.
The issue hanging over the NDA Commandant
had to do with two contentious property, both
in Barnawa GRA, Kaduna formerly belonging to
NDA. But they were sold to the l Mr. Joseph
Kingo Lafidi (now late) and to D. Akpam (also of
blessed memory). Both were then civilian staff
of the military institution.
However, widows of the late NDA staff , Mrs.
Elizabeth J. Lafidi (1st Plaintif) and Dorcas D.
Akpam (2nd Plaintiff) were evicted from the
property in 2010 by the NDA authority . The
widows however took the matter to court and
won the case on April 2014.
But, the property were forcefully taken from
them by the NDA.
Counsel to the widows, Barrister Lekan Oyerinde
approached the same Kaduna State High Court
in Suit No: KDH/KAD/737/2015, alleged that the
NDA commandant acted against the Judgment of
the court and forcefully evicted the ‘original
owners’ using armed soldiers. The NDA
disregarded several summons over the case of
contempt against it.
But when contacted on phone, a source close to
the academy who doesn’t want to be quoted
said, the matter is in appeal court sand
therefore, he would not want to comment much
on it.
Even though, he did not provide the appeal
number, the source said, ”the widows were
dubious about the house, NDA has announced
severally that no staff should get any house
through the monetization because the academy
is an institution where people come and go, so
there is no way it can monetize its houses, if it
does, where will the people coming after live?”
He further noted that widows were not told to
evacuate NDA staff quarters until the
entitlement of their husbands were paid.

The Military and her injustice.

If the property were presumably sold by the Military under past Commandant, the current commandant has no right to evict the owners.

Muhammed Idris is showing a very poor and in-disciplined example by not responding to the court order.

If you can not take orders from a higher authority then you have no right to give orders.
