NECA flays labour minister over retrenchment in banking sector






Nigeria Employers’ Consultative Association (NECA) has expressed dismay with the position of Chris Ngige, minister of labour and employment, directing banks and financial institutions to suspend further retrenchment of their workers.

NECA at the weekend also directed banks, financial institutions and other employers of labour to ignore the minister’s misplaced directive.

Olusegun Oshinowo, director-general of NECA, speaking against the minister’s directive, said the labour law of the land did not empower the minister to issue such a directive, which he considered “uninformed and populist.”

Oshinowo said the labour laws had envisaged redundancy situation and, therefore, made provisions in Section 20 of the Labour Act to guide the actions of the parties in the event of retrenchment or redundancy.

Oshinowo insisted that “the minister seems not to have shown understanding of the fundamentals of industrial relations and labour laws in Nigeria and thus, has acted ultra vires.”

NECA affirmed that no employer would take pleasure in declaring redundant employees it had invested significant resources in developing over the years. Usually, redundancy exercise is foisted on employers on account of an unhealthy economy and the dynamics of the business, which often demands staff rationalisation.

NECA also reminded the minister that it was part of the inalienable right of an employer to determine the optimal staff level it required to sustain its operations. He noted that employers had rights, which include “the right to hire and fire within the rules governing such employment contract.”

Employers’ rights are “employers’ prerogatives,” which are not subject to ministerial directives,” he said.

He assured the minister that: “Where an employer has found it necessary to carry out retrenchment, it would respect the laws of the land and the laid down procedures for redundancy.

“Employers’ expectation from the minister of labour and employment is that he will work hand in hand with other government ministries in the establishment of the desired enabling environment to ensure business sustainability, competitiveness and job creation.”

The NECA boss advised Ngige to understand that “the ministry of labour and employment runs on the principle of tripartism, which entails regular interactions with trade unions, employers and government.

“The ministry of labour and employment is expected to respect the rights and interests of employers and workers alike on issues that relate to labour and industrial relations.”

Oshinowo particularly deplored the way and manner the minister had been running the affairs of the ministry without respect to the prerogative and rights of enterprise as employers of labour. He recalled an earlier directive of similar nature to the oil and gas sector, with regards to the rights of employers in Nigeria.

According to him, “for a long time, employers have been advocating that the ministry should be headed by a technocrat in order to avoid the kind of disposition being displayed by the minister, which tends towards “populism” and “partisanship” rather than professionalism.”

Party affiliations and senseless hates has eaten the grey matter of so many Nigerians. It is pathetic that i see so called youths, (many unemployed) come online to keep attacking Ngige. Have some people sworn to be slaves all their lives. These useless banks declare mind blowing profits at the end of every year, but at any little opportunity they are looking for excuse to sack Nigerians. Why can't they be patriotic and endure with Nigeria in these hard times rather than mass sack then later they declare mind profits. Many of these banks dont even allow unions, what kind of slavery is that? The annoying thing is they don't even follow laid down procedures for mass retrenchment. They rather employ contract staffs, then sack u at Will. Always looking for cheap labour but are quick to declare huge profits. Imagine waking up in the morning, prepare for work, get to the office, log on to ur username, and u can't log in.... which simply means u have been sacked. You guys can keep being slaves in your country.....

very unfortunate, the same people the govt is trying to protect. For those saying govt has no say in who private employers engage, why do we have Nigerian content act? Many of the so called CEOs today may not be on their seats if not for govt compelling multinationals to employ Nigerians. Ngige did not say don't sack but follow the rule and do it responsibly as last resort. Some people just resume on Monday to discover there passwords have been disabled, is that how to treat a dedicated worker?

Let them keep fooling themselves online. The funny thing is, they suffer the most with their everyday prayer that this govt fails. I have always said it, the worst than can happen is APC loose sit in 2019. But before then, they will suffer so much with what they wish Nigeria, but those in power will keep globe throttling, with their children scattered in different countries, and enough money for their unborn generations.

zombeism- its when you jubilate over the recovery of less than $2b looted fund in expense of Abt $15b loss in foreign direct investment......

buhari nuked the banking sector with TSA.... NOI establish this policy with the aim of implementing it by installmentally withdrawing govt funds from commercial banks to cbn and as well as instantenously reducing commercial bank reserve requirement from 25 billion to 17 billion so the bank liqiuidity remains stable and at equillibrium.........
but buhari just implemented like its a fish cake which now lands us in this quagmire

oga Ngige see what u will do for us... REMOVE Bsc/HBD bi (wateva) and as I get both Bsc & HND mandate my employer to be paying me double salary. that's how it's done in other countries.
