their lawyers have studied this case very well and realized it'd likely not end in their favour. if the govt., is to settle out of court then empty hen should be ready to cover any expenses incurred by ncc on the case so far.

MTN took the case to court but now they applied to settle out of court. They are like a bunch of clowns.

Anyway, I wish NCC and the minister can refuse to settle out of court. They asked for it and so shall it be.

I think NCC has a good case in court. Bottom line - MTN must pay the fine!

Smh! You need to stop been sentimental... According to the gist, MTN signed an agreement with NCC where things were stated clearly and they violated the said agreement. The sanest thing they should have done is to lobby and negotiate the fine rather than dragging the NCC to court.

Lets bring it to a personal level: if you go into a business agreement with someone and they go back on such agreement despite clearly stating all the penalties and all parties signed, would you just sit and look or would you take actions?

Personally, i would have preferred MTN negotiated the penalties from the onset before they signed such agreement rather than doing a round-about face when they were called out on breaking the agreement.

You need reorientation, so you think this foreign companies have the right to disobey laws which they signed when coming into the country. No wonder why you all would be slaves to anything foreign. Moreover do you know this foreign companies convert all ur Nairas to dollars and send back to their country, so how is that helping the exchange rate

is it the government that is begging to settle out of court now? Foreign Investment that disobeys existing local laws? That disregards national security? Common you're better than this.

They were misadvised by the greedy lawyers who wanted a piece of the action, this issue was not meant for the courts in the first place as the Nigerian govt did not break any law at all. Mtn is the lawless party here. It ought to be the govt taking MTN to court instead

No one is saying they should not be punished. You must punish them to the appropriate degree. The amount is too excessive.

Already South Africa says they will stop buying nigeria's crude that they will buy from Iran. This is weird because Nigerian crude is light but Iran is heavy.

I THOUGHT THEY WILL NOT SEE THE HAND WRITTEN ON THE WALL.ANYWAY FOR THE SAKE OF SEVERAL FAMILIES THAT ARE DIRECTLY OR INDIRECTLY DEPENDENT ON THEM,NCC SHOULD ONLY ALLOW THEM AN INSTALLMENTAL PAYMENT BUT NOT A KOBO REDUCTION.

No body forced them to sign the agreement All Telcos signed too( $1000/Unregistered SIM on the network, it is less about the fine but more about the negligence they simply didn't bother

I am a supporter of reduced fine, but MTN took the case to court which I did not support. It's the same MTN that's seeking out of court settlement. You can NEVER sue your regulator over your own screw up and expect all to go well. Case example, when the U.S. was facing mortgage crises and the BIG banks were accused of foreclosing on homes inappropriately, the Feds sued. The banks begged to settle out of court which the AG agreed to. The banks paid through their nose and to punish the banks, the feds made sure every case of wrongdoing was audited (incurred by the banks). The banks learned, but I did not hear for instance, Bank of America or JP Morgan sued the Feds over their own wrongdoing. It's NEVER done, and MTN fvcked up on this one. In fact, I want them to pay the whole fine + other attorney and administrative fees incurred by NCC.

That amount wasn't just slammed on them, in the agreement they signed there's a specified fee for each subscriber they refuse to deactivate his or her line. That amount was multiplied by the total numbers of active unregistered subscribers. So telling them to pay 50 or 100B is against the agreement MTN and other network providers signed

am pretty sure that offer is off the table cuz MTN took NCC and AGF to court, if you noticed what the lawyer who represented the AGF said, he wants the case settled in the courtroom and not outside anywhere

It's all part of th strategy. If you follow legal cases you will notice they take it court to frustrate the government and at some point depending on how the case is going the government may decide to settle out of court for a lower amount.

All you will hear is MTN and NCC and settled out of court for an undisclosed amount.

That's not exactly true. Negotiating out of court settlement is normal during civil court cases. It can also be a way to delay.

It has been adjourn till March and then they bring something else up.

We don't need mtn again. Most of all these foreign company are killing us due to poor government policy... They run from other countries due to their policies to Nigeria.
They will even be saying that Nigeria gov is weak n you can operate them anyhow.

The US banks could have sued but it would have been futile. The US public also wanted nlood.

That however: is the US, the largest economy in the world. California alone is the 11th largest economy in the world.

Some of the fines were excessive but the banks wanted to move on as many more fines laid ahead. America is a very litigous society. Other countries did not fine their banks so ferociously.

America is not desperate for foriegn investors. They are not chasing dollars. Their currency is the worlds reserve currency.

As earlier said, its one of the largest non oil and financial fines ever. MTN is right to challenge the monstrous fine
