What do you expect when the constitution was hurriedly put together by few military criminals? That's why we want a constitution where Nigerians will sit down together and make a law that will govern them. Anything apart from that, we will continue to see the country as a zoo.. angry

DEATH OF A GOVERNOR ELECT BEFORE TAKING OATH OF OFFICE
According to the 1999 Constitution as amended, Section 181.
(1) If a person duly elected as Governor dies before taking and subscribing the Oath of Allegiance and oath of office, or is unable for any reason whatsoever to be sworn in, the person elected with him as Deputy governor shall be sworn in as Governor and he shall nominate a new Deputy-Governor who shall be appointed by the Governor with the approval of a simple majority of the House of Assembly of the State.
(2) Where the persons duly elected as Governor and Deputy Governor of a State die or are for any reason unable to assume office before the inauguration of the house of Assembly, the Independent National Electoral Commission shall immediately conduct an election for a Governor and Deputy Governor of the State.

The Act does not allow for replacement at this stage. The election will be conducted without the participation of APC

The Angle of d Law According to “1. Section 34 of the Electoral Act 2006 only empowers a party to substitute nominated candidates not later than 60 days to election and upon application giving cogent and verifiable reasons so to do." Hence the Deputy has to continue with d Mandate...However, the bone of Contention is whether or not the elections have to be re run or a fresh election be conducted. But as it stands I don't see any legal interpretation strong enough to advocate for a conclusion of d elections. INEC will be setting a big Precedence in this case. As it stands we have a long film to watch as The Supreme Court would be called in for interpretation..

A new candidate will be presented to the Inec by APC and the inconclusive election has to be cancelled for new one to be conducted. Par adventure if it happens to another candidate of different party cancellation will still occur. If this persists within the stipulated time a sole administrator will be appointed by the president till elected governor emerged.

Has Audu been validly elected before his demise? If no then this section is not likely to be applicable in this instance.
