Order 131 of the Senate Rules states that "nominations neither confirmed nor rejected during the session or within 21 working days in the case of Ministerial nominees shall be returned by the clerk to the National Assembly to the President of the Federal Republic of Nigeria and shall not again be made to the Senate by the President of the Federal Republic of Nigeria". |

Nigeria is in trouble, those who make the law doesn't know the law!!! the law is clear that any law that is inconsistent with the provision of the Constitution is void to the extent of its inconsistency. I refer you to section 1 of the 1999 Constitution as amended. see also section 11 of the interpretation Act backed by section 171 of the Constitution. Section 11 of the interpretation Act says where a nominees that was sent to the National Assembly for confirmation but was rejected or fail to be confirmed, the president should re send his name for confirmation, but if he further fails to be confirmed, the nominee should continue to act as an acting chairman at the pleasure of the president. by implication, if the president decided to allow magu to continue as an acting chairman, magu would continue to act through out the tenure of Mr. president 2 Likes |

Surely there must be some strong reasons why PMB wants Magu as his anti corruption Czar. If there are valid basis for his recommendation for the job, the Presidency should just empower him to continue in acting capacity until Nigerians REALLY begin to see his effectiveness or lack of it. We've become too used to personalised governance that's why we don't recognise n respect institutions rather we go on and on about the person. Why should the leadership of the EFCC be so personal to d president that he'll retaliate against the Senate because they didn't confirm his nominee? Is the Senate bound to confirm all his nominees as per rubber stamp with no power or discretion? but the rule he is quoting used the word 'neither' and not 'either'...This guy does not understand the rule and is interpreting it backward. And EFCC is not a ministerial and not subject to the 21 working days criteria.
