Senate Considers Bill On Life Jail For Corrupt Public Officials by Nobody: 6:24pm On Feb 16, 2010
The Senate has begun consideration of a Bill
seeking life jail for corrupt public officials in
the country.
The Upper House has read the Bill,
sponsored by Senator Smart Adeyemi (PDP,
Kogi West), for the first time.
The bill is titled: “An act to provide for the
imposition of special punishment on
persons found guilty of economic sabotage
and other matters connected therewith.”
It seeks to punish officials who corruptly
enrich themselves with public funds.
The Bill, which prescribes life jail for those
who are guilty of the offence, specifies that
five years of the life jail will be spent at a
mechanised farmland of the Nigerian Prison
Service in the state where the offence is
committed.
The highlights of the bill, which short titled
was read last Thursday, are: “Any person
who fraudulently takes or converts to his
own use any sum of money amounting to
five million naira or more being the
property of the Federal Government of
Nigeria or of a State or Local Government in
Nigeria shall be guilty of economic
sabotage.
“Any person who fraudulently diverts any
public fund amounting to five million or
more being the property of the Federal
Government of Nigeria or of a State or Local
Government in Nigeria into his private
account shall be guilty of economic
sabotage.
“Any person who receives any payment or
revenue amounting to five million naira or
more on behalf of the Federal Government
of Nigeria or of a State or Local Government
and intentionally refuses to pay such fund
into the appropriate government account
shall be guilty of economic sabotage.”
A statement issued yesterday by Adeyemi’s
Special Adviser (Media), Dickson Adeyanju
said, “The bill also seeks to empower the
Attorney-General of the Federation or that
of the State Government to constitute a
special panel which will investigate such
allegation."
The panel, the statement added, will be
made up of "a legal practitioner, a reputable
member of Nigerian Union of Journalist, a
Police officer not below the rank of a Chief
Superintended of Police, a senior counsel in
the Ministry of Justice and a person of
unquestionable integrity from a reputable
civil society group, which will investigate
such allegation upon which the Attorney-
General will prefer criminal charges against
such a person.”
