A Kaduna-based constitutional lawyer, Mr. Sunny Akanni, has declared that it will amount to the violation of the provision of the constitution if President Muhammadu Buhari does not appoint a minister from each of the 36 states of the federation. The lawyer who was commenting on speculations that the president was considering reducing the number of ministers to be appointed, said if he must reduce the number of ministers, it should not be less than 36. According to him, Section 147 of the 1999 Constitution (as amended) provides that a minister must be appointed from each of the 36 states of the federation. He said any attempt to violate the provision of the constitution would be challenged in court. “I have heard speculations that the President wants to reduced the number of ministers to be appointed to save cost of governance. That is a very good steps and I commend him for that, but in taking such steps, he has to be conscious of the provisions of the constitution as well. “Section 147 of the Constitution said the president shall appoint at least one minister from each state of the federation who shall be indigene of such state. “So if a minister is not appointed from my state, I will challenge it in court because that is a violation of the provisions of section 147 of the Constitution. So it is compulsory that he appoints ministers from each of the states, he has no choice,” he said. Akanni said: “I expected that by now the president should have appointed an Attorney General who guide him on issues that have constitutional implications. He should be guided by the constitution before reducing the number of ministers. He argued further that the same thing applies to the states, pointing out that even the decision of the Kaduna state governor, Mallam Nasir El-Rufai to reduce the number of commissioners to be appointed to 13, is unconstitutional. According to him, section 14, subsection 4 of the constitution provides that a commissioner must be appointed from each of the local governments in the state. “The composition of the Government of a State, local government council or any of the agencies shall be carried out in such a manner to recognise the diversity of the people within its area of authority and the need to promote a sense of belonging and loyalty among the people of the federation,” he quoted the constitution. “So how do you want to run a government when you don’t have such representations in the states and local governments,” he queried. Well, if truly that's what the constitution states, then he has no choice but to honour it. Some of the posters above should thrown away sentiments when it comes to certain issues. It is a democracy afterall. |

It's a constitutional issue and must be guided by the constitution. The only way out is to get the constitution amended. |
