The Attorney-General and Minister of Justice, Mr. Michael Aondoakaa (SAN) on Tuesday said President Umaru Musa Yar’Adua could perform his official duties from his sick bed at the King Faisal Intensive Care and Research Centre, Jeddah, Saudi Arabia.

Addressing a press conference to highlight the achievements recorded by his ministry in the past one year, the minister advised those calling on the President to resign to take a second look at the 1999 Constitution.

There have been calls for Yar’Adua’s resignation from various interest groups. Also, his refusal to hand over to Vice-President Goodluck Jonathan, in accordance with the 1999 Constitution, has attracted widespread condemnation.

But the justice minister declared that the powers of the President were not exercised territorially. He said that those calling for the President’s resignation were ignorant.

He said, “There is no evidence that he is not exercising his powers as President. He has his vice-president and his ministers whom he delegates power and functions to.

“The powers of the President are not exercised territorially. Yar’Adua can exercise his powers anywhere in the world, on the plane, at the meeting of the United Nations or even on his sick bed, as long as he is not incapacitated by the sickness.


“The President can exercise his powers through the vice-president and ministers while on his sick bed and that is what he has been doing. For example, the Chief Justice of Nigeria wrote a letter to the President and copied me that he would be retiring on December 31, that the President of the Court of Appeal has just retired and that their replacements have not been screened by the Senate.

“I sent the letter to the Principal Secretary to the President who transmitted same to the President who approved it and sent it back to me.”

Aondoakaa cautioned opposition leaders against making utterances capable of destabilising the nation, noting that “the powers of the President are embodied in his body. We don’t want to take issue with the opposition. We shall meet in 2011 and they will not succeed.”

Aondoakaa also said that the probe into the $180m Halliburton scandal was stalled because witnesses gave evidence in French and it had been difficult translating the information to English in Nigeria.


He added that N6bn was paid by the government through his ministry for debts incurred on judgements against federal agencies in 2009. He decried the failure of federal ministries, departments and agencies to heed legal opinion from his ministry. He lamented that this non-challance had cost his ministry huge sums of money in litigation.

He sadi, “The revocation of the Ajaokuta steel complex contract has so far cost government a whopping $2m in legal fees. Government still pays about N12bn to workers in a company that is not working. The ministry is developing a strong internal capacity to offer advisory legal opinions to agencies of government. The core objective of this initiative is to develop a culture of predictability and uniformity in government positions on similar issues across all MDAs.

“We also seek to progressively rely less on external consultancy services and ultimately reduce the government’s liabilities in the handling of legal matters which may sometimes be aggravated by poor legal advice.”

He said the President had asked the Borno State commissioner for justice to investigate the killing of a female corps member, Miss Grace Adie.

Speaking on the National Drug Law Enforcement Agency {NDLEA}; an agency under the ministry, the minister noted that “NDLEA has again received ninth consecutive certification for excellence for taking Nigeria out of the list of countries determined as a major Drug-Transit and major Drug producing countries. Within the first eight months of 2009, the agency has successfully apprehended 4,970 suspected drug traffickers. A total of 48,770,773 kg of various narcotics and psychotropic substances were also seized from illicit drug traffickers”.

Aondoakaa said that under the ministry’s prisons decongestion programme that about 42,000 cases had been given to about 2,500 private legal practitioners across the 36 states of the Federation. “Over 5,000 accused persons have been granted bail while over 3,000 accused persons have been convicted after diligent prosecution. So far about 25,000 cases are still pending in courts with representation from the office of Attorney-General of the Federation,”

He said that in 2009, N1, 815,666,668 was released by government for the programme and that his ministry had achieved 100% utilization of the released amount. “We hope to prosecute the programmed with even greater vigour next year in view of the obvious benefits to our criminal justice system” he added.

Aondoakaa announced that the Nigerian Law School will establish additional campuses in Bayelsa and Adamawa states respectively in addition to the current ones in Lagos , Abuja , Enugu and Kano.

This, he said, would help to maintain a 6-campus structure that would cover all the country’s geo-political zones.

He however said that law school examination would continue to be administered centrally.

“We have extracted concessions from the Adamawa and Bayelsa State governments to complement federal government’s efforts by providing the physical facilities for the two new campuses.”

Comment: Why not, the president and this group of court jesters were not doing much anyway. I guess Andoakaa would support an "absentee" president in the next election too - I 'll like to be a candidate for that   - I don't live in Nigeria and am not incapacitated.

We know what they are setting us up to do. Instead of coming out to explain things to the Nigerian people in plain terms they keep treating us like kids. This AGF particularly keeps showing that he will throw away all common sense to defend the indefensible. I can't get the image of him climbing on a plane to personally intervene on Ibori's behalf out of my mind - that wasn't too difficult. Now, the Haliburton probe is stalled because he cannot find translators to translate evidence given in French to English (see below). For for God's sake, our country is not located at the bottom of the ocean where nobody can see or hear us, although the world is slowly tunning us out, and laughing themselves silly behind closed doors.

Do not blame Aondoakaa, the man is only doing his job.
The way I see things, I think Yaradua will feel better very soon and return back home to carry on. I do not see this guy stepping down or dieing any time soon.

I say get used to it and let's plan for 2011.

It is ridiculous that they are finding it difficult to translate French evidence to English in Nigeria and this is coming from the the Minister of Justice who is also a senior advocate. Who are they fooling? in Nigeria anything is possible, i believe one day they will all pay for all this.

The french language is a rather difficult one, in complexity it rivals with the xhosa, in eccentricity it ranks with the deep ishan language. French is not just a spoken tongue my friends, its also a way of life, ,, like the french kiss, the french rolls, the french cheese, etc. So i believe in the middle of their testimonies, the witnesses kissed each other, they had pastries, and all these have a meaning that must be incorporated into the verbal aspects to give the proper perspective. You don't want the wrong people behind bars now, do you? With a kiss lisa becomes lizard in french. Anyway, the government is in talks with Sarkozy.

Although I agree that Aondoakaa needs to be hospitalised so as to ascertain the wellness of his brain cells (he obviously speak like one who is very sick in the head),  I am insisting that neither him nor his likes are the problems of Nigeria.

Aondoakaa and his likes are mere servants of the "masters". the guy is simply doing his job. Anything less than that will get him fired. These people have no idealogies, and if they have any, it is survival of the animals in the jungle.

They dont have any hope or plan for Nigeria. There love for Nigeria is dependent on the "allocations". They cant survive where justice is in charge.

Aondoakaa is a mirror of the failure of the system called Nigeria. The leadership is hijacked by a cabal who nuture ethinic and religious sentiments to perpetuate themsevles in power.

Remove this Aondoakaa, another like or even worse than him will emerge.

This system can only produce his type.  It is the same system that has produced tyrants like IBB, Abacha, Buhari, OBJ. The same system that gave us a weakling as Head of State, and today, our government is running on "auto pilot".

Since the system can be auto piloted, Yaradua can rule from Saudi even for 20 years. Even if the man is so sick that he cant speak, those who know him very well like his wife, can decode what he has in mind and "government" can continue withour "hazzles?.

Dear Nigerians, is this cartoon network of what?

Yet on a very serious note, it is time to restructure Nigeria. There is too much power at the centre.

the problems with our socio/political/economic settings lie with our lack of punishing below average individuals.

Our society indulge these misfits who were killed off under Nazi Germany under the cover of eugenics. Imbeciles are on the prowl in nigeria and they always think that it is their right to destroy the not many intellectually endowed people. angry

To start with, why is there no much punishment for lack of performance or underperformance. In the past, when the educational system was relatively good, a pupil/student that failed a class is made to take a lower class as compared to his mates. If he repeated this on many occasions, he was made to withdraw and learn a trade. If he fails at that, he becomes a porter (alaaru) in the market or a messenger in an office or any manual labour position.

However this days, they are left as weeds in the vineyard to compete or choke the valuable crops and use up the minerals in the soil. This is the unfortunate situation we are in Nigeria. The under-achievers, the low-IQ gents and ladies, the shallow thinkers, the common thieves and societal miscreats and street urchings are now in power. Any man of substance is seen by them as enemy and summarily assasinated or passivated.

Why on earth are people like El-Ruffai being hunted like a wild animal when his spooky sucessor with no vision is left without any disurbance? why are people like Fashola are under constant persecution while the low-life failure Alao Akala in the next state enjoying inglorious life at the expense of previous, current and future generations of the state? Why would someone as ignorant, as pathetic, as foolish and as unimportant as aondoakaa be the AGF?

I thinks underachievers should be punished in accordance to the position the filled and the level of trust placed in them!

A University graduate that graduated with say ordinary pass or third class should never be allowed to hold any political office!
A Chairman of local government that performed below 70% should be jailed!
A single misguided utterance from any political office holder should attract sack or impeachment!
A non performing ministry for a consecutive period of time should be scrapped!

and so on. Enough, they say, is enough!!

yar adua is our president and so shall he remain till the next 9 yrs plus.
wether he is sick, ill, mad or dead, he will surely see off his record tenue of three terms.

I cant bebelieve this atattorneyeneral of a man,how do we know he is not inincapacitated. Most of his foforeign trips are on medical grounds and now we dont even know when he will be back in the country, on a second thought he has not done us any good when he was here anyway so it make no difference if he is back or not.The fact remains that we need someone with an average bill of health to lead this country at least to set up a certain point of agenda and fufulfilling it, not someone with serious questionable health issues setting up some seven points agenda that he has not got a clue on how to go about it.Anyway as someone said the atattorney general is just tring to stay in his job.
