So it turns out the President did not have to send Magu's name to the Senate for confirmation after all. An erudite lawyer, Jibrin Samuel Okutepa (SAN), gave a free lecture this morning on AIT's Focus Nigeria. He quoted a section of the constitution to buttress his point, section 171 of the constitution to be precise.

EFCC being a department in the Justice Ministry does not require anyone heading it to be confirmed by the Senate.
.
One is bound to ask, why did the AGF not advise the President accordingly? Why did he allow the President to send Magu's name to the Senate for confirmation? The Senate too ignorantly seized the opportunity to blackmail Mr. President.

Now that three very senior lawyers in the persons of Jibrin Samuel Okutepa (SAN), Prof. Itsey Sagay (SAN) and Femi Falana (SAN) have all agreed that it was wrong to send Magu's name to the Senate for confirmation in the first place, what next?

Jibrin Okutepa (SAN) suggested the President writes the Senate informing them that Magu's name was sent to them for confirmation in error. The President should quote the section of the constitution that gives him the power to appoint a Chairman of EFCC without recourse to the senate. He should then go ahead to announce Magu as the substantive Chairman of the Economic and Financial Crimes Commission. Shikenan!!

The AGF needs to sit up. All this confusion arose because he failed to advise the President accordingly.

This is good coming from the 'backward' Northern lawyers.
However, it is still debatable whether the EFCC is an appendage of the Justice Ministry to give effect to section 171 of the 1999 Constitution cited by the Senior Advocate .
