Kenny Martins charged with 419

The Federal Government has filed a -four -count charge of advance fee fraud against the Coordinator, Police Equipment Foundation, Mr. Kenny Martins, for allegedly breaching a loan agreement of $97.5m he entered with an American firm, Cavalry Security Group, LLC.







Martins was consequently brought to a Federal High Court, in Abuja for arraignment but that was not done as the court did not sit for the purpose.

Also listed in the charge as second accused is the Police Equipment Foundation.

A source told our correspondent that Martins would be arraigned on Monday at the court.

Martins was arrested by the police few days ago and since then had been in police custody.

He was driven back to police custody in a white police bus on Thursday when the arraignment could not take place.

The offence is contrary to Section 1(2) and punishable under Section 1(3) of the same of Advance Fee Fraud and other related offences Act, 2004.

The charge sheet on suit FHC/ABJ/CR61/2009 was signed by Prisca Oguamalam of Legal/Prosecution Section of the Nigeria Police Force Headquarters, Abuja and filed before Justice Gabriel Kolawole.

In a document attached to the charge sheet, the police said that the American company allegedly defrauded by Martins had instituted a case against the Federal Government in the United States, asking for damages running into about $30.400m in a court before Judge Stein.

The damages were predicated upon costs incurred by the foreign company in providing PEF with some equipment it asked for and other personnel and transportation expenses.
