Judge Issued Warning To EFCC Not To Re-arrest Chief Fani-kayode. by BERNIMOORE: 9:34am On Nov 16, 2016
“On monday November 14th 2016 at the Federal High Court in Lagos,
Justice Muslim Hassan lambasted the EFFC and its prosecutor, one Mr. Rotimi Oyedepo, in open court for arresting Chief Femi Fani-Kayode at the Federal High Court premises on 21st October without an arrest warrant and for detaining him illegally without any detention order for 24 days. “This was made all the more damning by the fact that Justice Hassan had previously warned the EFCC not to re-arrest Chief Fani-Kayode who had been previously detained by them for 67 days.

“Justice Hassan said this because he had granted Chief Fani-Kayode court bail as far back as July 4th and at the previous court session he had specifically warned and admonished the EFCC not to re-arrest or detain him after his lawyer told the court that that was what they were planning to do. “Justice Hassan told the EFCC that serving charges on an accused person should not warrant arrest and detention and that he himself was once a prosecutor and that was not the way things are meant to be done.

“When Oyedepo attempted to lie to the court and feign ignorance of the re- arrest and detention of Chief Fani-Kayode and when he tried to proffer a shameless and disgraceful justification for it after he was forced to admit that it happened, Justice Hassan advised him to stop trying to defend the indefensible and advised him to tender his apologies to the court for the illegal behaviour of the EFCC. “Oyedepo took the advice and he promptly apologised.

Mtcheew.

U accuse someone of theft, arrest the person, and proceed to trials, u will not, the person is granted bail, certain conditions reached, u arrest am again, u still never try am for the 1st arrest oh, granted bail 2nd time, u still no try am, u wan still arrest am again. My dear, if u have a genuine case for all these arrests, pursue them and stop being a pussy.

That's my take.

If everyone is justifying all these lawless acts by both DSS and EFCC simply because they claimed to be fighting corruption( I don't have any problem fighting corruption). And neglecting the law of the land( u can not claim to be fighting law defaulters when u are actualling giulty of same). If a new party emerges, somewhat opposition to this administration which is not impossible. Trust me, u will wish u were never a Nigerian, because the impunity that will be committed will have children, grand children, great grand children, and even great great great great grand children, becos posterity will be their witness. And no one dares talk because everyone is mute now.

That is why I call it a time bomb.

If someone is corrupt( apparently, the person is a defaulter of the law, maybe by stealing or abusing of office) and u that wants to make corrections and punish the person will do so while commuting same crime u want to punish them of? Who does that?

oyibo repete! So you will pretend that his previous trial is ongoing? or that Efcc cannot bring new charges to an accused person or what? Just because a judge is shouting does not mean he is making any sense. Govt can arrest you again and again as long as they keep discovering crimes ....

Why must he be arrested because of new charges when he didn't jump bail in the first trial, all the need to have done is to interrogate him and charge him afresh or amend the existing charges to include the new one. Re=arresting is punitive and in bad faith
