Oga read am wella, the ATM default policy is to refund you after 24 hours... The man has not got a refund after months, with their customer care throwing you jab as if it's not your pay .

Let him sue their ass... even if h doesn't get any compensation, it will send a very strong signal to them, to always address customers nicely.

Did u read where they said he is a customer of diamond bank, that means on this case he can't sue access...diamond bank should handle his complaints

from 50% of the responses on this topic, i can deduce that this country is devoid of hope for a better tomorrow.
A man has been maligned by a business that is set up for profit, he is seeking compensation and most people here are finding it funny and amusing.... it is a big shame!

You people should go and educate yourselves on how the legal process works so as to be better informed.

Yet, a good number of you are dreaming of moving to america or somewhere in europe.... have you asked yourselves why businesses in these places, especially the big ones don't joke around with any customer - even the least of them? The slightest mistake that causes any customer grief will see you paying your half years profit as compensation to that customer. The lawyers and the judicial systems in these countries live for these type of cases and that is why every aspect of their society functions the way it should. Social advancements and inventions for better living usually come from these type of law suits. Imagine if every single person that feels wronged by any business files a lawsuit and claims damages, do you know how many businesses - both government and private that will step up their game and procedures?

for example.....

In probably the most famous example of a seemingly trivial legal action is Liebeck v. McDonald’s Restaurants, also known as the McDonald’s coffee case and the hot coffee lawsuit

In 1992 Stella Liebeck, a 79-year-old woman from Albuquerque, New Mexico, bought a cup of coffee from a drive through McDonalds and as she removed the lid, spilled the entire cup of coffee on her lap.

She was wearing cotton sweatpants; they absorbed the coffee and held it against her skin, scalding her thighs, buttocks, and groin.

Hospitalized for eight days while she underwent skin grafting, followed by two years of medical treatment she sued the fast food giant claiming it was too hot and more likely to cause serious injury than coffee served at any other establishment.

She won an astonishing £1.7million.

As a result of this, McDonald's stopped serving extremely hot coffee, except on request by the customer.

Do you think what the man is doing

up there in the story is still trivial? undecided

Story. .....

I think u should also do well to study how banking works. ....I can't believe the man is a lawyer and doesn't understand a simple process as dispense error reversal process. And he could not even make enquiries before showcasing his ignorance. As far as access bank is concerned, they don't have any business with him. Let him go and bring in his bank as the mediator.

This is a step in the right direction. Not everyone will sit down in the comfort of there home and wait for miracle that will change the postures of our banks. I give kudos to this lawyer, either he's hungry or not, that is not the bone of contention. Look at CBN , doing nothing as banks went on rampage by fixing indiscriminate rate for online purchases. It's unfortunate. Maybe if they have attended to the lawyer and do the needful, he might not go to court. This will serve as different to our banks

It's actually a right step in the wrong direction. The suit should be against diamond bank not access. ...that's if he had complained to diamond and they didn't do anything.

Re: Nigerian Lawyer Sues Access Bank For Failed ATM Transaction, Demands N100m by Rexology: 9:22pm On Jun 01, 2017
The man has no Locus Standi to sue Access Bank because of the followings:
1.He is not an account holder with Access Bank.
2.It was not Access bank that debited his account.
3.He has no contract with Access bank.
4.He is a third party customer.
5.Access Bank cannot reverse the transaction.
Access Bank has no case to answer, therefore the case would be thrown out at first hearing. Infact a cost should be awarded against the plaintiff for abuse of court process.

Hahahahaahaha cheesy grin! That's why typical Nigerians have been eating shyt for the past 3 - 4decades seeking messiahs that will never come because they chose to settle for less always been "typical" instead of being:
- extraordinary
- change-inducing
- revolutionary
- nationalistic
- unconventional

After all the sacrifice, what has it amounted to?

Don't tell this to the Pensioners dying on the Pension Queues o!
And pls, don't raise your children to be "typical Nigerians"!

Abeg, leave all the worthless slaves who see themselves as undeserving of anything good in life, not even qualitative services, fairness and accountability for their money's worth!

This is what you get when "school-cert-failed" dropouts flood forum with their "empty-fuel-tank" brains; they don't even understand that, by siding the Bank, they're actually promoting corruption.

What if that #40k was the Lawyer's last cash that was meant to pay labor-ward bills for his pregnant wife? And bank having ate it, caused him to lose both wife and child to protracted labor and abandonment, as Naija hospitals usually do? Will these keyboard-warriors and nitwits be typing the same accursed f00lishness they're typing upandan now?

Many of them nor get brain, stop giving them audience, some are even under curse sef and it oozes out in every expression of their personalities! That is how insulting it presently is being a Nigerian, you get to share nationalities with the world's greatest gang-up of imbeciles angry!
