Lagos based lawyer, Ebun-
Olu Adegboruwa, on
Thursday, described the
issuance of a Certificate of
Return to Uchechukwu Ogah
as the new governor of Abia
State as “worrisome,”
saying the ruling All
Progressives Congress-led
government is setting a
dangerous precedent for the
nation's democracy if it is
lying in wait and prodding the
Independent National
Electoral Commission, INEC to
violate the basic tenets of
democracy, which is respect
for the rule of law and due
process.
Adegboruwa in a statement,
opined that the Abuja
Federal High Court’s decision
on Monday cannot be
enforced because Okezie
Ikpeazu, who was removed
as governor, had filed an
appeal, as well as a stay of
execution.

According to him, “There is
said to be a grand plan, now
in its well advanced stage, to
swear in Ogah, who will then
subsequently defect to the
ruling APC, on the excuse of
the fictionalization within the
PDP between Modu Sheriff
and Ahmed Markafi.
“On June 29, 2016, the
sitting governor of Abia
State, Mr. Okezie Ikpeazu,
filed an appeal against the
said judgment, together with
an application for a stay of
execution of the judgment of
court.
“The said application is yet
to be heard or determined by
the court, the consequence
of which is that the judgment
of court cannot be enforced.”
Adegboruwa stated that the
Supreme Court had held that
once an appeal has been
filed against a judgment and
the appellant has also filed
an application to stay the
execution of the said
judgment, the judgment
cannot be enforced, until the
application for a stay of
execution has been heard
and determined.
His words: “It is a
dangerous precedent that
the APC led government is
setting for our democracy, if
it is lying in wait and
prodding INEC to violate the
basic tenets of democracy,
which is respect for the rule
of law and due process.
“In times past, APC
governors and public
officers under its platform
have benefited robustly,
from this hallowed principle
of law, the latest example
being the president himself,
Major-General Muhammadu
Buhari, Retd.
“Very recently, the Federal
High Court dismissed a
preliminary objection filed by
the President, in respect of
the case challenging his
eligibility, for alleged
absence of his WAEC
certificate.
“The President promptly filed
an appeal against the said
ruling and also filed an
application for a stay of
further proceedings before
the high court. The high
court deferred to the
President and adjourned
further proceedings sine
die.”
Mr. Adegboruwa called on
political parties, public
officers, and institutions to
respect the rule of law and
due process of court.
“In one breadth we are told
that the judiciary is the
headache of this present
administration, but when it
suits the same
administration, it frustrates,
intimidates and muzzles the
judiciary, judicial officers and
even lawyers.
“I call on the good people of
Nigeria and all our allies
worldwide and all lovers of
democracy, to demand that
the ruling APC government
give respect to the laws of
the land, to avoid resort to
lawlessness.”

I do not see where I have condemned any of the named personages as guilty. I am indeed right that both have criminal cases in court.

Adegboruwa is becoming too partisan for a lawyer and a rights activist he claims to be.
I still remember his struggles tho... from the days of great Ife (OAU).

All what you're seeing in Abia now has been in the cooking for long and some of us were aware of it before now - watching as it unfolds.

Never again will non-ngwas be regarded as inferiors in Abia. Okwa ya?

I believe the last thing on ogah's mind is defecting to APC, but truth be told PDP has a very poor record of dealing with their aggrieved members. Trust me the best pdp do is to allow dr okezie and ogah settle their scores. Manipulation of any source within the party means death of it in Abia state and it only a matter 2019 the rest of SE. Mark my word for this, politics is now leaving the old crooks and it's time for the young, so playing old cards amounts to getting pawned like you will never imagine. Whether you are hand you have to readjust and play with the time.

For PDP and their e-worriors to leave their problem and start dragging APC into the mud is shared stupidity! My question for these miscreants are:

is it APC that ask Ogah to head to court to challenge the alleged fraud?

Is the allege fraud committed by the erstwhile governor?

Let's assume that APC asked Ogah to go to court to challenge the fraud, when has it become morally or politically wrong for a person or group of persons or party to challenge a fraud?

Does the rule of law which the PDP and their lawyers friends believe in, now give subordinate court (state high court) the jurisdiction to set aside the judgment of a superior court (in this case a federal high court)?

Perhaps the learned colleague should also tell us whether APC cause the faction in PDP that will make it possible for Ogah to defect to their fold.

I need answers to the above questions.

This lawer is fool.... This thing is planned by pdp members in Abia North. See the pix of oga's arrival.... You will see Nkeiru Onyejeocha..... Pdp Current house member representing Isukwuato/umnaochi fed constituency. See the earlier Ikpeazu looks beyond APC and start looking within his party pdp to fish out those who are working against him the better for him.
