The Child Rights Act sets 18 as the minimum age, but not all Nigerian states have domesticated that law. In some parts of the country, especially under customary or Islamic law, marriage is still valid once the girl is considered mature and her family gives consent.
At the time Ned Nwoko married Regina Daniels, there was no legal evidence that she was under 18 her family publicly confirmed she was already an adult, and no official record ever proved otherwise. Allegations about her being younger were mostly internet speculation, not a verified legal claim.
So legally speaking, Ned Nwoko didn’t commit any proven crime. If her parents consented and the marriage followed the applicable customary law in Delta State, then it stands valid in Nigeria.
Also, living in the UK doesn’t mean Nigerian customary law stops applying in Nigeria he followed the law of his home state. Unless there’s solid proof that she was under 18 and that a federal law binding in that state was violated, there’s no legal ground for imprisonment.

Because some people hide to do it doesn’t make it legal. And we have seen how a lot of those marriages have ended. With death of the man. You are just twisting in circles. Rita had been settled by Ned. Of course she will lie. Regina has said she was 17, which matches her father’s claims. There were posts on NL about this in 2019. Ned was more than sufficiently notified that he was marrying an underage. There must have been a reason they lied about her age, a lawyer who is greedy will advise them to, to avoid legal implications.

If it was true that it was indeed Regina Daniel's father that made the voice note, then he is a very irresponsible man. He claimed to be a lawyer. If he is a responsible man that love and cared for his children, why did he not take Ned and his ex wife to court for conducting an underage marriage on his daughter? Where was he all the while, when the ex-wife was raising their children alone? Regina and her siblings obviously had no paternal care or guidance. He was busy raising another family and abandoned his children. If it was in the US , he would be in jail for neglecting his children.

A lot of you guys are just parroting Western (European) law and customs, and applying it to others without looking at their unique socio-cultural background. Even in the US, people marry multiple wives or under 18 girls. One even documented his "bigamy" in a series called sister wives.

Nigeria operates multiple laws, there is tradition laws, religious laws and English law. And the Nigerian constitution recognises all three laws, with only a caveat that the English law is superior. Then there are different laws between the north and south. The south use the criminal code, while the north use the Penal code. Sometimes these two laws are at variance with each other.

Now back to this case. First Ned is Muslim. He married under both Muslim law and traditional law. Muslim and traditional law permits polygamy and underage marriage. Please note that the Nigerian constitution recognises both Muslim law and traditional law. So it would be interesting for someone to sue a man and the families engaging in underage marriage ceremony.

As much as I detest Senator Ned for marrying an underage girl, I blame Regina's mother and her family more. They openly came out to deny Regina was 17 at the time people raised concerns. They claimed Regina was 19 in unison, and they participated in the marriage ceremony, along with their whole community. So how can you then blame Ned for marrying an underage girl? Na him born am?
