While some mischievous and aggrieved parties are now on full throttles trying to deliberately misinform the public, sway public opinion and malign the ruling party and the President of Federal Republic Of Nigeria as having influence on the recent judgments emanating from the Tribunals For the Benue and Taraba States governorship elections.

It behooves on some of us who are widely knowledgeable not to allow this fifth columnist (who are yet to recover from the devastating defeat suffered by their hero in the hands of Nigerians) now masquerading as opinion writers and born again lovers of Rule Of Law to further drag the Sacred institution of Law into the mud.

Let me for the sake of emphasis, relay albeit briefly, the prayers and ground of petitions filled by the two candidates in the two contentious states vis a vis the rulings by the tribunals on the cases for Nigerians to compare and contrast.

Benue State: (Trazoon Vs Ortom)
Let us look at the addresses of the two Learned Men representing the Petitioner(Trazoon) and the Defendant (Ortom)

Adenipekun said it was a settled law that the appropriate place to ventilate the issue of qualification is the election petitions tribunal.

The lawyer said the first respondent was not sponsored by the APC and was not a member of the party at the time of the election.

He said the APC did not hold a valid governorship primary, adding that the court should allow his petition.

But the Counsel to INEC, Prof Tony Ijohor, urged the court to dismiss the petition.

According to him, there are no facts to support grounds two and three of the petition, hence the petitioner cannot seek solace under the canopy of severance of pleadings without a formal application.

Prof Ijohor cited Gundiri v Nyako, 2NWLR Part 1931 P. 211 at 284 and 285, decided by the Supreme Court.

The law expert urged the court to invoke the presumption regularity with respect to the nomination of Ortom by virtue of sections 167 and 168 of the Evidence Ac.

http://thenationonlineng.net/tarzoor-v-ortom-tribunal-reserves-judgment/

The Tribunal Verdict:

Justice Elizabeth Karatu in her ruling dismissing the petition stated thus:
Section 177 and 138(1)(c) of the 1999 Constitution as amended and held that Governor Ortom met all the criteria for being recognized as the validly elected candidate of the APC.

She went further to point out that the petitioner failed to provide valid evidences to show that the APC did not hold its primaries as required by law.

According to her, the petitioners witness (one) made mockery of the Tribunal by presenting to it a report of the Independent National Electoral Commission, INEC, on the APC primaries which was not written on an INEC letter headed paper nor signed by the relevant persons.
http://www.vanguardngr.com/2015/09/benue-petition-tribunal-upholds-ortoms-election/.

Now To Taraba State: Aisha VS Dairus)

The petitioners prayed the tribunal to void the governorship poll for corrupt practices and substantial non-compliance with the provisions of the Electoral Act 2010, as amended.

They also urged the tribunal to disqualify the 1st respondent, Ishaku, and hold that all votes credited to him during the election were “wasted and thrown away votes”.

The petitioners through their lead counsel, Mr. Abiodun Owonikoko, SAN, told the tribunal: “Contrary to the provisions of Section 85 of the Electoral Act, which requires the service of at least 21 days to INEC before the holding of congress for the conduct of primary election, the 2nd respondent (PDP) only delivered their notice to INEC on December 11, 2014, at exactly 6:04pm and held the purported primaries on the same day. This was apparently after they have conducted the said primary.

“That in defiance of the requirement of Section 87 of the Electoral Act, the 2nd respondent held the purported primary at Abuja as against Jalingo, Taraba State capital.
At the hearing, counsel to the petitioners Mr. Abiodun Owonikoko (SAN) adopted his final written addresses and urged the tribunal to return the 1st petitioner, Alhassan, as the elected governor of the state. However, counsel to the 1st, 2nd and 3rd respondents in their unanimous submissions prayed the court to dismiss the petition, describing it as lacking in merit.

In his closing argument, counsel to the PDP, Solomon Akuna (SAN), also prayed that the petition be dismissed because the petitioners have not proved their case.

The Tribunal Verdict:
In the unanimous judgment that lasted about three hours, the tribunal Chairman, Musa Danladi Abubakar held that the purported nomination of the sacked governor by PDP breached section 85 of the Electoral Act 2010.

The tribunal held that it was a fundamental law in Nigeria that a candidate for an elective position must be duly nominated and sponsored by a registered political party before the candidature of such candidate can be legally valid.

In the instant case, the tribunal said that there was overwhelming evidence that PDP in Taraba State did not do any primary election that could have led to emergence of anybody as a sponsored candidate.

The tribunal recalled the evidence of the Independent National Electoral Commission (INEC) on subpoena during the hearing of the petition when the Commission claimed that it has no record of any primary election by PDP in Taraba State whereas Section 85 of the Electoral Act made it mandatory that INEC must be given 21 days notice of a convention or a primary where candidates are to be nominated for election.

The tribunal therefore said that since Darius Ishaku was not sponsored by any known registered political party, he cannot lay claim to votes cast for any political party and cannot as well claim to be an independent candidate in the election.
http://abusidiqu.com/how-tribunal-sacked-taraba-gov-ishaku-to-declare-apcs-aisha-alhassan-nigerias-first-female-govits-a-political-judgment-fayose/

Let us now analyze the similarities of the two cases:

#Fact 1: The two petitioners lost an election(which they believed was unfair) and approached the tribunals for redress.

#Fact 2: The two approached the different tribunals with similar prayer, which was:
That the primaries elections that brought their opponent were conducted in breach of the relevant sections of the constitution and electoral acts(as amended)

#Fact 3: The Tribunals asked them to bring evidence to support their claims.

#Fact 4: The two argued their cases within the abilities of their counsels.

So as you can see from th above: The two cases are similar in contents and arguments.

Contd..

The Difference Which Settled The Matter:

In the Case of Hajia Aisha Jumai Alhassan, she was able to prove her case with relevant documents and testimonies from the INEC official that there that the purported primary election that threw up Darius Ishaku was held in total breach of the constitution and electoral act:

See excerpt of the verdict: In the instant case, the tribunal said that there was overwhelming evidence that PDP in Taraba State did not do any primary election that could have led to emergence of anybody as a sponsored candidate.

However in the case of PDP Trazon, he was not able to prove his case beyond doubt that the primary election that brought up the APC Ortom was not held in compliance with the electoral act (as amended)

Hear the Judge: "She went further to point out that the petitioner failed to provide valid evidences to show that the APC did not hold its primaries as required by law.

According to her, the petitioners witness (one) made mockery of the Tribunal by presenting to it a report of the Independent National Electoral Commission, INEC, on the APC primaries which was not written on an INEC letter headed paper nor signed by the relevant persons"

So what's all these noises about "double standards" in the two cases??

It held that since Ishaku was not duly sponsored by the PDP, the party had no candidate in the governorship election in the eyes of the law. The tribunal therefore voided the votes of the PDP and Ishaku in the election saying`it is a waste’’ and declared the APC and its candidate, which came second, as the valid winner of the April 11 election."

It is wrong to relate or compare this case with the locus classicus case of Amaechi v. INEC (2008) 5 NWLR (Pt. 1080) p. 227. Whereas the issue in Amaechi's was on who was the lawful and rightful candidate of the Peoples Democratic Party (PDP) as between Mr. Celestine Omehia and Mr. Rotimi Amaechi. The question in the Taraba's case is whether the PDP participated at all in the election in the eyes of the law.

By the provisions of Section 140 of the Electoral Act 2010 (as amended), where an Election Tribunal or Court determines that a candidate who obtained the highest votes was not qualified to contest the election, it shall not declare the candidate with the second highest votes as elected, but it shall order for a fresh election. On the other hand, where the Tribunal or Court determines that the candidate who was returned as elected did not score majority of valid votes at the election, it shall declare the candidate with the highest valid votes as elected.

If the issue was solely on the qualification of the PDP candidate then the Tribunal's order declaring the APC candidate as duly elected was arrived at per incuriam (in error) as the proper order would have been an order for a fresh election.

The fact that the purported PDP primary election was held outside the stipulated time as stated by an INEC staff whose testimony was accepted by the Tribunal is conclusive of the fact that the PDP never validly nominated a candidate as required by law. In essence, the PDP did not participate in the election.

It has been argued by some that it amounts to "double standard" for the Tribunal which sat in Abuja because of the security situation in the State to invalidate the PDP primary election which was taken to the party secretariat in Abuja also because of "security concerns".

However, let it be on record that APC plans to destroy our nascent democracy and capture all states of the federation will results into anarchy as they will fail in their enterprise.

Time shall tell and posterity will judge.

Btw: we are in possession of All progressives Congress [APC] official document tagged "Penetration Strategy Draft".

The document revealed APC's strategy to usurp power from the Peoples Democratic Party [PDP] especially in Rivers State, Taraba etc. as well as how to win the upcoming Bayelsa and Kogi States governorship elections.

At the peak of "Kidnapping" in the south east : All millionaires from South East deserted that region. Luxury cars were exchanged for volkswagen beetle for disguise. Some hired ambulance as camouflage to visit home. Some abandoned their mansion to lodge in hotel. Some relocated their business to the "zoo". Some relocated their families and properties to the "zoo". Some died in the hands of those kidnappers. Life became nasty, short and brutish for south easterners. Fear and nightmare killed many millionaires. Many millionaires died in the hands of their captors. All Igbo traditional cultures were deformed during kidnapping hence the "zoo" became a safety net for all. The "zoo" played host to uncountable traditional marriage of our people. The "zoo" played host to our revered traditional New Yam Festival. Churches in the south east went bankrupt because nobody was honouring any invitation of fund raising. Fake and pretentious lifestyle was activated out of fear. Many projects were abandoned both private and public projects. Pupils were withdrawn from schools. At a stage kidnappers started kidnapping themselves while some youths started self kidnapping to exploit their parents and sponsors. Ok.Kontinu In the early days of Boko-haram, many people saw it as a Northern problem. As it escalates, it went beyond a regional problem and become a national problem and migrated to global problem. Any sensible creature that visits Northeast Nigeria today must break down in tears. Some millionaires are now starving in IDP. Life is now a misery in northeast. Some are making millions out of the calamity while millions are lavishing in hunger and deprivation. Hmmmmm. I detest anything violence. I detest Incitement. I detest war I detest aggression. Those sponsoring the Biafra uprising today are short minded creatures that lacks knowledge. There is nothing that you cannot achieve through peaceful means. Advice to 2nd Niger Bridge dwellers, You can empower group of miscreants with lies and deceit as a way of distracting an administration you hate with passion . You will be their first victim when they run out of control. You will not be lucky to re-educate them when they buy into your hate propaganda. Violent struggle are the easiest struggle that can be hijacked by miscreants and terrorist. Violence orientation gives birth to terrorist upbringing. Hating the "zoo" to Greatness will leave you stranded. The zoo might not accommodate us all when it starts . Do not think you have monopoly of violence. To South East Elites, Rise and Educate your populace! Kidnapping litany will be a child's play when miscreants hijack this agitation. You might not live to see the end.. Dear President Buhari, The National Orientation Agency is dead. Revive it. Reactivate it. Declare emergency in NOA. Okokobioko has plenty homes across "zoo". He can minister from anywhere. Stop posting trash. That section of the electoral act was rejected at the Federal high court, so it's a nullity. Read here

PDP is a genuine loser as far as Taraba is concerned, and there is nothing the appellate or supreme court can do about it.

In summary, PDP presented a ghost candidate(a candidate that does not exist in the eye of the law) in the last election.therefore stands no chance in laming a claim to the victory that is deserving of madam taraba unless they can prove that the primary in abuja was duely ractified by INEC.

It is very clear that the Benue state tribunal was BIA in its ruling.

1. There was NO Governorship primary of the APC that was held on or before December 11, 2014. All they had was an arrangement inside the parlour of George Akume which other candidates REJECTED. See the Nation's report...
"Chief Ortom emerged after other governorship aspirants stepped down for him at the end of a close door meeting brokered by the senate minority leader, Senator George Akume, in Makurdi."
www.thenationonlineng.net/benue-apc-settles-ortom-governorship-candidate/

2. In fact, other FIVE aspirants rejected the arrangement.http://www.leadership.ng/news/394871/benue-apc-primaries-5-guber-aspirants-reject-ortom

3. No delegate was present nor participated in the sham as required by section 78(b)(I) of the Electoral Act. For the record...

Section 78 (b) (1)(2) of the Electoral Act states: In the case of nomination to the position of Governorship candidate, a political party shall where they intend to sponsor candidates:

(i) hold special congress in each of the Local Government Areas of the States with delegates voting for each of the aspirants at the congress to be held in designated centres on specified dates.

(ii) the aspirant with the highest number of vote at the end of the voting shall be declared the winner of the primaries of the party and aspirant’s name shall be forwarded to the commission as the candidate of the party, for the particular state.

4. No INEC official monitored the primary election/f®audulent arrangement by APC. This contravenes section 85 of the Constitution

This issue was RAISED by PDP candidate but INEC working with APC was silent on it.

6. The tribunal Judge failed to look at the merit of the argument but dwelt on technicalities. It ask the PDP to prove that there was NO primary election. But in the Taraba case no such was demanded.

7. Both cases are of similar magnetude. While INEC was quick to point out that they never monitored any Taraba PDP primary election, they kept quiet in the case of Benue.

We shall not relent in our drive to reclaim our stolen mandate in Benue and Taraba states. The Judiciary terrorism by APC, Buhari and corrupt judges shall be resisted. This is pure Judicial Terrorism perpetrated by the unholy group called APC.

Amaechi's case is different from that of Ishaku Darius. Amaechi won the primary election in Rivers State but had his name substituted with that of Omehia because of what Obasanjo called "K leg." You may liken the case of Ishaku Darius to that of Ifeanyi Ararume of Imo State, whose party, PDP, told the world it's not sponsoring.

"The future of Nigeria Democracy is at stake".

You begin to ask yourself, what future? What democracy? Was there future before?Has there ever been democracy under PDP for 16yrs?

A party that rigged a governor's forum election?Where 16 is greater than 19?Where is the democracy?

A party that has no respect for rule of law.A party that turned Nigeria to a jungle.

A party where a siting governor was kidnapped in broad day light.

A party where a sitting governor disguised as a woman in far away UK in order to jump bail.

Is there any shame and regard left in PDP?

A word is enough for the wise.
Ngene, the herculean task that we face is convincing people that the way of life forced on us by PDP led government for 16years was an anomaly and that a society governed by the rule of law is achievable.

Pls Ngene, I beg you too to offer tonye the same crash course becos I can see both metuh and Tonye will soon write pdp into oblivion.

If you and lai mohammed continue with this bashing, I'm afraid, they will make a visit to lagos one day, and the next thing, Oba Akiolu's voice of lagoon theory will begin to sound in their ears and the next thing, they might obey the voice and JUMP INSIDE THE LAGOON

[s]It is very clear that the Benue state tribunal was BIA in its ruling.

I am not interested in the morality or "emotionality" of the case neither am I interested in whether APC complied with the electoral act in holding their Primaries.

However, I have cleared the wrong notion that there was double standards in the two rulings (as claimed by you).

PDP and it's candidate failed to prove their case in Benue, while APC did! So deal with it!

You may be right in your submission but the truth is, the court can only decide based on the facts before it. If the PDP counsel did not prove their case beyond reasonable doubt before the Benue electoral tribunal, you can't abuse the judges for deciding based on the evidence before them.

Another point to note is the evidence given by INEC. In the case of Taraba, inec affirmed that PDP conducted no primaries and in Benue, Inec disagreed with the petitioner that APC conducted no valid primaries. The evidence of INEC, an independent third party will definitely be relied upon by any court in this scenario.

INEC never said APC had primaries for Benue state. They were completely SILENT on it because they understand that they can't prove that primary election was held. The tribunal judges fraudulently left the argument to ask the petitioner to prove in a glaring case. Or did they say same for APC in Taraba? Not even INEC proved that primary election was held in Benue APC.

It is glaring that there is a grand conspiracy by the Presidency, APC, INEC and the Election Tribunal to subvert the will of the people in favor of APC. This is purely Judicial Terrorism.
