These are among the ways the judiciary encourage crime by giving option of fine for offences that should carry mandatory jail terms. Its a victory to the criminals, the judgement brokers and the judge.

Ultimately, Nigeria and Nigerians are the loser bc this judgement serves as no deterrent. There will be no theft of crude by Nigerians if there is no market for stolen crude.

Too small an option.
Knowing the Asians for their avarice, they
won't mind serving out the jail term. Life
sentence would have been preferable. I
expect EFCC to appeal the judgement.

Is this the strong signal the court is sending?.....allowing the sentences to run concurrently?..... and giving the convicts the option of paying a fine that is a small fraction of the value of the illicit product? Strong signal indeed..... to invite others to get involved in the business.

Why didn't you post their fine at 1billion naira. Do you have an idea of how long they've carried out this very activity?? 5 million might just be a meager sum out of the whole loot. See diz daniskas fa! Nigerians d steal crude, una ma carry una vessel to come steal, una fada for dia. Like say make I dash person knock.

A Federal High Court in Lagos on Tuesday convicted nine foreign citizens for stealing 3,423.097 metric tons of crude oil from Nigeria.
Among the convicts were five Filipinos and four Bangladeshes.

They had been intercepted by the Nigerian Navy on March 27, 2015, while trying to export the stolen product loaded in their vessel, MT Asteris, out of the country.

On Tuesday, Justice Ibrahim Buba convicted them on four counts bordering on the crime and
sentenced each of them to a jail term of five years with an option of N20m fine.

In handing down the sentence, Buba said he was satisfied that the Economic and Financial Crimes Commission, which prosecuted the convicts, proved its case beyond reasonable doubts.
“The case of the prosecution is as clear as the daylight,” the judge held, adding that the failure of the convicts to supply the evidence that they had lawful permit to deal in crude oil further strengthened the prosecution’s case.
The product was illegally sourced in Nigeria as “the Department of Petroleum Resources confirmed to the EFCC that MT Asteris was not licensed to deal with crude oil in Nigeria.”

The judge said it was the likes of the convicts that made Nigeria a laughing stock in the eyes of the world. Adding that it was not right for anyone to deprive the country the enjoyment of its natural resources through illegal means.

Buba said the court had the duty to send a strong signal to Nigerians and non-Nigerians alike that the country had laws and the laws were enforceable.
“It is not right for either Nigerians or foreign nationals to deny this country its God-given natural resources through illegal means. Accordingly, this court hereby sentenced each convict to five years term of imprisonment on count one with effect from March 27, 2015 with an option of N5m fine,” the judge held.
He also sentenced them to five years each on counts two, three and four or a fine of N5m on each count.

He said:
“All the sentences are to run concurrently, but not the option of fine. In addition, the vessel, MT Asteris, and the cargo on board are forfeited to the Federal Government of Nigeria.
“For purposes of clarity, each convict is to serve five years term of imprisonment with effect from 27 of March, 2015, or pay fines of N20m for all the four counts.”
The foreigners who were convicted and jailed are Axel Jabone, Zahirul Islam, Juanito Infantado, Suarin Alave and Gatila Gadayan.

Others are Islam Shahinul, Islam Rafiqul, Shaikh Nomany and Rolando Comendador.

Its so painful that only the poor thieves and pick pocket get jail terms that are always longer than the real armed robbers that's dos that steal naija money, crude oil and other naija properties..if someone can have vessel or ship to steal crude oil, have the access to the crude oil, how much is 20million that he can't pay..have you held in abroad where they give fine for dis kind of serious crime..God help naija oooo

I'm sure they will pay that with ease.

and we sentence our own citizen to death for stealing phone.... what a country!

Giving an option does nothing to stop the act. Options of fine in offences such as this should be very steep while the term of imprisonment should not be too much or too little.

A 5 or 7 year imprisonment term with an option of at least N50m per accused person totalling N450m or $1.8m.

Now that isn't too much or too little, just right for international thieves and if unfortunately, they're caught again, just make it $18m or $2m/N450m per accused person. That will deter others to some extent.

That's how it's done. I don't understand Nigerian judges. They're very timid.

If they don't pay the fine, no one is going to see them outside the 4 walls of kirikiri until 2020.
