Why is it that members of PDP just prefer to utter plain gibberish all in a bid to defend the president's "AWOL" It is obvious that they all have capitalized on the loophole in the constitution to keep their Cabal in control long enough,  undecided



Former Works Minister and chieftain of the PDP, Engineer Adeseye Ogunlewe has cautioned agitators for take over of the office of the President by his deputy, Dr Goodluck Jonathan.

Speaking with Saturday Sun in an exclusive interview, Ogunlewe submitted that since the ailing president did not notify the National Assembly of his intention to transmit power to his deputy as provided for in the constitution , any attempt to transmit power to Jonathan would amount to treason, as it runs against the process highlighted in the constitution.
Excerpts:

Let us start with the state of the nation: a president whose Sate of health is shrouded in secrecy and Nigerians are worried that why is it so difficult for PDP to let Jonathan take over, after all he isn’t from any of the opposition parties

Look it isn’t a PDP matter, it is a constitutional matter. All those people who are clamouring for something that isn’t covered by the constitution, they are only being a little but mischievous and it’s unfair .The constitution has protected the president to be absent as long as undefined in the constitution. Section 145 indicated that, if he transmits; if he doesn’t transmits there is nothing that anybody can do . But that is the lacuna in our constitution and unless and until that is removed.

Our constitution never anticipated what is happening now, so there is no provision for it. My fear is that people shouldn’t just drift into areas of treason.


How do you mean?
If you do anything that isn’t covered by the constitution it is treason so people should be careful. There’s nothing anybody can do .

But the same constitution envisages this and said, if a sitting president knows that he would be away for long, he should write to the National Assembly so that the VP can act in his absence.
If you don’t do so, what does the constitution say? There is no sanction. That is the area I am talking about; he has been protected that if he doesn’t act, there is nothing anybody can do. If the constitution has specified that if you don’t do so these are the consequences then we will be talking.


But the president can’t be larger than the nation…
[cuts in] It is the constitution that is larger than the nation, it isn’t the individual. He has been protected by the constitution, by the word, ‘If ‘ and there is nothing anybody can do.
