Justice Adeniyi Ademola of a Federal High Court in Abuja on Wednesday resumed sitting following his recall by the National Judicial Council last week.

Justice Ademola was among the six judges earlier asked by the NJC to stop sitting, shortly after raid conducted by the State Security Service on his house and other judges’ in October last year.

But the NJC, in a statement through its Director of Information, Mr. Soji Oye, stated on Saturday that Justice Ademola should resume his judicial duties on the basis that the court had exonerated him of the charges preferred against him by the Federal Government.

Five other judges were also asked to resume on the basis that the Attorney-General of the Federation and Minister of Justice, Mr. Abubakar Malami, had failed to institute charges against them since October last year when the minister requested the NJC to suspend them pending the outcome of the cases against them.

The NJC had said the development had led to backlog of cases in the various courts where the judges presided.

All the judges were therefore asked to resume sitting on Wednesday.

Justice Ademola commenced sitting after 9am on Wednesday.

Seven cases were listed for the Wednesday’s court session.

A Senior Advocate of Nigeria, Mr. Joe Agi, with whom Justice Ademola was tried on corruption allegations but later discharged, had his case come up before the judge on Wednesday.

Agi, being the only Senior Advocate of Nigeria, his case, although listed as number six, was heard first.

When the case was mentioned, the defence was not represented in court.

Agi, who was the plaintiff’s lawyer, however, sought the withdrawal of the case on the grounds that it had been overtaken by event.

The judge granted the application and struck out the case.

The SAN took his leave from the court immediately after the case was struck out.

He declined to speak with journalists waiting outside the courtroom.

But a lawyer, Mr. Femi Morohundiya, who was in th court, addressed journalist and welcomed Justice Ademola back.

Morohundiya also justified the recall of the judge, following the judge’s acquittal by the trial court earlier this year.

The lawyer said, “It is a welcome development. The Senate President is being tried by the executive, yet he is still sitting as the Senate President. This judge has been cleared.

“So it is a welcome development that he is back to the judiciary to continue his work.”

Useless FG,why prosecute someone when you have no evidence to nail him. If i am the Judge I will sue them for defamation

Very true. The Judiciary has respected the Executive enough and 8 months is enough time to file charges against people they already indicted to the press n public. If they had nothing they should have shut up until ready. Courts will not remain empty and justice denied those who seek it cos some petty buffoons are unable to get their shït together.

Senate President is on trial and still sits in plenary so the judges must rightfully resume and do their jobs. Ajumogobia and Ngwuta should have been recalled too.

Nine months. They have been on suspension since the first week of October 2016.

The judiciary has been the bastion of corruption for a long time, the safe haven for corrupt politicians. Since Kastina Alu became CJN the judiciary has gone to the dogs. A judge has over a million US dollars in his house yet the court threw out the case for lack of evidence. Well the real solution to Nigeria's corruption problem is a violent revolution.
The Judiciary has now joined the executive and the legislature in protecting " their own". How much is the judges salaray what business is he engaged in that he made a million dollars from it. It is only in Banana Republic Nigeria that a judge standing trail for corruption will return back to the bench to dispense "justice". Judges own several houses in Maitama, Asokoro, Wuse2. These houses cost several hundreds of millions of naira where did they get the money. Well we all know. It is better to have a thousand corrupt politicians than one corrupt judge.

Somebody is very unserious, and I'm betting it's the EFCC plus FG plus Attorney General.

So, you wasted taxpayers my money distracting a judge, without concrete evidence to send him to jail or at least get him disqualified.

Either your lawyers are incompetent or yourselves are.

is able to prove that the money was illegally acquired.
The burden of proof is on the prosecutor not the accused.

What other advance democracies did on time to survive and provide for the welfare and well being of their people was to weed out criminals like justice Ademola by every means possible. You sit there talking law and evidence crap, When corruption has almost consumed every fabric of our society. Even if the evidence were brought from heaven the corrupt judiciary that is bent on sabotaging the system to set one of its own free will still claim" lack of evidence" BS.

The battle against corruption, just like the war against gangs in the 60s, 70s in America and the war against the mafia in Italy can NEVER be fought conventionally. There will be need to take care of the criminals and sympathizers like you unconventionally if we want to win this war.

Also find out from Hong Kong how they dealt with the issue of endemic corruption and organised crime. Like I said earlier it is better to have a thousand corrupt politician than one corrupt judge. So you know how many toxic judges we need to take out now. You saw the Dino and the judge asking for the money be paid in USD.
